Ordinance - 1998 - 337 - Creating Title 2/Creation Of A Development Impact Fee - 11/24/1998ORDINANCE No. 337 AN ORDINANCE CREATING TITLE 2, CHAPTER 5, EAGLE CITY CODE PROVIDING FOR THE CREATION OF A DEVELOPMENT IMPACT FEE ADVISORY COMMITTEE; TERM OF OFFICE AND VACANCIES; ORGANIZATION; DUTIES; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO: Section 1. That Title 2, Chapter 7 Eagle City Code, be, and the same is hereby created to read as follows: CHAPTER 5. DEVELOPMENT IMPACT FEE ADVISORY COMMITTEE 2-5-1 COMMITTEE CREATED 2-5-2 TERM OF OFFICE AND VACANCIES 2-5-3 ORGANIZATION 2-5-4 DUTIES 2-5-1 COMMITTEE CREATED There is hereby created a Development Impact Fee Advisory Committee for the City, which Committee shall be known and designated as the Eagle City Development Impact Fee Advisory Committee. 2-5-2 TERM OF OFFICE AND VACANCIES The Development Impact Fee Advisory Committee shall consist of not fewer than five (5) members appointed by the Mayor with the confirmation of the City Council. Two (2) members shall be active in the business of development, building or real estate. Persons living within the Area of City Impact shall be entitled to representation on the Development Impact Fee Advisory Committee. Such representation shall as nearly as possible reflect the proportion of population living within such area of City impact. Upon the appointment as herein provided, the members of the Committee shall meet and draw lots for the terms of office which shall be as near as possible for an equal number of terms for two (2), and four (4) years, and thereafter, at the expiration of any terms of office, appointment to such office shall be for the period of four (4) years. If a vacancy shall occur during any unexpired term, the Mayor, with confirmation of the Council, shall appoint a member for the balance of such unexpired term. 2-5-3: ORGANIZATION A. Chairman: The Development Impact Fee Advisory Committee shall meet and appoint one of its members as Chairman of the Committee, who shall hold office as Page 1 of 3 H:\COUNCIL\Draft Ordinances\Impact fee committee dft.doc such Chairman for such term as the Committee shall so designate, and the Committee may elect a Vice -Chairman who shall act as Chairman in the absence of the Chairman of the Committee B. Clerk Of Committee: The Development Impact Fee Advisory Committee shall have authority to designate a Clerk, who may be an officer or employee of the City, and who shall act as such Clerk or Secretary to the Committee and shall keep an accurate record of all proceedings of said Committee, and shall file, when ordered by the Committee, with the Council, a report of all transactions of the Development Impact Fee Advisory Committee. C. Meetings: A majority of the appointive members of the Committee shall be necessary to constitute a quorum for the transaction of business. The Committee shall hold meetings each month for at least nine (9) months of the year, and at such other times as may be called by the Chairman or by the Mayor or City Council. D. Rules For Conduct Of Business: Written rules consistent with this Chapter and the laws of the State of Idaho for the transaction of business of the Committee shall be adopted. E. Records Kept: Written records of meetings, hearings, resolutions, findings, studies, permits and actions shall be maintained and open to the public F. Compensation: The members of the Development Impact Fee Advisory Committee shall serve and act without compensation, except that their actual and necessary expenses shall be allowed by the Council and the City shall provide the necessary and suitable equipment and supplies to enable the Committee to properly transact and perform its business. 2-5-4: DUTIES A. The Development Impact Fee Advisory Committee shall serve in an advisory capacity and is established to: a) Assist the City in adopting land use assumptions; b) Review the capital improvements plan, and proposed amendments, and file written comments; c) Monitor and evaluate implementation of the capital improvement plan; d) File periodic reports, at least annually, with respect to capital improvement plant and report to the Mayor and Council any perceived inequities in implementing the plan or imposing the development impact fees; and e) Advise the Mayor and Council of the need to update or revise land use assumptions, capital improvements plan and development impact fees. B: The Mayor and Council shall make available to the Development Impact Fee Advisory Committee, upon request, all financial and accounting information, professional Page 2 of 3 H:\COUNCIL\Draft Ordinances\Impact fee committee dft.doc reports in relation to other development and implementation of land use assumptions, the capital improvements plan and periodic updates of the capital improvements plan. This Chapter shall not be construed in any manner as infringing upon any authorization previously granted to any other commission or board of the City, but all the departments and officials of the City shall cooperate with the Development Impact Fee Advisory Committee for the purpose of coordinating the efforts and functions of all departments, commissions, and boards of the City for the development of all public facilities of the City. Section 2: This ordinance shall take effect and be in force from and after its passage, approval, and one (1) publication of the ordinance in the official newspaper of the City.
