ORDINANCE 395
AN ORDINANCE AMENDING EAGLE CITY CODE TITLE 8 "ZONING", CHAPTER 8
"AREA OF CITY IMPACT", SECTION 3 "APPLICABLE PLAN POLICIES AND
ORDINANCES"; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, The Eagle City Council and the Ada County Commissioners entered into
negotiations and resolved through the public hearing process, to amend the Eagle Area of City
Impact Applicable Plans Policies and Ordinances to recognize the 2000 Comprehensive Plan as
the plan which applies in the Eagle area of City impact;
WHEREAS, The City Council and the Ada County Commissioners agree pursuant to
Blaha v. Board of Ada County Commissioners, that subdivision applications within the Eagle
area of City impact are to be submitted to the City for their recommendation to the County for
consideration.
NOW, THEREFORE, BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF EAGLE, IDAHO, as follows:
Section 1: That Eagle City Code Section 8-8-3, be, and the same hereby is, amended to
read as follows:
8-8-3: APPLICABLE PLAN POLICIES AND ORDINANCES:
A. The Eagle Comprehensive Plan, as adopted and amended by the City on March 10, 1987,
July 18, 2000, by Resolution 1 87 00-06, shall apply within the Eagle area of City impact.
Subsequent amendments to the aforesaid Eagle Comprehensive Plan shall apply within
the Eagle area of City impact if the City and the County so agree.
B. Applications for subdivision development in the Eagle area of City impact shall be
evaluated for conformance to the design and improvement standards contained in the
Eagle City Code, Title 9, Chapter 3, and in Chapter 4, Sections 9-4-1 through 9-4-1-12.

C. All subdivision plats situated within the area of City impact shall be submitted to the City

D. The Ada County Zoning Ordinance (Ada County Code, title 8) shall be used to
implement this Chapter.
Section 2: That this Ordinance, or a summary thereof in compliance with Section 50 -

901A, Idaho Code, shall be published once in the official newspaper of the City, and shall take
effect immediately upon its passage, approval, and publication.
