Minutes - 2022 - City Council - 04/07/2022 - Special EAGLE CITY COUNCIL MEETING MINUTES April 7,2022 1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 3:00 PM. 2. ROLL CALL: GINDLESPERGER,RUSSELL,BAUN,PIKE. Baun absent,a quorum is present. 3. PLEDGE OF ALLEGIANCE 4. PRESENTATIONS: A. Ada County Assessor:Assessor Robert McQuade will give a report to the Mayor and Council. Mr. McQuade stated that assessment notices would be mailed out to all residents by the end of May. He discussed the one-time tax reduction offered by the State of Idaho last year and its effect on homeowners. He then provided a brief overview of the current property values, residential and commercial,and the process of how those values are reached. He discussed the New Construction Roll and how the different categories change as property is developed or use is changed. He further explained that the new Homeowners Exemption law allows homeowners to claim their exemption until the end of the year rather than the original date of April 15t. This change causes the taxable market values to continually change throughout the entire year and in some cases causes a tax rebate for the homeowner. When asked, Mr. McQuade said that the City's levy rate is one of the lowest in Ada County. The power point from Mr.McQuade's presentation is attached to these minutes. 5. ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS: CONSENT AGENDA: • Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor, a Councilmember,member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council. • Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, Planning &Zoning Commission, or Design Review Board shall be adopted as part of the City Council's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of March 22,2022. B. A Service Proposal between the City of Eagle and Advanced Sign:A service proposal between the City of Eagle and Advanced Sign for the fabrication and installation of the City of Eagle Seal plaques for the City Hall expansion exterior in an amount not to exceed$10,900. (ELZ) C. A Service Quote between the City of Eagle and Graybar: A Service Quote between the City of Eagle and Graybar for the purchase of 2" and 1.25 conduit to be utilized for the City Fiber Optic System in an amount not to exceed$55,051.85. Staff is proposing to utilize ARPA funds for this expense. (ELZ) D. ARPA Funding Expenditure Approval: Staff is requesting Council approval to utilize ARPA funding to pay for staff travel costs associated with the retrieval of fiber optic equipment that was purchased out of state, in an amount not to exceed$1,027.65. (ELZ) E. Agreement Between the City of Eagle and Knife River Corporation: An agreement between the City of Eagle and Knife River Corporation for the construction of the Eagle Road pedestrian and bicycle bridge in the amount not to exceed$3,313,387.00. (NBS) Mayor Pierce introduces the consent agenda. Pike requests the removal of Item 5C from the consent agenda for clarification. Pike made a motion to approve items 5A through 5E with the exception of Item 5C. The motion was seconded by Gindlesperger. Roll call vote: GINDLESPERGER, AYE; PIKE, AYE; RUSSELL AYE. MOTION CARRIED. Pike asked for clarification that this conduit purchase was bid according to Idaho Code requirements for purchases over $50,000. Public Works Director, Eric Ziegenfuss, presented the bidding documentation for three different vendors. Legal Counsel confirmed the proper steps were followed for this purchase. Pike made a motion to approve Item 5C. The motion was seconded by Russell. Roll call vote: GINDLESPERGER,AYE; PIKE,AYE; RUSSELL AYE. MOTION CARRIED. 6. PUBLIC COMMENT 1: The Eagle City Council is taking both in person and remote public comment via Webex. Meeting login instructions are posted on https://www.cityofeagle.org/1698Nirtual-Meetings. If you just want to watch the meeting, without giving comment, please watch our livestream at https://www.cityofeagle.org/305/City-Agendas-Videos. This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding any matter, up to and including any subject on the agenda with the exception of Public Hearing and land use items. Comments regarding Public Hearing and land use items need to be made during the open public hearing for said item(s)in accordance with Idaho Code. At times,the City Council may seek comments/opinions regarding specific City matters(excluding Public Hearing and land use items)during this allotted time. Out of courtesy for all who wish to speak,the City Council requests each speaker limit their comments to three(3)minutes. No public comment. 7. EXECUTIVE SESSION: A. Idaho State Code 474-206. Executive Sessions -- When authorized. (1) An executive session at which members of the public are excluded may be held,but only for the purposes and only in the manner set forth in this section. The motion to go into executive session shall identify the specific subsections of this section that authorize the executive session. There shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An executive session shall be authorized by a two-thirds (2/3) vote of the governing body. An executive session may be held: (c) To acquire an interest in real property which is not owned by a public agency. Russell made a motion pursuant to I.C. 74-206(1) that the City of Eagle convene an Executive Session for the purpose of: (c) To acquire an interest in real property which is not owned by a public agency. The motion was seconded by Gindlesperger. Roll call vote: GINDLESPERGER, AYE; PIKE,AYE; RUSSELL AYE. MOTION CARRIED. City Council entered executive session at 3:21 PM. Discussion of property acquisition. City Council reconvenes at 3:31 PM. B. ACTION ITEM: Action regarding acquisition of real property. No action. 8. ADJOURNMENT: Gindlesperger made a motion to adjourn. The motion was seconded by Russell. ALL AYES,MOTION CARRIED. Hearing no further business, the City Council meeting was adjourned at 3:32 PM.
