PARTIAL RELEASE OF EASEMENTS WITH COVENANTS
AND RESTRICTIONS AFFECTING LAND
The Eagle Village Co-Owners, specifically Oppenheimer Companies, Inc.,
Thomas Dater, N. Jeanne Drown, Bradford p, Shaw, Kittyhawk Investments, an Idaho
partnership, and Jordan Wilcombe Co., an Idaho partnership ("Eagle Village") and the City of
Eagle, Ada County, Idaho, together make the following declaration of recision,
On May 30, 1981, that certain document entitled "Easements With Covenants
and Restrictions Affecting", was recorded in the Real Estate Records of Ada County, Idaho,
as Instrument No. 8138900 (the "ECR"), which was executed by the then-current property
owners of Parcels I, II and III (as are more particularly described on Exhibits B, C and D,
respectively, which are attached to and are a part of the ECR).
By this Partial Release of Easements With Covenants and Restrictions Affecting
Land, and pursuant to Section 8(e) of the ECR, Eagle and Eagle Village, the current owners
of record of all property affected by the ECR, hereby rescind and terminate each, all and
every easement, covenant, and restriction contained in the ECR with respect to that certain
parcel of real property which is a portion of the property subject to the ECR shown as
Parcel I on the attached survey of record which is attached hereto as Exhibit (A) and which is
made a part hereof by this reference and which is more particularly described on Schedule I
which is also attached hereto and made a part hereof by this reference.
