PRE COUNCIL AGENDA:
1. City Hall Department Supervisor Reports:
Parks/Rec Director Aho: Reports on the Mace Trail and the conflict over the pipeline, and
the Dry Creek Pathway easement with the Church, the removal of trees and the deadline
is December 15th. General discussion.
City Clerk/Treasurer Bergmann: No report
2. Mayor and Council Reports:
Soelberg: Reports on the Historical Preservation Commission meeting.
Kunz: Reports on the ACHD meeting.

Mayor: I will meet with the Ada County Commissioners on Monday to talk about the
Ada/Eagle Sports Complex.

the prescribed time for an Executive Session which the public is not entitled to participate

EXECUTIVE SESSION: 74-206(1)(f) Pending and/or Threatened Litigation. When
authorized. (1) An executive session at which members of the public are excluded may be
held, but only for the purposes and only in the manner set forth in this section. The
motion to go into executive session shall identify the specific subsections of this section
that authorize the executive session. There shall be a roll call vote on the motion and the
vote shall be recorded in the minutes. An executive session shall be authorized by a two-
thirds (2/3) vote of the governing body. An executive session may be held:
(f) To communicate with legal counsel for the public agency to discuss the legal
ramifications of and legal options for pending litigation, or controversies not yet
being litigated but imminently likely to be litigated. The mere presence of legal
counsel at an executive session does not satisfy this requirement.

4. SERVICE RECOGNITION:
1. Volunteer of the Month — August — Mike Olsen: The City of Eagle is pleased to
recognize Mike Olsen as the Volunteer of the Month for August 2016. Mike offers his
time and expertise at City events to take professional quality photographs and gifts the
use of his pictures to the City of Eagle. Recently, Mike attended Eagle Fun Days and has
allowed -the City's use of over 200 photographs. We appreciate the time and skill Mike
dedicates to improving the quality of life in our community.
Mayor introduces Mike Olsen, thanks him for his service to the community and presents
him with a Volunteer of the Month plaque and the Volunteer of the Month Proclamation.
5. PUBLIC COMMENT:
This time is reserved for the public to address their elected officials regarding
concerns or comments they would like to provide to the City Council regarding
subjects not on the agenda. At times, the City Council may seek comments/opinions
regarding specific City matters during this allotted time. This is not the time slot to
give formal testimony on a public hearing matter, or comment on a pending
application or proposal. Out of courtesy for all who wish to speak, the City Council
requests each speaker limit their comments to three (3) minutes.
Mark McCord, Parma, I have lived in the oil and gas field for a long time. I sent you all
an email about with the oil and gas companies are doing to take over city governments.
Discusses being able to regulate oil and gas.

Shelly Brock, 8779 W. Chaparral, I have lived in Eagle for 40 some years and very
concerned about the gas and oil exploration. We have been going to the rule making
committee for several months. Discusses some proposed changes. Leaves documents for
the Council. We have been fighting hard in Gem County. We are putting on a statewide
to provide first responders in the oil and gas industry.
Shawn Nickel, we are going to be losing Frank Thomason this week. He is leaving for
Colorado and we should recognize him for what he has done for our Community.

Jane Rowling, 582 Palmetto Drive, I want to share an article with you on communities
needing to be proactive about fracking. Provides copies of the article for the Council.

6. ADDITIONS, DELETIONS OR MODIFICATIONS TO THE AGENDA:

up on the signup sheets and this would be eligible to be moved to the Consent Agenda.

16/RZ-04-16—Annexation and Rezone from RUT (Rural -Urban Transition—Ada County
Designation) to R -E (Residential—Estates) and Item#9B1 PD-01-16—Parcel Division.
Seeing none this would be eligible to be moved to the Consent Agenda.

Denney: Butch and Ida Denney, represented by Cyrus McCrory with Artisan
Construction and Remodel, Inc., are requesting conditional use permit
approval for a waiver to reduce the side yard (south) setback on Lot 2, Block
2, from 20 -feet to 10 -feet to accommodate the placement of an accessory

is requesting a noise waiver on August 13, 2016 until midnight at 50 E. State

Bastian removes the minutes from the Consent Agenda. There is a minor error on Page 7,
at the end of the 4th sentence from the end of the paragraph; the word "consideration"
should be "reconsideration".
Kunz: I have also made some corrections to the minutes.

the draft minutes? Kunz: I have also proposed some corrections to the minutes.
The proposed corrections to the minutes affected some names in the minutes. They

