Re: Service Agreement for Landscape Maintenance

The City of Eagle and Summer Lawns Inc. ("Summer Lawns") currently have a Landscape Maintenance
Service Agreement executed September 25, 2012, and addendums. Pursuant to Par. 13, the City is entitled to an
"opt -out" of the Service Agreement by giving thirty (30) days written notice.
The City is notifying Summer Lawns that it is going to put out to bid the City landscape and maintenance
services in the next few months. The City encourages Summer Lawns to provide a bid at that time. In the interim,
the City would like to proposle a month-to-month contract until the bid process is completed and a start date for
the winning bidder is determined.
The service and compensation terms of the current contract would still apply and the Billing Schedule set
forth under Par. 6 would still apply during this period. Upon the completion of the bid process, the City will notify
Summer Lawn of the end date. The City will do its best to provide advance notice but will not be required to
provide an additional 30 days in the event Summer Lawns is not the winning bidder.
The work done by Summer Lawns has been above par and the City hopes to continue a great working
relationship in the future. Please let me know within ten (10) days whether Summer Lawn agrees to this
arrangement or not.

Dear Mayor Ridgeway and City Council Members:
Per the letter from Mayor Stan Ridgeway extending the opportunity to continue Landscape services per
Par.6, referencing Summer Lawns Landscape Maintenance Services for the City of Eagle's Portfolio on a
month-to-month basis beginning at the end of the current agreement, Summer Lawn Inc. graciously
accepts the opportunity, We acknowledge that the opportunity will continue until further notification
from the City. Services will continue for both Landscaping and Facilities under the same and existing billing
scheduled.
