ORIGINAL ORDINANCE #350 AN ORDINANCE AMENDING EAGLE CITY CODE TITLE 6 "PUBLIC WAYS AND PROPERTY", CHAPTER 5 "WATER SYSTEM", SECTION 13 (C)(2) "DISCONTINUANCE OF SERVICE"; AND AMENDING EAGLE CITY CODE TITLE 9 "LAND SUBDIVISIONS", CHAPTER 4 "REQUIRED IMPROVEMENTS", SECTION 1-9 (C)(1)(a) "WATER SUPPLY AND SEWER SYSTEMS"; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Hubble Engineering, Inc. applied to the City to amend Eagle City Code Section 6-5-13 (C)(2) to allow cross connections between the Water Departments system and another water supply; to amend Eagle City Code Section 9-4-1-9 (C)(1)(a) to allow a pressurized irrigation system to be connected to a potable water system. THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO, as follows: Section 1: That Eagle City Code Section 6-5-13 (C)(2), be, and the same hereby is, amended with the strike-thru text being deleted and the underlined text being added to read as follows: Cross Connections: A cross connection is defined as any physical connection between The—W, it Dsopzetinengs the potable water system and another water supply. - - .., .. . - - . . e ' ✓ . and The TJ.E. Br.: ental Protection The Water Dcpar:t City of Eagle or its agent will not permit any unprotected cross connection and will discontinue service to any persons or premises where an unprotected cross connection exists. Service will not be restored until the cross connection is properly protected eliminated. Individual backup connections to individual lots bv individual lot owners shall be prohibited with the exception of the common area lots owned and maintained bv the homeowners association. Section 3: The provisions of this ordinance are hereby declared to be severable and if any provision of this act or the application of such provision to any person or circumstance is declared invalid for any reason, such declaration shall not affect the validity of remaining portions of this ordinance. Section 4: This Ordinance shall take effect and be in force from and after its passage, approval, and publication as required by law. In lieu of publication of the entire Ordinance, a summary thereof in compliance with Section 50-901A, Idaho Code, may be published. DATED this 22nd day of June, 1999.
