Ordinance - 2000 - 363 - Repeal Title 7-1-A---E - 02/22/2000ORIGINAL ORDINANCE # 363 AN ORDINANCE REVISING SECTIONS OF THE CITY OF EAGLE, IDAHO, REPEALING EAGLE CITY CODE SECTION 7-1A ARTICLE A BUILDING CODES AND REPLACING IT WITH A NEW SECTION 7-1A ARTICLE A BUILDING CODES; REPEALING SECTION 7-1B ARTICLE B GAS CODE AND REPLACING IT WITH A NEW SECTION 7-1B MECHANICAL CODES; AMENDING PORTIONS OF SECTION 7-1C ARTICLE C ELECTRICAL CODES; AMENDING PORTIONS OF SECTION 7-1D FIRE CODES; ESTABLISHING A NEW SECTION 7-1E ARTICLE E PLUMBING CODE; PROVIDING FOR SEVERABILITY OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, The City of Eagle proposes to define regulations for building; and WHEREAS, the City of Eagle finds that the adoption of a more comprehensive selection of codes will safeguard life or limb, health, property and public welfare. THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO, as follows: Section 1: Eagle City Code, Chapter 1, Article A is deleted in its entirety. Eagle City Code Chapter 1, Article 1 shall read as follows: CHAPTER 1 BUILDING CODES ARTICLE A. BUILDING CODES SECTION: 7-1A-1: Short Title and Purpose 7-1A-2: Adoption of Codes 7-1A-3: City of Eagle Amendments to the Uniform Building Code 7-1A-4: Construction Start 7-1A-5: Code Priority 7-1A-6: City of Eagle Amendments to the Elevators, Dumbwaiters, Escalators and Moving Walkways, ANSI A17.1-1993 with 1994 and 1995 addendum 7-1A-1: SHORT TITLE AND PURPOSE: 1 This Chapter shall be known and cited as the CITY OF EAGLE BUILDING CODE ORDINANCE. The purpose of this Chapter is to provide minimum standards and requirements to safeguard life or limb, health, property and public welfare, by regulating and controlling, grading, quality and installation of materials, use, occupancy and maintenance of all buildings, manufactured homes and structures in the City of Eagle. 7-1A-2: ADOPTION OF CODES: A. The following codes, except as herein amended are hereby adopted and incorporated by reference as if fully set forth herein, and shall apply in the City of Eagle. This Chapter shall include rules and regulations governing all grading and building activity including; erection, construction, enlargement, alterations, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of buildings or structures, installation requirements for manufactured homes. It shall be unlawful to engage in any grading or building activity without complying with the rules and regulations as contained in this Chapter and the codes adopted herein. The following codes and portions thereof are on file in the office of the City Clerk, in accordance with Idaho Code, section 31-715. UNIFORM BUILDING CODE, 1997 Edition, Vol. 1,2 and 3. Published by the International Conference of Building Officials, and in addition the following appendices: Chapter 3, Division I; Detention and Correctional Facilities, Chapter 15; Re roofing; Chapter 16, Division I; Snow Load Design, Chapter 19; Protection of Residential Concrete Exposed to Freezing and Thawing, Chapter 29; Minimum Plumbing Fixtures, Chapter 31, Division II; Membrane Structures, Division III; Patio Covers, Chapter 33; Excavation and Grading. UNIFORM CODE FOR BUILDING CONSERVATION, 1997 Edition Published by the International Conference of Building Officials. UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, 1997 Edition Published by the International Conference of Building Officials. ELEVATORS, DUMBWAITERS, ESCALATORS AND MOVING WALKS, ANSI A17.1-1993 with 1994 and 1995 addendum Published by the American National Standards Institute. 2 7-1A-3: CITY OF EAGLE AMENDMENTS TO THE UNIFORM BUILDING CODE: The Uniform Building Code, 1997 edition, as adopted above, is hereby changed, altered, deleted and amended as follows: A. Section 105 BOARD OF APPEALS. Add: Section 105.1.1 Fees. All appeal hearings will require a fee as approved and adopted by resolution of the City Council to defray expenses incurred in travel and overhead of the members of the Building Appeals Board and administrative costs as determined by the Eagle Zoning Administrator. B. Section 106.3.2 Submittal Documents. Add the following exceptions: 2. Group R, Division 1 occupancies of Type VN construction which do not exceed two (2) dwelling units or two (2) congregate residences (each accommodating 10 persons or less) and not exceeding two (2) stories in height are not required to be prepared, signed or sealed by an architect or engineer licensed by the State of Idaho. 3. Group R, Division 3 and Group U, Division 1 occupancies of Type VN construction not exceeding two (2) stories in are not required to be prepared, signed or sealed by an architect or engineer licensed by the State of Idaho. 