Findings - DR - 2016 - DR-58-16 - Subdivision Entrance Monument SignBEFORE THE EAGLE DESIGN REVIEW BOARD IN THE MATTER OF AN APPLICATION ) FOR A DESIGN REVIEW FOR A ) SUBDIVISION ENTRANCE MONUMENT ) SIGN WITHIN RENOVARE SUBDIVISION) FOR MDG, LLC ) FINDINGS OF FACT AND CONCLUSIONS OF LAW CASE NUMBER DR -58-16 The above -entitled design review application came before the Eagle Design Review Board for their action on October 13, 2016. The Eagle Design Review Board having heard and taken oral and written testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law; FINDINGS OF FACT: A. PROJECT SUMMARY: MDG, LLC, represented by Walter Lindgren with Lindgren:Labrie Architecture, PLLC, is requesting design review approval for a subdivision entrance monument sign for Renovare Subdivision. The sign is proposed to be located within the existing landscape planter located at the intersection of South Edgewood Lane and East Lone Shore on the east side of South Edgewood Lane at the Renovare Subdivision entrance. B. APPLICATION SUBMITTAL: The application for this item was received by the City of Eagle on September 8, 2016. C. HISTORY OF RELEVANT PREVIOUS ACTIONS: On February 13, 2014, the Eagle Design Review Board approved a design review application for the common area landscaping within Renovare Subdivision (DR -33-13). On January 8, 2015, the Eagle Design Review Board approved a design review application to construct an entry structure and signage for Renovare Subdivision (DR -61-14). AGENCY RESPONSES: None I. LETTERS FROM THE PUBLIC: None received to date. STAFF ANALYSIS PROVIDED WITHIN THE STAFF REPORT: A. COMPREHENSIVE PLAN PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: • Protect and enhance the small town character of the City by requiring signage which is creative and distinctive, compatible with its surroundings, and an integral component of the style and character of the building to which it relates. B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: • Eagle City Code Section 8 -2A -2(B) The general theme of the Design Review Overlay District is to specify desirable building and landscape architectural styles and materials to create a sustainable and pleasing environment for residents and visitors alike. The architectural designs, materials, and graphics set forth in this article are compiled to create a theme unique to the area called "Eagle Architecture". 0 Eagle City Code Section 8 -2A -7(D)(2) 2. Clear vision triangle shall be observed in regard to all vegetation. All shade trees planted within vision triangles shall be pruned to a minimum seven feet (T) above the adjacent sidewalk and fourteen feet (14) above the adjacent roadway surface. Shrubs and ground covers planted within the vision triangle shall not exceed three feet (3') height at maturity. The boundaries of the vision triangle are defined by measuring from the intersection of the edges of two (2) adjacent roadways forty feet (40) along each roadway and connecting the two (2) points with a straight line. The sight distance obstruction is also applicable to railroad -highway grade crossings with the vision triangle defined by measuring forty feet (40) along the railroad property line. In all cases, ITD and ACHD standards shall apply also. (Ord. 462, 11-I1-2003) • Eagle City Code 8-2A-8(C)(3)(a) a. One subdivision sign may be permitted on each side of any entry road into a subdivision, or within the landscape median at the entry road if approved by ACHD, and at the intersection of any collector and/or arterial streets abutting the subdivision. DISCUSSION: • The applicant is proposing to construct one (1) subdivision entry monument sign located within an existing landscape island at the Renovare Subdivision entrance. The landscape plan date stamped by the city on October 30, 2014, shows Blue Oat Grass and Knock Out Roses to be planted within the landscape island (DR -61-14). The picture of the existing landscape planter, date stamped by the city on September 8, 2016, shows lavender plants within the existing landscape planer. The lavender plants were not approved with the subdivision design review application. Staff is unsure if the applicant is proposing to incorporate the existing lavender plants into the landscape plan, or if the plants will be removed. The approved Blue Oat Grass can reach the height of two and a half feet (2.5'), and the Knock Out Rose can reach up to four feet (4') in height. Both the approved plants and the lavender plants will obstruct the view of the proposed subdivision entry monument sign. The applicant should provide a revised landscape plan showing all proposed landscaping that will not obstruct the view of the entry monument sign. The revised landscape plan should be reviewed and approved by staff and one member of the Design Review Board prior to the issuance of a sign permit. • The location of the proposed subdivision entry monument sign is located within the ACHD right- of-way. The applicant should be required to obtain a license agreement from ACHD to place the subdivision entry monument sign within the right-of-way. The approved