Minutes - 2022 - City Council - 04/12/2022 - Regular EAGLE CITY COUNCIL MEETING MINUTES April 12,2022 1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m. 2. ROLL CALL: Present: GINDLESPERGER, PIKE, BAUN, RUSSELL. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: 4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA: A. City Staff requests.: None B. Mayor or City Council requests.None 5. PRESENTATION: A. Valley Regional Transit Service Planning Discussion(NBS) Steven Hunt Regional Director for Valley Regional Transit: Mr. Hunt reviews options for expansions to services to Eagle and possible costs associated with the same.Council member Pike and Russell, liaisons to the Eagle Senior Center and Valley Regional Transit(respectively)discuss recent meetings with those entities and challenges that currently need to be addressed. Discussion regarding transportation options and costs associated with the same. General discussion. 6. REPORTS: A. Mayor and Council Reports: Pike reports on the Urban Renewal Agency, Downtown Advisory Committee,Comprehensive Plan Review Committee,Eagle Sewer District,and the Eagle Senior Center Board meetings. Gindlesperger reports on the Animal Control Committee meeting. B. City Hall Department Supervisor Reports: Director of Long-Range Planning and Projects provides an update on the Comprehensive Plan Review Committee meeting. C. City Attorney Report: None 7. PUBLIC COMMENT 1: The Eagle City Council is taking both in-person and remote public comment via WebEx. Meeting login instructions are posted on https://www.cityofeagle.org/1698/Virtual-Meeting. If you just want to watch the meeting, without giving comment, please watch our livestream at https://www.cityofeagle.org/305/City-Agendas-Videos. This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek comments/opinions regarding specific City matters during this allotted time.This is not the time slot to give formal testimony on a public hearing matter,land use application,or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. James Burton 1896 N. Eagle Road Eagle,Idaho. Mr.Burton would like to address the speed limit change on Eagle Road. Mr.Burton is seeking an explanation for why the speed limit was reduced. He does not feel that this change resulted in an improvement. Mayor Pierce addresses the impetus of the change in speed limit. Discussion. 8. FPUD-09-21 & FP-15-21 — Final Development Plan and Final Plat for Mosey Hill Subdivision — Greg Hall: Greg Hall, represented by Kent Brown, is requesting final development plan and final plat approvals for Mosey Hill Subdivision,a 58-lot(53-buildable, 5-common)residential planned unit development.The 28-acre site is located on the south side of West Beacon Light Road approximately 100-feet west of North Lanewood Road at 6001 West Beacon Light Road.(MNB) D. Cost Share Agreement Between the City of Eagle and B.B. One,LLC: A Cost Share Agreement between the City of Eagle and B.B.One,LLC for North Channel Center Trail Bank Repairs with the City's amount not to exceed$10,000 for design and engineering and$50,000 for permitting and repair.(NBS) E. Approval of the Donation of a Tree:A donation of a Shade Master Honey Locust tree in celebration of HC Company's twenty years in business to be located at Guerber Park.(ELZ) F. Reappointment to the Design Review Board: In accordance with Resolution 14-19, Mayor Pierce is requesting Council confirmation of the reappointment of David Duperault to the Design Review Board. Mr. Duperault will be serving a three(3)year term that will expire April 2025.(JWP) G. Award of Horseshoe Bend Road Water Main Extension—North Bid: After review of the bids received, staff is recommending the award of the Horseshoe Bend Road Water Main- North project to Knife River Corporation — Mountain West in an amount not to exceed $700,735.00. (KRA) H. Consulting Services — Human Resources Compensation Services Agreement. An agreement between the City of Eagle and AmeriBen for consulting services. Staff is requesting ARAP funds be utilized for these services. (TEO) I. Proclamation for Sexual Assault Awareness Month: A proclamation declaring April as Sexual Assault Awareness Month in the City of Eagle. (JWP) J. Professional Service Agreement Between the City of Eagle and Ecosystems: A Professional Service Agreement between the City of Eagle and Ecosystems for the Environmental and Cultural Baseline Survey for the Eagle Shooting Sports Park in the amount not to exceed$9,935.00. (NBS) K. Eagle Fun Days Poster Design: An agreement between the City of Eagle and Red Couch Creative for graphic design services for the 2022 Eagle Fun Days Poster for an amount not to exceed $1045.00.