ROLL CALL: Present: WRIGHT, GUERBER, MCLAUGHLIN, SMITH, MCCAULEY. A quorum is present. 3. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS. ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of March 21, 2022. B. Findings of Fact and Conclusions of Law for the Approval of PU-01-21 — Spring Valley Planned Unit Master Plan No. 1 — GWC Capital, LLC: GWC Capital, LLC, represented by Brook Cole, is requesting approval of Planning Unit Master Plan (PUMP) No. 1 for the Spring Valley Planned Development (fonnerly known as M3 Spring Valley). PUMP No. 1 consists of 1,005.91-acres, 2,200 residential units, 150,000 sq. ft. of non-residential uses, and 504.39-acres of regional and community open space. The 1,005.91-acre site is generally located 3,000-feet northeast of the intersection of State Highway 16 at Equest Lane (approximately 1 mile north of the Beacon Light Road and Linder Road intersection). PUBLIC HEARINGS: ALL PUBLIC HEARING ITEMS ARE CONSIDERED ACTION ITEMS. A. ACTION ITEM. CU-03-22 — Change of Nonconforming Use — Craig R. Shotwell: Craig R. Shotwell is requesting conditional use permit approval for a change of nonconforming use to allow an addition to the existing residence (located within the required front yard setback). The 2.00-acre site is located on the north side of the terminus of West Rush Court at 741 West Rush Court. (MJW) Craig Shotwell, ADDRESS, provides an overview of the application. Shotwell responds to questions from the Commission. City Planner, Michael Williams, provides an overview of the application. Planner Williams responds to questions from the Commission. Chairman Wright opens the public hearing. Kathy Davis, 723 West Rush Court. Davis opposes the application, and expresses concerns that approving this CUP would open the door to the construction of additional housing on the lot. Hardy opposes the application, and expresses concerns related to the proposed dwelling becoming an additional dwelling. Shotwell addresses concerns raised during the public hearing and provides rebuttal. Shotwell responds to questions from the Commission. Chairman Wright closes the public hearing. McCauley moves to approve CU-03-22 due to nonconforming use with the following verbiage added... include site plan date stamped by the City of Eagle April 4, 2022. Seconded by Smith. Planner Williams requests clarification on the motion from the Commission. Commissioner McCauley provides clarification on the motion. Discussion amongst the Commission. ALL AYES ... MOTION CARRIES. B. CU-05-21/PPUD-05-21/PP-07-21 — Millstone Farms Planned Unit Development — Brent Thompson: Brent Thompson, represented by Tamara Thompson with The Land Group Inc., is requesting conditional use permit, preliminary development plan, and preliminary plat approvals for Millstone Farm Subdivision, a 338-lot, 311-unit (245- single-family dwellings, 33-single-family attached dwellings [located within 66-lots], 27- common [inclusive of 3 shared access lots]) residential planned unit development. The 89.87-acre site is located at the northwest corner of North Palmer Lane and West Floating Feather Road at 2871 North Palmer Lane. (MJW) Planner Williams requests this item be continued to the April 18, 2022 Planning and Zoning Commission meeting. MOTION: McLaughlin moves to continue item 5B to April 18, 2022.