9. PUBLIC HEARINGS:
Public Hearings are legally noticed hearings required by state law. The public
may provide formal testimony regarding the application or issue before the City
Council. This testimony will become part of the hearing record for that
application or matter.
A. RZ-08-15/PP-08-15 — Redstone Ranch Subdivision — A Team Consultants: A
Team Land Consultants, represented by Steve Arnold, is requesting a rezone from R-3
(Residential) to MU -DA (Mixed Use with a development agreement [in lieu of a PUD])
and preliminary plat approvals for Redstone Ranch Subdivision, a 52 -lot (46 -buildable, 4 -
common, 2 -private drive lots) residential subdivision. The 10.06 -acre site is generally
located on the north side of Hill Road approximately 400 -feet west of the intersection of
Hill Road and State Highway 55. (WEV)

Cindy Maestas, 2422 Hill Road, I have no problem with the development and I just have
a couple concerns, the potential grading on the hillside and some safety and privacy
concerns. The owners have verbally agreed to grant me an easement for that small parcel
at the top.

Soelberg moves to approve RZ-08-15/PP-08-15 — Redstone Ranch Subdivision — A
Team Consultants with the amendment that we discussed previously regarding the
agreement between the homeowner and A Team Land Consultants. Seconded by
Preston. Kunz: Would the maker of the motion clarify the position about working
with ACHD on a 33' street section as a Site Specific Condition of Approval and also
the proposed Site Specific Condition of Approval revision to #13 regarding the
pressurized irrigation system and landscaping of the ITD property. Discussion.
Zoning Administrator addresses the changes. Zoning Administrator Vaughan:
provide an easement along the western property line for landscaping installation
and maintenance for the owner to the West specific easement language shall be
reviewed and approved by the City Council with the final plat application and then
adding the language that I read earlier to you with regard to the pressurized

irrigation amendment, Condition #13 which will be reflected in your Findings of
Fact and Conclusions of Law and acknowledging the condition regarding the

Soelberg: so moved. Seconded agrees. Discussion on the pressurized irrigation and
the maintenance of the ITD property. Soelberg: with that I would keep the
condition and along the lines of what the Mayor was saying we could make sure that
those special assessments will cover these costs moving forward into the future as
part of that agreement. I would like that to the City Councils directive moving
forward until we see that final plat. Discussion. Bastian: I would recommend that
we leave it to staff to negotiate an agreement. When the agreement comes to us we
can determine whether we want to support it or not. Discussion. Bastian calls for

Torfin, is requesting a rezone from R-1 (Residential) to MU -DA (Mixed Use with a
development agreement in lieu of a PUD), a development agreement modification and
preliminary plat modification for Lakemoor Subdivision, a previously approved 409 -lot
(existing platted 223 residential, 14 commercial, and 21 common [7 private road];
proposed 117 residential lots [32 attached], 16 commercial lots, 18 common lots [3
private street lots and 1 utility lot], and 1 utility lot). The entire 178.91 -acre site is
generally located on the east side of Eagle Road approximately 1000 -feet north of

Matt Rydzon, 759 E. Lake Briar Lane, I built my house in 2010. Discusses the current
construction in Lakemoor. I would suggest that there be stop signs put at Colchester
before someone gets killed. This is a safety concern. In case of a fire there is only one
way to get out.
Mike Band, I represent Jim Liley and they live at 3410 E. Chinden Blvd., the Liley's have
some concern in the expansion of Area E. The mix of residential and commercial in this
area has been concern to them. The development in Area E is in the Wylie's backyard.
They are also concerned about traffic into the development off from Chinden. General
discussion.
Dan Torfin addresses the comments from the public. I think there is a way that we can
control the construction traffic with our development partners. Discusses the concerns of
the Liley's. The lighting will already address the dark skies. We want to be a good
neighbor to Jim. We would like to keep our building height as in the Development
Agreement. The road will be built and completed this year and will be a right -in right -out
so we will have 3 accesses on Eagle Road. The density in Area E is 10 units per acre.