4. Group R, Division 3 and Group U, Division 1 occupancies of Type VN construction may submit standard plans. Standard plans shall be so designated by the applicant at the time of the original submission. C. Section 106.4.1 Issuance. Add after the second sentence: For new construction, written approval or fee receipts shall be obtained from the following agencies and provided to the City of Eagle in order to receive an Eagle Building Permit: • Ada County Highway District (ACHD) Impact Fee receipt or ACHD Impact Fee waiver. • Central District Health Department Septic System Approval or • Eagle Sewer District Connection Fee receipt or Connection Fee waiver. • Park Impact Fee receipt or Park Impact Fee waiver. • Water Service Provider Fee Receipt or Department of Environmental Quality Well Certification D. Section 107.2 Permit Fees. Delete the first and second paragraph of this section and add: The value to be used in computing the building permit fee shall be either the total value of construction work for which the permit is issued as stated by the Building Permit Applicant, or the value calculated using "Building Valuation Data" established by a resolution adopted by the Eagle City Council whichever is the larger amount. The fee for each building permit shall be calculated using a "Building Permit Fee Table" established by resolution 98-10 adopted by the Eagle City Council or any subsequent resolution approved by the City Council. E. Section 107.3 Plan Review Fees. Delete the last sentence of the first paragraph and add: Plan Review Fees for Group R, Division 3 and Group U, Division 1 Occupancies shall be determined by resolution 98-10 adopted by the Eagle City Council, or any subsequent resolution approved by the City Council. F. Section 108.5 Required Inspections. Add the following sentence to items 108.5.3 and 108.5.5: This inspection may be waived at the option of the Building Official. G. Section 109.1 Use and Occupancy. Delete the exception. H. Table No. 1-A - BUILDING PERMIT FEES. Delete this table. I. Section 220-S. Add the definition for Standard Plan. Standard Plan: is a set of plans, specifications, computations and other data used to apply repeatedly for separate building permits. J. Section 302.1 General. Add the following exception: 5. A Group B Occupancy of 300 square feet in floor area or less that is used as an office or for the dispensing of personal services such as accounting, hair care, consulting etc. need not be separated from a Group R, Division 3 Occupancy provided that no one is employed other than a resident of the Group R, Division 3 Occupancy and there is at least one exit from the Group B Occupancy directly to the exterior. K. Chapter 34 EXISTING STRUCTURES. Section 3404 Moved Buildings. Add subsection #1. #1. Existing established buildings used as classrooms, offices, sales locations, businesses or dwellings (not to include manufactured homes), that are relocated into or within the city limits of Eagle, shall be inspected by an Idaho licensed architect or engineer. This inspection shall be followed by a sealed report accompanying the City 4 of Eagle Building Permit Application that identifies the particular building and states that the licensed professional does not find any structural condition indicating a deficiency that would preclude the continued use of the building. This statement shall be accompanied by a sealed foundation design for that specific building. L. Appendix Section 1515.2.1: Add the following to the end of the paragraph. The pre roofing inspection is not required when the roof slope is at least 2 vertical to 12 horizontal. 7-1A-4: CONSTRUCTION START: Excavation work for foundation less than four feet (4') below grade or erection of concrete forms for foundations is not considered a construction start. 7-1A-5: CODE PRIORITY: Requirements specifically addressed by more than one code will be in the most restrictive code adopted herein. 7-1A-6: EAGLE CITY AMENDMENTS TO THE ELEVATORS, DUMBWAITER, ESCALATORS AND MOVING WALKS, ANSI A17.1-1993 with 1994 and 1995 addendum: Add the following to the end of the section one: This code applies only to new construction of, alterations of and additions to: public school buildings owned or operated by a public school district classified as Group E Occupancies by the Uniform Building Code. Section 2: Eagle City Code Chapter 1, Article B, Gas Code is deleted in its entirety and shall read as follows: CHAPTER 1 BUILDING CODES ARTICLE B. MECHANICAL CODES SECTION: 7-1B-1: Mechanical Code Adopted 7-1B-2: City of Eagle Amendments to the Uniform Mechanical Code 7-1B-3: Mechanical Inspector 5 7-1B-1 UNIFORM MECHANICAL CODE, 1997 Edition : There is hereby adopted by the City for the purpose of prescribing regulations governing minimum standards and requirements for the use of and the design, construction, installation, improvement, extension and alteration of materials, piping, venting, fixtures, appliances and appurtenances in relation to mechanical systems as defined by the Uniform Mechanical Code, and to provide that all systems shall be designed, constructed, installed, improved, extended and altered in substantial accord with the Uniform Mechanical Code published by the International Conference of Building Officials, and in addition the following appendices: Appendix A: UMC Standards, Appendix B: Solar Systems, Appendix C: Sizing of Venting Systems Serving Appliances Equipped with Draft Hoods and Appliances Listed for the use with Type B Vents. 