ORDINANCE NO. 380
AN ORDINANCE CREATING TITLE 2, CHAPTER 6, EAGLE CITY CODE
PROVIDING FOR THE CREATION OF THE EAGLE ARTS COMMISSION;
ESTABLISHING THE TERMS OF OFFICE AND VACANCIES OF SUCH
COMMISSION; PROVIDING FOR SUCH COMMISSION'S ORGANIZATION,
DUTIES AND RESPONSIBILITIES; PROVIDING FOR OTHER MATTERS;
AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO:
Section 1. That Title 2, Chapter 6, Eagle City Code, be,
and the same is hereby created to read as follows:
CHAPTER 6. EAGLE ARTS COMMISSION:

2-6-4 DUTIES AND RESPONSIBILITIES
2-6-1: COMMISSION CREATED
There is hereby created a City of Eagle Arts Commission,
which Commission shall be known and designated as the Eagle
Arts Commission.
2-6-2: TERM OF OFFICE AND VACANCIES
The Eagle Arts Commission shall consist of five (5) members
appointed by the Mayor with the confirmation of the City
Council. Members shall reside in the City of Eagle. No
organization, which is a potential recipient of City arts
funding shall have on the Commission more than one person
who serves on its board or staff. In addition, no Eagle
Arts Commission member may take voting action that
financially benefits themselves, members of their immediate
family or their business and corporate affiliates.
Commissioners may be removed by the Mayor with the approval
of the City Council. Upon the appointment as herein
provided, the members of the Commission shall meet and draw
lots for the terms of office which shall be as near as
possible for an equal number of terms for two (2), and three
(3) years, and thereafter, at the expiration of any terms of
office, appointment to such office shall be for the period
of three (3) years. All members shall be eligible for
reappointment. If a vacancy shall occur during any
unexpired term, the Mayor, with confirmation of the Council,
shall appoint a member for the balance of such unexpired
term.

A. Chairman: The Eagle Arts Commission shall meet and
appoint one of its members as Chairman of the Commission,
who shall hold office for one year, and the Commission shall
also elect for the same one-year term a Vice -Chairman who
shall act as Chairman in the absence of the Chairman of the
Commission.
B. Clerk Of Commission: The Eagle Arts Commission shall
also designate one of its members a Clerk, who shall keep an
accurate record of all proceedings of said Commission.
C. Meetings: All meetings of the Commission shall be open
to the public, and follow the requirements of Idaho's open
meeting laws. A majority of the members of the Commission
shall be necessary to constitute a quorum for the
transaction of business. The Commission shall hold meetings
each month for at least nine (9) months of the year, and at
such other times as may be called by the Chairman or by the
Mayor or City Council.
D. Records Kept: The Commission shall keep minutes and
other appropriate written records of its resolutions,
proceedings and actions and submit such minutes and records
to the city clerk upon their approval.
E. Compensation: The members of the Eagle Arts Commission
shall serve and act without compensation, except that their
actual and necessary expenses shall be allowed by the
Council and the City shall provide the necessary and
suitable equipment and supplies to enable the Commission to
properly transact and perform its business.
F. Bylaws The transaction of business and the internal
affairs of the Eagle Arts Commission shall be governed by
the Bylaws of the Eagle Arts Commission. The initial Bylaws
shall be approved by resolution of the Council along with
this chapter, and shall thereafter be amended by a two
thirds vote of the members of the Commission and approved by
the Council, or returned to the Commission for amendment..
2-6-4: DUTIES AND RESPONSIBILITIES
The Eagle Arts Commission shall serve in an advisory
capacity and is established to:
a) To advise the City Council on ways in which City
Government might best serve the public with regard
to matters involving the arts.
b) To encourage and aid the appreciation and awareness
of, participation in, and preservation of the arts
among all citizens of the City of Eagle.

c) To encourage cooperation and coordination among
individuals, organizations and institutions
concerned with the arts in the City of Eagle.
d) To promote and expand the cultural resources of
Eagle, thereby facilitating employment for artists
and the development of self-sustaining arts
programs.
e) To formulate in cooperation with other City
agencies a long-range plan for the development of a
thriving cultural climate in the City of Eagle.
f) To initiate, sponsor, conduct or support, alone or
in cooperation with other public or private
agencies, public programs in the arts.
g) To advise the City Council as to the availability
and adequacy of facilities and space for the
presentation of cultural activities.
h) To review and advise on the aesthetic aspects of
all works of art or designs or public monuments
under consideration to be accepted or commissioned
by the City of Eagle.
i) To prepare and submit budgetary recommendations to
the City Council for annual expenditures necessary
to the continuation and development of public
programs furthering the arts.
j) To review funding requests and recommend to the
City Council the allocation of public monies to
artistic and cultural organization, individual
artists and community programs.
k) To seek out and encourage contributions and grants
to the arts from private and public sources and to
advise and recommend to the City Council on the
allocation of such monies appropriated and/or
granted and donated for such purposes.
Section 2: This ordinance shall take effect and be in force
from and after its passage, approval, and one (1)
publication of the ordinance in the official newspaper of
the City.

2-6-1: COMMITTEE CREATED

known and designated as the Eagle Arts Commission.
2-6-2: TERM OF OFFICE AND VACANCIES
The Eagle Arts Commission shall consist of not fewer than five (5) members appointed by
the Mayor with the confirmation of the City Council. Members shall reside in the City of
Eagle. No organization, which is a potential recipient of City arts funding shall have on the
Commission more than one person who serves on its board or staff. Upon the appointment
as herein provided, the members of the Committee shall meet and draw lots for the terms of
office which shall be as near as possible for an equal number of terms for two (2), and
three (3) years, and thereafter, at the expiration of any terms of office, appointment to such
office shall be for the period of three (3) Years. All members shall be eligible for reappoint-
ment. If a vacancy shall occur during any unexpired term, the Mayor, with confirmation of
the Council, shall appoint a member for the balance of such unexpired term.

Secretary to the Committee and shall keep an accurate record of all proceedings of said
Comrrfittee, and shall file, when ordered by the Committee, with the Council, a report of all
transactions of the Eagle Arts Commission.
C. Meetings: All meetings of the Commission shall be open to the public, and follow the
requirements of Idaho's open meeting laws. A majority of the appointive members of the
Committee shall be necessary to constitute a quorum for the transaction of business. The
Committee shall hold meetings each month for at least nine (9) months of the year, and at
such other times as may be called by the Chairman or by the Mayor or City Council.
D. Rules For Conduct Of Business: Written rules consistent with this Chapter and the laws
of the State of Idaho for the transaction of business of the Committee shall be adopted.
E. Records Kept: The Commission shall keep minutes and other appropriate written
records of its resolutions, proceedings and actions.
F. Compensation: The members of the Eagle Arts Commission shall serve and act without
compensation, except that their actual and necessary expenses shall be allowed by the
Council and the City shall provide the necessary and suitable equipment and supplies to