I would make a condition that the Developer works with the City to provide

D. RZ-05-16 — Rezone from R-4 (Residential) to CBD (Central Business District)
— Shawn Nickel: Shawn Nickel is requesting a rezone from R-4 (Residential) to CBD
(Central Business District). The 0.33 -acre site is generally located on the west side of
North Eagle Road approximately 675 -feet north of West State Street at 247 North Eagle
Road. (WEV)

Bastian moves to approve RZ-05-16 — Rezone from R-4 (Residential) to CBD (Central
Business District) with the development agreement with the following conditions,
that the one condition is to construct a water stub out for future connection to Eagle
Water and the second condition, that when the property at 277 N. Eagle Road is
developed that they connect to the water main. Discussion. Bastian: I would ask that my
second condition be stricken. Kunz withdraws his second. General discussion. Bastian:
the second condition could be that when the property at 247 N. Eagle Road would need to
connect to central water in five years. Discussion.
Kunz: I would make a substitute motion that we approve RZ-05-16 — Rezone from
R-4 (Residential) to CBD (Central Business District) for Shawn Nickel with the
following additional three Site Specific Conditions of Approval; #1. that a water
main stub at address 247 N. Eagle Road be stubbed out to N. Eagle Road for
connection to Eagle Water; #2 . that the site at 247 N. Eagle be connected to the city
water service no later than August 9, 2021 and that the Development Agreement
restrict the rezone to office use only until such time that 247 N. Eagle Road is
connected to Eagle Water. Seconded by Bastian. General discussion. Shawn
Nickel: discusses the restricted use. General discussion. Kunz amends the motion,
specifically the third recommendation that the rezone be restricted to specifically
exclude restaurant uses. Second accepts that change. Discussion. Kunz: I'm going
to amend motion again, that the third add recommendation direct city staff to

Brett Nordquist, I am the writer of the letter you received today. Discusses his concern
about the rental rate in the Sports Field Reservation Policy. I don't have a way to come
up with the additional $1,000 per year. My request is if this gets open up we may get

practice and he has some concerns over the fees for use of the fields. This item as it relates to the process for reserving
fields is on tonight's City Council Agenda item #10A
As Mr. Nordquist mentions Eagle Parks and Recreation held 2 meetings (October 21, 2015, March 7, 2016) with the
user groups to gather input and comments on the proposed process and fees. This Field Use item came before the
Parks and Pathways Committee on March 17, 2016 and they recommended that it be adopted. The fees for field use
were approved by City Council on May 24, 2016. The $10 per hour fee for field use is the same amount Meridian and
Boise charge.

Our Under 12 Year Old Idaho Rush Select Youth Soccer Team has been using Section B of the field at
Guerber Park for many years and we are classified as "Historical Users". I am the head coach and I was able

to attend one of the two preliminary meetings where the proposed "Athletic Facility Reservations Application"
was discussed, but I was unable to attend the second one due to work.
Our team consists of fourteen families. 79% of the families reside in Eagle. The remaining 21% are
from Star, Boise, and Meridian. The athletic field usage fees proposed in the "Athletic Facility Reservations
Application" state that the "rate per field/section" is $10 per hour. We have been using section B of Guerber
Park with a written permit issued by Caitlin Straubinger for each season (both fall and spring), but we have not
needed to pay field usage fees in the past. I already submitted an "Athletic Facility Reservation Application"
on June 25, 2016 and soccer practice will be starting this week. We have traditionally requested to use Section
B for approximately 24 practices at two hours per practice. If this new "Athletic Facility Reservations
Application" proposal passes, that will mean our team will need to come up with an additional $480 to obtain
a permit, or be forced to leave Guerber Park if another team obtains a permit and wants to use Section B of the
field. An additional $480 requested by Eagle Parks and Recreation added to the Rush soccer registration fees
is a financial hardship that will not be possible for the families of our team members. We have no other way
to fund this type of proposed field fee. We are asking for a fee waiver or another possible option to allow our
team to continue practicing at Guerber Park.

13. The pressurized irrigation system has been approved as a shared system between the City of Eagle,
WyCliffe Estates Subdivision, Cedarfield Subdivision, and Redstone Ranch Subdivision. The applicant
shall provide an updated pressurized irrigation analysis to reflect the redesign of Redstone Ranch
Subdivision (52 lots, 46 buildable lots, 4 -common lots, 2 private drive Tots) for the inclusion into a
"Second Amended Pressurized Irrigation Operation and Maintenance Agreement". As part of that
amended agreement and as part of the required design review application, the developer of Redstone
Ranch will submit a separate landscape plan and a cost estimate for landscaping the ITD property
generally located at the northwest corner of SH 55 and Hill Road. The City will coordinate with all
parties (parties to the second amended agreement) to include provisions into the Second Amended
Irrigation Operation and Maintenance Agreement regarding the perpetual maintenance of the
landscaped areas of the aforementioned ITD property. It is anticipated that the parties will
proportionately share in the cost of ongoing maintenance. The Second Amended Irrigation Operation
and Maintenance Agreement shall be reviewed and approved by the City Council prior to approval of
the first final plat application. In the event an agreement cannot be reached, the City Council may
amend this condition accordingly with the final plat application as part of a New Business agenda item,
and as such, a public hearing will not be required so long as advanced notice is provided to all parties
(parties to the second amended agreement) of the date and time of the city council meeting.

