Minutes
1. CALL TO ORDER: Meeting called to order at 6:03 p.m.
2. ROLL CALL: Present: WRIGHT, GUERBER, MCLAUGHLIN, SMITH. MCCAULEY Absent:
None. A quorum is present.
3. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS.
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will
be no separate discussion on these items unless the Chairman, a Commissioner, member of City
Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items
removed from the Consent Agenda will be placed on the Regular Agenda in a sequence
determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval

A. Minutes of April 4, 2022.
B. Findings of Fact and Conclusions of Law for the Approval of CU-03-22 — Change of
Nonconforming Use — Craig R. Shotwell: Craig R. Shotwell is requesting conditional use
permit approval for a change of nonconforming use to allow an addition to the existing residence
(located within the required front yard setback). The 2.00-acre site is located on the north side of
the terminus of West Rush Court at 741 West Rush Court. (MJW)
McLaughlin moves to approve the consent agenda as presented. Seconded by Smith. ALL
AYES... MOTION CARRIES.

A. ACTION ITEM- CU-05-21/PPUD-05-21/PP-07-21 — Millstone Farms Planned Unit
Development — Brent Thompson: Brent Thompson, represented by Tamara Thompson with The
Land Group Inc., is requesting conditional use permit, preliminary development plan, and
preliminary plat approvals for Millstone Farm Subdivision, a 338-lot, 311-unit (245-single-family
dwellings, 3 3 -single-family attached dwellings [located within 66-lots], 27-common [inclusive of
3 shared access lots]) residential planned unit development. The 89.87-acre site is located at the
northwest corner of North Palmer Lane and West Floating Feather Road at 2871 North Palmer
Lane. (MJW) This item was continued front the April 4, 2022 Planning and Zoning Commission
meeting.

overview of the application.

MOTION: Smith moves to recommend approval CU-05-21/PPUD-05-21/PP-07-21 —
Millstone Farms Planned Unit Development — Brent Thompson with the understanding that
item specific condition #15 as requested by the applicant and approved by Mr. Williams,
City Planner, that would make that condition with the words that he recommend earlier so
as modified to indicate that it could be taken out at the end of the development.
McCauley seconds.
Discussion amongst the Commission.
Planner Williams requests the inclusion of elevations provided by the applicant's representative
as part of the motion of approval.
Smith moves to withdraw original motion. ALL AYES ... MOTION CARRIES.
Smith moves to recommend approval CU-05-21/PPUD-05-21/PP-07-21 — Millstone Farms
Planned Unit Development — Brent Thompson to recommend approval with the exception
of the modification on Site Specific Condition #15 and also a recommendation that the road
cross section as recommended by Planner Williams is included.
Planner Williams provides clarification on staff s request.
Smith includes the clarification as stated by staff.
McCauley seconds.

B. ACTION ITEM. A-12-21/RZ-18-21 & PP-19-21 — Farmstead Landintz Subdivision — WH
Eagle 80, LLC: WH Eagle 80, LLC, represented by Dave Yorgason, is requesting an annexation,
rezone from RUT (Rural -Urban Transition — Ada County designation) to R-2-DA (Residential
with a development agreement [in lieu of a PUD]), and preliminary plat approvals for Farmstead
Landing Subdivision, a 167-lot (140-buildable, 27-common) residential subdivision. The 80.23-
acre site is located on the north side of West Floating Feather Road between North Park Lane and
North Linder Road. (MNB)

concerns related to buffering on the northern border of their development.
Adcox responds to questions from the Commission.
Rebecca Van Camp, 4719 West Braveheart Street. Van Camp opposes the application, and
expresses concerns related to buffering and landscaping between the development and the Bella
Terra Subdivision.
Van Camp responds to questions from the Commission.
Ken Collar, 4695 West Montage Drive. Collar opposes the application, and expresses concerns
related to buffering and disrupting the existing feel of the Bella Terra Subdivision.
Garrett Curr, 4451 West Braveheart Street. Curr opposes the application, and expresses concerns
related to buffering between the proposed development and the Bella Terra Subdivision.
Curr responds to questions from the Commission.
Brian Graham, 3855 West Lorenzo Lane. Graham is attending remotely via WebEx. Graham
supports/opposes the application, and expresses concerns related to groundwater and hydrology
reports.
Dana Lombardi, 4369 West Braveheart Lane. Lombardi supports/opposes the application, and
expresses concerns related to the applicant's fencing plan and the preserving the rural feel of the
City of Eagle.

