ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY IDAHO, ADDING EAGLE
CITY CODE TITLE 5 "POLICE REGULATIONS", CHAPTER 1 "MINORS",
SECTION 2 " UNCONTROLLABLE CHILDREN" AND PROVIDING AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF EAGLE, ADA COUNTY, IDAHO:
Section 1: Any person under the age of eighteen (181 may be declared beyond control of
his parents. guardians or legal custodian who persistently or habitually refuses
to obey reasonable and proper orders or directions of his parents. guardians or
legal custodians. where that specific conduct may place him in danger to
himself or others or becomes so unreasonably disruptive that it ieopardizes the
family unit. A person under the age of eighteen (181 may be taken into
custody by a peace officer if the peace officer has reason to believe that the
child's continued liberty poses an imminent danger to that child or to others.
as evidenced by a threat of substantial physical harm or upon complaint by the
person's parent. guardian or legal custodian that said person's specific conduct
is so unreasonably disruptive that it ieopardizes the family unit. Whenever a
child is taken into custody under this Section without court order. the evidence
supporting the claim of imminent danger must be presented to a duly_
authorized court on the next iudicial day.
Section 2: This ordinance shall take effect and be enforce from and after its passage,
approval, and publication as required by law. In lieu of publication of the Ordinance, a
summary thereof in compliance with Section 50-901A Idaho Code, may be published.