license agreement should be provided to the city prior to the issuance of a sign permit. • The applicant did not provide a site plan confirming the subdivision entry monument sign will not be placed within the vision triangle. The applicant should provide a revised site plan showing the location of the sign located outside of the vision triangle. The revised site plan should be reviewed and approved by staff prior to the issuance of a sign permit. • Upon completion of the subdivision entry monument sign and required landscaping, the applicant should request a site inspection to be completed by the Planning and Zoning Department. Upon verification that the monument sign and landscaping have been completed in compliance with the approved plans, a certificate of completion will be issued. • Staff defers comment regarding design and color of the proposed entry monument sign to the Design Review Board. STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT: Based upon the information provided to staff to date, staff recommends approval with the site specific conditions of approval and the standard conditions of approval provided within the staff report. PUBLIC MEETING OF THE BOARD: A. A meeting to consider the application was held before the Design Review Board on October 13, 2016, at which time the Board made their decision. B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one. C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not including the applicant/representative). BOARD DECISION: The Board voted 4 to 0 (Grubb and Baer absent) to approve DR -58-16 for a design review sign application for a subdivision entrance monument sign within Renovare Subdivision for MDC, LLC, with the following staff recommended site specific conditions of approval and standard conditions of approval. Page 3 of 5 KAPlanning DepttEagle ApplicationADA2016MR-58-16 Renovare entry sign drf.doc SITE SPECIFIC CONDITIONS OF APPROVAL: 1. Comply with all applicable conditions of DR -61-14. 2. Provide a revised landscape plan showing landscaping that will not obstruct the view of the proposed subdivision entry monument sign. The revised landscape plan shall be reviewed and approved by staff and one member of the Design Review Board prior to the issuance of a sign permit. 3. A sign permit is required prior to the installation of any signs on this site. 4. Upon completion of the monument sign, the applicant shall request a site inspection to be completed by the Planning and Zoning Department. Upon verification that the monument sign and landscaping have been completed in compliance with the approved plans, a certificate of completion will be issued. Provide a license agreement from ACHD to place the subdivision entry monument sign within the right-of-way. The approved license agreement shall be provided to the city prior to the issuance of a sign permit. 6. Provide a revised site plan showing the location of the subdivision entry monument sign located outside of the vision triangle. The revised site plan shall be reviewed and approved by staff prior to the issuance of a sign permit. NOTE: In the event a Standard Condition of Approval conflicts with a Site Specific Condition of Approval contained herein the Site Specific Condition of Approval shall control. STANDARD CONDITIONS OF APPROVAL: 1. A building permit/zoning permit shall be required prior to construction of any sign which is not attached to a building with an active building permit. 2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review, as stipulated in Eagle City Code (one year from the City Council approval date). 3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with. All design and construction shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the City Council. 4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may elect to take those plans to the Design Review Board and the City Council for review and approval. 5. Any changes to the plans and specifications upon which this approval is based, other than those required by the above conditions, will require submittal of an application for modification and approval of that application prior to commencing any change. 6. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the City of Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 7. Any modification of the approved design review plans must be approved prior to construction/installation of such changes. Failure to do so may result in the requirement to modify the project to comply with the approved design review and/or result in the inability to issue a certificate of completion for this project. The application for this item was received by the City of Eagle on September 8, 2016. 2. The Board reviewed the particular facts and circumstances of this proposed design review application (DR -58-16) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review Overlay District, and based upon the information provided with the conditions required herein, concludes that the proposed design review application is in accordance with the Eagle City Code and the Eagle Comprehensive Plan.
