AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, CREATING
CHAPTER 8 "DISORDERLY CONDUCT" OF TITLE 5 "POLICE REGULATIONS,
PROVIDING ENFORCEMENT PROVISIONS FOR PEACE OFFICERS AND
CITIZEN CITATIONS, PROVIDING A PENALTY, AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Eagle City Council is empowered to enact ordinances to
promote the general welfare pursuant to Idaho State Code § 50-302;
WHEREAS, the City of Eagle desires to prohibit disorderly conduct within its
boundaries,
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Eagle City Council as
follows:
Section 1:
5-8-1: DISORDERLY CONDUCT:
A. Any person who loiters, prowls, or wanders upon private property without
lawful business with the owner or occupant. Loiter means lingering for the
purpose of committing a crime if given opportunity.
OR
B. While in the violation of above, peeks in a door or window of an inhabited
building or structure.
OR
C. Who urinates in any public place or in any place open to the public or exposed
to public view.
OR
D. Willfully fleeing or attempting to elude a peace officer after being lawfully
ordered to stop by an identified peace officer.
Section 2:
5-8-2: ENFORCEMENT:
A. Peace Officer citation: Any peace officer or person empowered to enforce this
provision of the Eagle City Code is authorized to issue a uniform citation
upon his own observation of a violation without the necessity of a citizen
complaint's signature on said citation. By signing the citation officer or
person is certifying that he has reasonable grounds to believe that the person
cited has committed the offense contrary to law.

B. Citizen Citation: A uniform citation may also be signed by any citizen or
person in whose presence an alleged violation of this ordinance occurred and
be witnessed by a peace officer or person empowered to enforce this provision
of the Eagle City Code whose name shall be endorsed on the citation.
Section 3:
5-8-3: PENALTY
Any person violating any provision of this ordinance shall be deemed guilty of
a misdemeanor and punished as provided in section 1-4-1 of this Code.
Section 4: This ordinance shall be in force and effect upon its passage, approval, and
publication in its official newspaper pursuant to Idaho State Code § 50-901.