Water contamination just as high from conventional as from
shale wells — scientists find

Duke University scientists studying wastewater being discharged or spilled into streams and rivers from oil and gas
operations in Pennsylvania and West Virginia have found that levels of contamination were just as high in
wastewater corning from conventional oil and gas wells as from hydraulically fractured shale gas wells.
In wastewater flowing into reservoirs from both types of oil and gas operations the researchers have discovered
high levels of two potentially hazardous contaminants. ammonium and iodide.
"By measuring naturally occurring ammonium and iodide in numerous samples from different geological
formations in the Appalachian Basin, including flowback waters from shale gas wells in the Marcellus and
Fayetteville shale formations, we show that fracking fluids are not much different from conventional oil and gas
wastes." said Jennifer S. Harkness, lead author of the study and a PhD student at Duke's Nicholas School of the
Environment.
When dissolved in water. ammonium can convert into ammonia, which is highly toxic to aquatic life. The scientists
detected ammonium levels of up to 100 milligrams per litre in oil and gas effluents they collected at the wastewater
discharge sites. Those levels are more than 50 times higher than the EPA water -quality threshold for protecting
freshwater organisms.
Elevated iodide in surface water can promote the formation of highly toxic byproducts in drinking water when the
iodide mixes with the chlorine used to disinfect the water at municipal treatment plants located downstream from
oil and gas operations. Such disinfection byproducts are not monitored by state or federal agencies.
The peer-reviewed study. appearing this week in the journal Environmental Science & Technology, is the first to
document the presence of high levels of ammonium and iodide in oil and gas wastewater.

"This discovery raises new concerns about the environmental and human health impacts of oil and gas
wastewater in areas where it is discharged or leaked directly into the environment," said Avner Vengosh, professor
of geochemistry and water quality at Duke's Nicholas School of the Environment.
"Our data clearly show that the current brine treatment practice in Pennsylvania is not sufficient to remove these
contaminants," Vengosh said.
To conduct the study, the researchers collected and analyzed 44 samples of waters produced from conventional
oil and gas wells in New York and Pennsylvania and 31 samples of flowback waters from hydraulically fractured
shale gas wells in Pennsylvania and Arkansas. They also collected and analyzed oil and gas effluents that were
being directly discharged into streams, rivers and surface waters at three disposal sites in Pennsylvania and a spill
site in West Virginia.
"Wastewater from both conventional and unconventional oil and gas operations is exempted from the Clean Water
Act, which allows their disposal to the environment. This practice is clearly damaging the environment and
increases the health risks of people living in these areas, and thus should be stopped," Vengosh said.

This office represents an Idaho property owner who will be impacted by the Oil and
Gas Operations Ordinance that this Commission is preparing and implementing for Gem
County. I have had an opportunity to review the proposed Ordinance, as well as Richard
K. Linville, Gem County Prosecuting Attorney's letter to the Commission dated May 25,
2016, as well as various neighboring county ordinances on point.
First, please let me point out that Linville's letter incorrectly overstated the limits of
Idaho Code Section 47-317, when he stated that, "the legislature of the State of Idaho has
decided that such extensive regulation at the local level in not permitted by Idaho law." The
statute actually only states that the local ordinances shall not "prohibit" the extraction of oil
and gas. To the contrary, the statute expressly acknowledges that local governments will
have regulatory authority of oil and gas extraction. Idaho Code Section 47-319, as
amended, states, "Without limiting its general authority, and without limiting the authority
of other state agencies or local government as provided by law, the commission shall have
the authority ...." (emphasis added).
The Local Land Use Planning Act ("LLUPA") allows counties to impose additional,
non -conflicting, regulations for oil and gas extraction. The premise of this letter is based
largely in part on the Idaho Attorney General's Office Opinion 11-1, sent to the Office of

