Special Meeting Minutes
September 8, 2016
1. CALL TO ORDER: Mayor Ridgeway calls the meeting to order at 12:30 p.m
2. ROLL CALL: KUNZ, BASTIAN, PRESTON, SOELBERG. All present. A
quorum is present.
3. PLEDGE OF ALLEGIANCE: Mayor Ridgeway leads the Pledge of Allegiance.
4. EXECUTIVE SESSION: §74-206 - When authorized. (1) An executive session at
which members of the public are excluded may be held, but only for the purposes and
only in the manner set forth in this section. The motion to go into executive session shall
identify the specific subsections of this section that authorize the executive session. There
shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An
executive session shall be authorized by a two-thirds (2/3) vote of the governing body. An
executive session may be held:
(c) To conduct deliberations concerning labor negotiations or to acquire an interest in
real property which is not owned by a public agency.
Mayor introduces the issue.
Kunz moves to go into Executive Session in accordance with I.C. 74-206(1)(c) to
conduct deliberations concerning labor negotiations or to acquire an interest in real
property which is not owned by a public agency. Seconded by Bastian.
Bastian: AYE; Preston: AYE; Kunz: AYE, Soelberg: AYE. ALL AYES: MOTION
CARRIES ...................
Council goes into Executive Session at 12:30 p.m.
Council leaves Executive Session at 1:30 p.m.
Mayor reconvenes the meeting at 1:30 p.m.
5. NEW BUSINESS:
A. Discussion of Proposed Easement for the Dry Creek Trail: A discussion with the
Eagle Nazarene church regarding a potential Easement for the Dry Creek Trail. (SR)
Mayor introduces the issue.
Mayor asks the Councilmembers if they have any ex parte communication on this issue.
Kunz: I have two ex parte communications that I need to declare. As the Eagle URA
Chair I did receive a voice mail inquiring as to whether or not the Church property where
the pathway is proposed is in the District boundaries. I left a voice mail back that it was
not. Within the last couple of days I have received a phone call from an individual who is
affiliated with softball who sometimes may use the baseball facilities at the Church. The
individual was asking for some history as to the pathway. I was not in possession of this
information at time so I referred this individual to Mayor Ridgeway.

Preston: I have talked to Pastor Tim Bunn, he is a longtime customer in my shop, and I
also attend Eagle Nazarene Church. I know he had been working on the pathway with
Mayor Reynolds. Recently we had this meeting coming up and he said you ought to take
a look at it and I walked the path and I walked under the underpass and that is about it.
Bastian: No ex parte.
Soelberg: None for me.
Mayor: I did not receive a call from anyone. I have also met with Pastor Bunn; he is also
my neighbor and my friend. I have walked the entire property including ideas for the
future growth there.
Pastor Bunn, we as a church are very much interested in a friendship and relationship
with the City and we are very much interested in seeing the fruition of the pathway.
Displays a power point which features the design and amenities of the pathway that the
Church wants and discusses the same.
