AN ORDINANCE AMENDING EAGLE CITY CODE TITLE 8, CHAPTER 2,
SECTION 8-2-4; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Hubble Engineering, Inc. applied to the City to amend Eagle City Code to
allow setback reductions to encourage variations in the design of the street facing side of
homes, to encourage side entry garages, and to encourage the construction of front
porches.
THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO, as follows:
Section 1: That Eagle City Code Section 8-2-4, be, and the same hereby is, amended
with the strike-thru text being deleted and the underlined text being added to read as
follows:

(A) Setback Reductions (To be measured from the foundation to the property line):
(1) No portion of the structure may extend more than two feet (2') into the side yard
setback:
(2) Open structures such as porches, canopies. balconies. platforms. carports. covered
patios and similar architectural proiections shall be considered part of the building
to which it is attached and shall not project more than fifteen feet (15') into the
reauired rear yard setback:
(3) Open porches for residential dwelling units shall not proiect more than five feet
(5') into the required front yard setback:
(4) A single family dwelling unit that utilizes a side entry garage shall be permitted to
have a five foot (5') reduction in the minimum required front yard setback
provided that the distance is no less than twenty feet (20') measured from the
foundation of the garage to the property line.
Section 3: The provisions of this ordinance are hereby declared to be severable and if any
provision of this act or the application of such provision to any person or circumstance is
declared invalid for any reason, such declaration shall not affect the validity of remaining
portions of this ordinance.
Section 4: This Ordinance shall take effect and be in force from and after its passage,

approval, and publication as required by law. In lieu of publication of the entire
Ordinance, a summary thereof in compliance with Section 50-901A, Idaho Code, may be
