MEETING MINUTES
April 21,2022
1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m.
2. ROLL CALL: Present: GINDLESPERGER, PIKE, BAUN, RUSSELL. All present. A
quorum is present.
3. PLEDGE OF ALLEGIANCE:
4. NEW BUSINESS:
A. ACTION ITEMS Authorization of Payment to TDX Power Services,LLC, in the
amount of$48,450.00,for the partial completion of Project CM-2(Greenbelt Bank&Trail
Repairs and Mitigations),awarded by Council on 2/8/2022 for a total cost of$1,397,020.00. This
is the first monthly request for payment. (STN)
Mayor Pierce introduces the item.
Pathways and Trails Superintendent, Steve Noyes briefly reviews the payment request and gives
an update on progress of the project.
Gindlesperger moves to approve action item 4A Authorization of Payment to TDX Power
Services,LLC,in the amount of$48,450. Seconded by Pike.Gindlesperger AYE;Pike AYE;
Baun AYE; Russell AYE. ALL AYE...MOTION CARRIES.
5. EXECUTIVE SESSION:
A. Idaho State Code 474-206.Executive Sessions--When authorized.(1)An executive session
at which members of the public are excluded may be held, but only for the purposes and only in
the manner set forth in this section. The motion to go into executive session shall identify the
specific subsections of this section that authorize the executive session. There shall be a roll call
vote on the motion and the vote shall be recorded in the minutes. An executive session shall be
authorized by a two-thirds(2/3)vote of the governing body.An executive session may be held:
(e) To consider preliminary negotiations involving matters of trade or commerce in which the
governing body is in competition with governing bodies in other states or nations;
(f) To communicate with legal counsel for the public agency to discuss the legal ramifications
of and legal options for pending litigation, or controversies not yet being litigated but
imminently likely to be litigated. The mere presence of legal counsel at an executive session
does not satisfy this requirement;
Pike moves move pursuant to I.C. 74-206(1)that the City of Eagle convene an Executive
Session for the purpose of(e) to consider preliminary negotiations involving matters of
trade or commerce in which the governing body is in competition with governing bodies
in other states or nations. Seconded by Russell. Gindlesperger AYE; Pike AYE; Baun
AYE; Russell AYE. ALL AYE...MOTION CARRIES.
Council enters executive session.
Council discusses negotiations involving matters of trading or commerce and
pending/threatened litigation.
Council exits executive session.