Curtis Gonzales, 1435 North Weldon Place. Gonzales opposes the application, and expresses
concerns related to farming equipment access off Floating Feather Road, groundwater/hydrology,
and construction traffic mitigation plan.

concerns related to property values.
Grant Brody, 4601 West Braveheart Street. Roddy opposes the application, and expresses
concerns related to buffering and landscaping between the development and the Bella Terra
Subdivision.
Jerry Hild, 1822 North Montarosa Way. Hild opposes the application, and expresses concerns
related to access connections to the Bella Terra Subdivision and provides comment relating to
bike lanes on nearby roads.
Hild responds to questions from the Commission.
Mike Lombardi, 4369 West Braveheart Lane. Lombardi opposes the application, and expresses
concerns related to fencing on the proposed development.
Sheridan Hodson, 5772 North Asissi Lane, Meridian ID. Hodson supports the application, citing
the care put forth into the production of the application.
Rodge Treveti, 1789 North Montarosa Way. Treveti opposes the application, and expresses
concerns related to traffic and growth in the City of Eagle.
Mary Colewell, 1873 North Livorno Avenue. Colewell opposes the application, and expresses
concerns related to pickleball noise.
Mike Ewing, 4761 Montage Court. Ewing opposes the application, and expresses concerns
related to maintaining the property values of the Bella Terra Subdivision.
Jim Milano, 4734 West Montarosa Way. Milano is neutral towards the application, and expresses

concerns related to slowing down growth and rapid growth.
Rebecca Van Camp, 4719 West Braveheart Street. Van camp provides additional comment
relating to buffering towards the Bella Terra Subdivision.

McLaughlin moves to approve A-12-21/RZ-18-21 & PP-19-21 — Farmstead Landing
Subdivision — WH Eaele 80, LLC with the following condition: add ssc2 to require
additional landscape screening along all the northern border of homes.
Guerber seconds.

McLaughlin moves to approve A-12-21/RZ-18-21 & PP-19-21 — Farmstead Landing
Subdivision — WH Eagle 80, LLC with the following sscs added: that the setbacks requested
by the applicant be allowed with a reduction on lot coverage to 40% and rear setback of
25ft instead of 30, that the private streets be allowed per achd, and the pond easement be
reduced to 12ft to 30ft.
Planner Bessaw provides clarification on requested conditions from staff.
Mclaughlin: Increase the lot coverage to 50%, the interior side setback be 7.5 feet with a
second story setback of an additional 5 feet. Provide a landscape buffer with the entirety of
the northern boundary. That open style fencing be required.
Guerber seconds. ALL AYES ... MOTION CARRIES.
NEW BUSINESS:
A. VAC-01-22 — Vacation to the Final Plat of Renovare Subdivision No. 2 — Lincoln Swa art:
Lincoln Swaggart, represented by Jeff Beagley with Sawtooth Land Surveying, LLC, is
requesting to vacate a portion of the emergency vehicle assess easement (EVA), and a portion of
the utility easement located within Lots 56 and a portion of 65, Block 1, Renovare Subdivision
Phase 2. The 4.34-acre site is located at the southwest corner of East Riverside Drive and South
Stellar Cove Avenue. (MJW)

Guerber moves to approve VAC-01-22 — Vacation to the Final Plat of Renovare Subdivision
No. 2 — Lincoln Swaf!2art with staff recommendations included. ALL AYES ... MOTION
