ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY IDAHO AMENDING EAGLE
CITY CODE TITLE 8 "ZONING", CHAPTER 2 "ZONING DISTRICTS AND MAP",
SECTION 3 "SCHEDULE OF DISTRICT USE REGULATIONS", TABLE TITLED
"OFFICIAL SCHEDULE OF DISTRICT REGULATIONS" AND SECTION 4 "SCHEDULE
OF BUILDING HEIGHT AND LOT AREA REGULATIONS"; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Eagle finds that Emergency Services and Nursing/Convalescent
Homes (which includes senior assisted living facilities) should be permitted uses, or permitted
with City approval of a conditional use permit, in additional zoning districts to allow more
flexibility for the location of such needed services;
WHEREAS, the City of Eagle finds that Child Care Facilities, Churches,
Nursing/Convalescent Homes (which includes senior assisted living facilities), Schools (Public
or Private), should be allowed an increased maximum lot coverage in certain zoning districts to
allow development of said uses within those districts.
WHEREAS, the City of Eagle finds that Nursing/Convalescent Homes (which includes
senior assisted living facilities) should be located adjacent to an arterial or collector roadway in
certain zoning districts.
WHEREAS, the City of Eagle finds that a new definition entitled "Emergency Services",
with associated parking requirements should be added to allow development of said uses within
certain zoning districts.
THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO, as follows:
Section 1: Eagle City Code Title 8 "Zoning", Chapter 1 "Zoning Interpretations and
Definitions", Section 2 "Rules and Definitions" is amended with strike -through text being
deleted and underlined text being added as follows:
Ambulance Services: Provision of non -emergency medical care transportation, including
incidental storage, and maintenance and parking of medical transport vehicles.

Section 3: Eagle City Code Title 8 "Zoning", Chapter 2 "Zoning Districts and Map",
Section 4 "Schedule of Building Height and Lot Area Regulations" is amended with underlined
text to be added as note "J" under "*Note Conditions" as follows (see attached table titled,
"Schedule of Building Height and Lot Area Regulations":
(J) Child Care Facilities, Churches, Nursing/Convalescent Homes (which includes senior
assisted living facilities), Schools (Public or Private), which are proposed within an Agricultural
District (A), Agricultural -Residential District (A -R), and/or Residential -Estates District (R -E),
shall be permitted an increase of the maximum lot coverage from 10% to 24%.
Section 4: Eagle City Code Title 8 "Zoning", Chapter 3 "Performance Standards",
Section 2 "Supplemental General Provisions" is amended with underlined text to be added as
letter "G" as follows:
G. Nursing/Convalescent Homes (which includes senior assisted living facilities) shall be
located adjacent to an arterial or collector roadway in zoning districts A, A -R, R -E and R.
Section 6: Eagle City Code Title 8 "Zoning", Chapter 4 "Off Street Parking and
Loading", Section 5 "Schedule of Parking Requirements" is amended with strike -through text
being deleted and underlined text to be added as follows:
Emergency Services 1 per 500 scl. ft. of gross floor area: plus minimum of two enclosed
vehicle storage spaces.
Section 7: The provisions of this ordinance are hereby declared to be severable and if any
provision of this act or the application of such provision to any person or circumstance is
declared invalid for any reason, such declaration shall not affect the validity of remaining
portions of this ordinance.

Section 8: This ordinance shall take effect and be in force from and after its passage,
approval, and publication as required by law. In lieu of publication of the entire ordinance, a
summary thereof in compliance with Section 50-901A, Idaho Code, may be published.