7-1B-2 CITY OF EAGLE AMENDMENTS TO THE UNIFORM MECHANICAL CODE: The Uniform Mechanical Code, 1997 Edition, as published by the International Council of Building Officials is hereby adopted. A. Section 115.2 Permit Fees add the following to Table 1-A MECHANICAL PERMIT FEES: Other Inspections and Fees All buildings with the exception of R-3 occupancies shall be charged at One and One Half percent (1 1/2%) of the total bid for the project plus $23.50. 7-1B-2 MECHANICAL INSPECTOR: A. Appointment, Term of Office: The City Council shall have the power to appoint a person qualified and experienced in heating, ventilation and air conditioning, to be Mechanical Inspector who shall hold such office at the discretion of the City Council and who's duties shall be overseen by the Building Official. B. Duties: It shall be the duty of the Mechanical Inspector to attend to the enforcement of the provisions of this Article, as the same shall pertain to the inspection and supervision of mechanical systems. The Mechanical Inspector shall have the jurisdictional authority to inspect, and shall inspect, installations of heating, ventilation, air conditioning and related equipment within the City's limits, to give notice of mechanical violations, to issue or cancel mechanical 6 permits, and to otherwise carry out their duties as Mechanical Inspector for the City. C. Compensation: The compensation that the Mechanical Inspector shall receive for providing services shall be fixed by the City Council and shall be paid in the same manor as other claims against the City. Section 3: That Article C, Section 7-1C-1, Eagle City Code be, and is hereby amended as follows: 7-1C-1: ELECTRICAL CODE ADOPTED: Except where a different standard is required by this Article, all work of electrical wiring, installation and construction, and the material, apparatus and fixtures used therein shall be in accordance with the rules established i tho 1 959 edition 1999 Edition of the National Electrical Code of . is hereby adopted for City of Eagle. except: compliance with Article 675-8N will include the additional reauirement that a disconnecting means always be provided at the point of service from the utility no matter where the disconnecting means for the machine is located. The Idaho State Division of Building Safety shall inspect such work and report violations to the Building Official. Section 4: Eagle City Code, Chapter 1, Article D, Fire Codes shall be amended as follows: 7-1D-2: Life Safety Code: There is hereby adopted for the purpose of regulating and controlling life safety of the City, the Life Safety Code 101-1997, prepared by the National Fire Protection Association, 1976 1997 edition thereof, and as the same may hereafter be revised or amended. EAGLE CITY AMENDMENTS TO THE LIFE SAFETY CODE: Amend section 1-4.1 to read as follows: This Code applies only to new construction of, alterations of and additions to: public school buildings owned or operated by a public school district classified as Group E Occupancies by the Uniform Building Code. Inspections shall be provided by the Eagle Fire Department and report violations to the Building Official. 7 Section 5: Eagle City Code, Chapter 1, Article F, Plumbing Codes shall read as follows: SECTION: 7-1F-1: 7-1F-2: CHAPTER 1 BUILDING CODES ARTICLE F. PLUMBING CODE Plumbing Code Adopted Plumbing Inspector 7-1F-1: UNIFORM PLUMBING CODE: There is hereby adopted by the City for the purpose of prescribing regulations governing minimum standards and requirements for the use of and the design, construction, installation, improvement, extension and alteration of materials, piping, venting, fixtures, appliances and appurtenances in relation to plumbing systems as defined by the Uniform Plumbing Code, and to provide that all plumbing and plumbing systems shall be designed, constructed, installed, improved, extended and altered in substantial accord with the Uniform Plumbing Code published by the International Association of Plumbing and Mechanical Officials, and it shall be amended, revised, compiled and published from time to time and as such amendments or revisions are adopted by the Idaho Plumbing Board, and subject to the conditions, exceptions and fees prevalent in Idaho Code Title 54, Chapter 26. 7-1F-2 PLUMBING INSPECTOR: 8 A. Section 6: The provisions of this ordinance are hereby declared to be severable and if any provision of this act or the application of such provision to any person or circumstance is declared invalid for any reason, such declaration shall not affect the validity of remaining portions of this ordinance. Section 7: This ordinance shall take effect and be enforced from and after its passage, approval, and publication as required by law. In lieu of publication of the ordinance, a summary thereof in compliance with Section 50-901A Idaho Code, may be published. Duties: It shall be the duty of the Mechanical Inspector to attend to the enforcement of the provisions of this Article, as al the same shall pertain to the inspection and supervision of mechanical systems.