(EAM) L. DR-03-22 — Common Area Landscaping for Parkway Development, including an Office (medical and dental) Building for Parkway Dental and Phasing Plan — Mike Spencer: Mike Spencer, represented by Jessica Petty with 12.15 Design, LLC, is requesting design review approval for the common area landscaping within Parkway Development, including a 3,000-square foot office (medical and dental) building for Parkway Dental and phasing plan.The 1-acre site is located on the south side of East State Street approximately 75- feet west of the intersection of East State Street and South Young Lane at 577 East State Street. (ERG) M. Service Contract Between the City of Eagle and Fireworks America: A service agreement between the City of Eagle and Fireworks America for the pyrotechnic public display for Eagle Fun Days display in an amount not to exceed$20,000.00(BLA) N. Local Professional Service Agreement - Engineer of Record Local — Eagle Road Pedestrian/Bike Bridge: Approval of the Local Professional Services Agreement with TO Engineers and Horrocks Engineering to serve as the engineer of record for the Eagle Road Pedestrian Bike bridge in the amount not to exceed$42,223.39. ACTION ITEM: RZ-16-21 & PP-16-21 — Rezone and Preliminary Plat for Cadenza Court Subdivision—MJV Properties,LLC: MJV Properties,LLC—Mike Groff,represented by Jay Gibbons with South,Beck,and Baird,is requesting a rezone from R-4(Residential)to R-6-DA (Residential with a development agreement) and preliminary plat approval for Cadenza Court Subdivision, a 14-lot(8-buildable, 5-common, 1-private street) residential subdivision. The 1.38- acre site is located on the east side of South Parkinson Street approximately 35-feet south of the intersection of South Parkinson Street and East Syringa Street at 540 South Parkinson Street. (MJW) Mayor Pierce introduces the item. Jay Gibbons 2002 S. Vista representing MJV Properties reviews the application and areas of applicant concern. Mr. Gibbons states that the applicant agrees to participate in Conservation Education Program funds. Mike Williams, Planner III reviews the staff report. Mayor opens the public hearing. Mark Butler 1675 E. Bishop Way Eagle,Idaho. Mr. Butler is supportive of this development. He addresses the setback condition on 6,8,3,4,2 and suggests a modification. Mr. Gibbons rebuts testimony regarding street layout, open space, tree plantings and staff recommended conditions. General discussion. Mayor closes the public hearing. Baun moves to approve action 9A RZ-16-21 & PP-16-21 —Rezone and Preliminary Plat for Cadenza Court Subdivision with the following site conditions: #6, 7, 8, 9, 18, 23 and 25 as stated,with#6 being changed to include lots 2,3,4,6 and 8.And adding site specific condition #26 the CEP funds per the applicant.Seconded by Pike. Discussion.Elevations not to exceed 2 stories.25'back of curb.Seconded concurs.Discussion.Baun amends this motion to include that elevations should not exceed two stories,and site specific condition #6 to add "25' from back of curb". ACTION ITEM Request For Proposal (RFP) for Heritage Park Renovation: Review and approve the Request for Proposals for the Heritage Park Renovation Capital Plan Project PW CM-1 (NBS) Mayor Pierce introduces the item. Director of Long-Range Planning and Projects,Nichoel Baird Spencer reviews the draft request for proposal and discusses funding for the renovation. Pike moves to approve action item 10A as explained by staff. Seconded by Baun. ALL AYE...MOTION CARRIES. B. Fiscal Year(FY)2022 Capital Plan Review:Mid-year review of the City's FY 22 Capital Plan including projects and maintenance in preparation for the FY 23-27 plan.
