DAVID NAVARRO d 0'5F, W.AHO 20Q0.f . 25 PM ORDINANCE # 368 ,ECQRDED- REQUEST OF FEE DEPUTY 100058158 For Recording Purposes Do Not Write Above This Line ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY IDAHO, ANNEXING CERTAIN REAL PROPERTY SITUATED IN THE UNINCORPORATED AREA OF ADA COUNTY, IDAHO, AND CONTIGUOUS TO THE CORPORATE LIMITS OF THE CITY OF EAGLE, TO THE CITY OF EAGLE, IDAHO; ESTABLISHED THE ZONING CLASSIFICATION OF SAID REAL PROPERTY; DIRECTING THAT COPIES OF THIS ORDINANCE BE FILED AS PROVIDED BY LAW; AMENDING EAGLE CITY CODE, TITLE 8 "ZONING", CHAPTER 2, "ZONING DISTRICTS AND MAP", SECTION 1, "DISTRICTS ESTABLISHED, PURPOSES AND RESTRICTIONS", SECTION 2, "OFFICIAL ZONING MAP INCORPORATION BY REFERENCE", SECTION 3, "SCHEDULE OF DISTRICT USE REGULATIONS", AND SECTION 4, "SCHEDULE OF BUILDING HEIGHT AND LOT AREA REGULATIONS"; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Eagle, Idaho is a municipal corporation organized and operating under the laws of the State of Idaho and is authorized to annex to and incorporate within the boundaries of the City contiguous real property in the manner provided by Section 50-222, Idaho Code; and WHEREAS, the Eagle City Council, is appropriate to meet the requirements of Idaho Code, Eagle City Code and the Eagle Comprehensive Plan. WHEREAS, the Planning and Zoning Commission of the City, pursuant to public notice as required by law, held public hearings on February 7, 2000, and March 6, 2000, as required by Section 67-6525, Idaho Code, and recommended to the Mayor and Council that the annexation and zoning request of The City of Eagle be approved. WHEREAS, the Eagle City Council, pursuant to public notice as required by law, held a public hearing on March 21, 2000, on the proposed annexation and zoning for the real property described on Exhibits "4N1E03", "4N1E04", "4N1E05", "4N1E06", "4N1E07", "4N1E10", "4N1W12", "4N1E19", "4N1E20", and "4N1E21" attached hereto, as required by Section 67- 6525, Idaho Code and determined that the land should be annexed into the City with the zoning Page 1 of 5 K:\COUNCIL\Ordinances\Ord 368.doc classifications shown on Exhibit "A" (dated as "Adopted on March 7, 2000"), attached hereto and that the said zoning designations are appropriate to meet the requirements of Idaho Code, Eagle City Code and the Eagle Comprehensive Plan. WHEREAS, In accordance with the Eagle 2000 Comprehensive Plan the City of Eagle proposes: to further define industrial uses within the M-1 "Light Industrial District" and M-2 "Heavy Industrial District"; to change the "Industrial Park District" designation to a "Business Park" designation; to make zoning designation changes to the official zoning map as shown on Exhibit "A" (dated as "Adopted on March 7, 2000"), attached hereto; to modify the Schedule of District Use Regulations to change the M -1A zoning designation to BP zoning designation; and to modify the Schedule of Building Height and Lot Area Regulations to change the M -1A zoning designation to BP zoning designation. THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO, as follows: Section 1: The Eagle City Council hereby finds and declares that the real property described on Exhibits "4N1E03", "4N1E04", "4N1E05", "4N1E06", "4N1E07", "4N1E10", "4N1W12", "4N1E19", "4N1E20", and "4N1E21" attached hereto, is contiguous to the City and that said property can be reasonably assumed to be used for the orderly development of the City. Section 2: The real property, all situated in Ada County, Idaho, adjacent and contiguous to the City, described on Exhibits "4N1E03", "4N1E04", "4N1E05", "4N1E06", "4N1E07", "4N1E10", "4N1W12", "4N1E19", "4N1E20", and "4N1E21" attached hereto, and zoned as shown Exhibit "A" (dated as "Adopted on March 7, 2000"), attached hereto and by reference incorporated herein, is incorporated into the territorial limits of the City of Eagle, Idaho. Section 3: From and after the effective date of this Ordinance, all property and persons within the boundaries and territory described above