the Prosecuting Attorney for Payette County when it was passing similar oil and gas zoning
ordinances. For your convenience, I am attaching the Opinion hereto, and will try not to
duplicate the legal basis for our position that Gem County has the power to pass similar
restrictions on oil and gas extraction within the county.
LLUPA generally encourages counties to take a hands-on approach to ensuring the
public health, safety and general welfare of its constituents. The legislature may have
recently made changes to the Oil and Gas Act, however, these recent changes do not impact
the counties' right, if not duty, to protect the life, liberty and property of its constituents. To
the contrary, LLUPA ensures that counties can (and frankly should) provide the following:
a. Protect property rights of its constituents
b. Protect local environmental features;
c. Protect life and property in areas subject to natural hazards and disasters;
d. Protect fish, wildlife and recreational resources;
e. Avoid undue water and air pollution, just to name a few.
I.C. § 67-6502. In order to achieve these things, counties have wide discretion when it
comes to planning and development guidelines through zoning ordinances. LLUPA requires
local planning and zoning commissions "to conduct a comprehensive planning process
designed to prepare, implement, and review and update a comprehensive plan, hereafter
referred to as the plan." I.C. § 67-6508. Perhaps most importantly related to the issue at
hand (oil and gas extraction), LLUPA dictates that the comprehensive plan must consider the
property rights of its constituents when creating passing and applying zoning ordinances.
In this instance, the county must balance the needs and rights of its constituents
against the interests related to oil and gas extraction. While the county is not at liberty to
prohibit oil and gas extraction, this Commission has a duty to pass ordinances putting
restrictions on the physical process of extraction of oil and gas within the county in an effort
to protect the property rights, safety, health and the general wellbeing of its constituents.
It is my understanding that the representative spokesperson for Alta Mesa has made
comments on the proposed zoning ordinances, and has asked this Commission to ease the
restrictions, setbacks, monitoring processes, etc., which quite frankly is putting profit before
person. LLUPA was designed to protect person and property first, which is what this
Commission should do instead.

The Linville letter further encouraged this Commission to ease the restrictions on
setbacks, monitoring processes, etc. Again, we adamantly disagree. At a minimum, this
Commission should adopt ordinances more in line with Dallas, Texas' Oil and Gas
Ordinances. A copy is attached hereto for your convenience. They require a permitting
process, water monitoring, oversight on construction, to name a few. The setback
requirements should be increased, but overall, the Dallas ordinance protects the health,
safety, general welfare and property of its constituents. This Commission should be doing
the same.

Fracking, horizontal high-volume hydraulic fracturing is a process that forces a mixture of
water, sand and chemicals under high pressure deep into the ground to extract oil and
natural gas in shale rock formations. Fracking has allowed the United States to become a
net energy exporter, but has created substantial problems for local communities hosting
fracking operations.
Authors Carolyn G. Loh, associate professor at Wayne State University, and Anna C. Osland, founder and principal
of Anna C. Osland Consulting, surveyed 140 local governments in four states with very active fracking: Colorado,
Louisiana, North Dakota and Pennsylvania. The authors set out to determine the kinds of policies these local
governments adopted to address the negative impacts of fracking and the role organizational capacity had on how
local governments deal with fracking.
In "Local Land Use Planning Responses to Hydraulic Fracturing," Loh and Osland found that the most common local
government response was no response at all. Fifty-four of the communities surveyed had not adopted any
regulations to address any of the problems caused locally by fracking activities.
Of survey respondents that have adopted regulations, the five most common local policies were.
1. Restricting the location of industrial activities;
2. Mandating fencing and landscaping around fracking sites;
3. Preventing vehicles used in fracking operations from traveling on certain roadways;
4. Requiring special use permits for drilling sites; and
5. Establishing setbacks for the compressor stations associated with fracking options.
While the environmental impacts of fracking are hotly debated, fracking can also have a positive impact on local
economies. Pros and cons aside, fracking operations can create substantial management problems for local
governments and expose local residents to serious health, safety, and environmental hazards. This leaves local
communities that might or do host such operations "scrambling" to address fracking, not trusting the state or federal
government to protect them.
The authors found that communities could use existing land use, noise and zoning restrictions to regulate fracking
operations to some degree, even though survey respondents reported concern there was little they could do to
address local fracking impacts.

Communities with more capacity -- more knowledge and experienced technical staff -- as well as those that had
experienced a fracking-related industrial accident were more likely to have adopted some regulations to either
prevent or address fracking issues.
Loh and Osland conclude that local governments do have some room to regulate local fracking operations. They
recommend that states invest in providing capacity building at the local level, offering technical assistance and
training to local planners and administrators. The authors stress that communities should be proactive and not wait
for an industrial accident or the cumulatively greater environmental, health or economic costs that fracking imposes
on local communities to add up.