shall be subject to all ordinances, resolutions, police regulations, taxation, and other powers of the City of Eagle. Section 4: The zoning land use classifications of the land described in Section 2 above is hereby established as provided for by the Zoning Ordinance of the City. The Comprehensive Plan and the Zoning Map of the City are hereby amended to include the real property described in Exhibits "4N1E03", "4N1E04", "4N1E05", "4N1E06", "4N1E07", "4N1E10", "4N1W12", "4N1E19", "4N1E20", and "4N1E21" above and with the zoning land use classifications specifically shown on Exhibit "A" (dated as "Adopted on March 7, 2000"), attached hereto. Section 5: The City Clerk is hereby directed to file, within ten (10) days of passage and approval of this Ordinance, a certified copy of this Ordinance with the offices of the Auditor, Treasurer, and Assessor of Ada County, Idaho, and with the Idaho State Tax commission, Boise, Idaho, as required by Section 50-223, Idaho Code, and to comply with the provisions of Section 63-2215, Idaho Code, with regard to the preparation and filing of a map and legal description of the real property annexed by this Ordinance. Section 6: Portions of Eagle City Code Section 8-2-1 "Districts Established, Purposes and Page 2 of 5 K:\COUNCIL\Ordinances\Ord 368.doc Restrictions" are amended to delete the strike -through text and add the underlined text as follows: M-1 LIGHT INDUSTRIAL DISTRICT: To encourage the development of manufacturing and wholesale business establishments which oda., &i smelke-er-glare shall be free of hazardous or obiectionable elements such as noise. odor. dust. smoke. or glare. that are operated entirely within enclosed structures and generate little industrial traffic. Research activities are encouraged- and limited office and commercial uses mav be permitted as ancillary uses. This District is further designed to act as a transitional use between heavy manufacturing uses and other less intense businesses. M lA NDUETI RK DISTRICT BP BUSINESS PARK DISTRICT: To encourage the development of technical park/research and development facilities, offices and office complexes. and limited industFial manufacturing activities including small scale production, distribution and storage of goods. Support activities mav also be permitted. All development within this District shall be designed to be within a landscaped setting. clean, quict, and be free of hazardous or objectionable elements such as noise, odor, dust, smoke or glare;_ Such development shall be operated entirely within enclosed structures, and generate little minimal industrial traffic; .. . _ _ . .. _ , . . ., . _ .. _ . _ g8 All development requiring a conditional use permit in the M lA BP Zoning District, as shown in Section 8-2-3 of this Chapter, shall occur under the PUD and/or development agreement process in accordance with Chapter 6 or 10 of this Title unless the proposed development does not meet the area requirements as set forth in Section 8-6- 5-1 of this Title. In that case a cooperative development, in conjunction with adjacent parcels (to meet the minimum area requirements), shall be encouraged. Otherwise a conditional use permit shall be required unless the proposed use is shown as a permitted use in the M -1A Zoning District within Section 8-2-3 of this Chapter. M-2 HEAVY INDUSTRIAL DISTRICT: To encourage the development of major manufacturing, processing, warehousing and major research and testing operations. Limited office and commercial uses mav be permitted as ancillary uses. These activities shall include certain uses excluded from the M-1 District for reasons of health, safety or general welfare. All development within this land use shall be free of hazardous or obiectionable elements such as noise. odor. dust. smoke. or glare. Section 7: Eagle City Code Section 8-2-2, "Official Zoning Map" (incorporated by reference) is hereby amended by adoption of the zoning designations shown on Exhibit "A" (dated as "Adopted on March 7, 2000"), attached hereto.
