ORIGINAL ORDINANCE NO. 432 AN ORDINANCE OF THE CITY OF EAGLE, IDAHO, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AMENDING EAGLE CITY CODE TITLE 7, CHAPTER 1A, ADOPTING THE 2000 EDITION OF THE INTERNATIONAL BUILDING CODE, THE INTERNATIONAL RESIDENTIAL CODE, PARTS I-IV AND IX, AND THE INTERNATIONAL ENERGY CONSERVATION CODE; AMENDING EAGLE CITY CODE TITLE 7, CHAPTER 1B, ADOPTING THE 2000 EDITION OF THE INTERNATIONAL MECHANICAL AND FUEL GAS CODES; AMENDING TITLE 7, CHAPTER 1C, ADOPTING THE 2002 EDITION OF THE NATIONAL ELECTRICAL CODE; AMENDING TITLE 7 CHAPTER, 1D, ADOPTING THE 2002 EDITION OF THE INTERNATIONAL FIRE CODE; PROVIDING EXCEPTIONS; PROVIDING FOR SEVERABILITY; REPEALING CONFLICTING ORDINANCES AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Idaho Legislature has enacted legislation requiring that cities adopting uniform building codes shall adopt the International Building code rather than the Uniform Building code; and WHEREAS, the City Eagle, Idaho finds that the adoption of the International Building Code, the International Residential Code, parts I-IV, IX, and the International Conservation Code will safeguard life or limb, health, property and public welfare and the Eagle City Council has deemed it to be in the best interest of the City of Eagle. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO, as follows: Section 1: Title 7, Chapter 1A, of the Eagle City Code is hereby amended to read as follows: 7-1A-1: 7-1A-2: 7-1A-3: 7-1'1 1: 7h4 5: 7 1A 6: Short Title And Purpose Adoption Of Codes Amendments To Adopted CodesThe Uniform Bu Id;.,,. node Code iority 7-1A-1: SHORT TITLE AND PURPOSE: This Chapter shall be known and cited as the CITY OF EAGLE BUILDING CODE ORDINANCE. The purpose of this Chapter is to provide minimum standards and requirements to safeguard life or limb, health, property and public welfare, by regulating and controlling, grading, quality and installation of materials, use, occupancy and maintenance of all buildings, manufactured homes and structures in the City. The following codes, except as herein amended are hereby adopted and incorporated by reference as if fully set forth herein, and shall apply in the City. This eChapter shall include rules and regulations governing all grading and building activity including: erection, construction, enlargement, alterations, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of buildings or structures, installation requirements for manufactured homes. It shall be unlawful to engage in any grading or building activity without complying with the rules and regulations as contained in this eChapter and the codes adopted herein. The following codes and portions thereof are on file in the office of the City Clerk, in accordance with Idaho Code, section 31-715. To the International Building Code: Section A. Add Appendix E. SUPPLEMENTTARY ACESSABILTTY REOUIRMENTS and Appendix J. SUPPLEMENTARY ACCESSABILITY REOUIRMENTS FOR OUALWF'IED HISTORIC BUILDINGS AND FACILITIES. 1. Delete Sections, 101.4.1, "Electrical" 101.4.4, "Plumbing" and 101.4.5. "Property Maintainance". 2. Section 103.2, " Appointment" is deleted. 3. Section 105.1.1 " Annual permit" is deleted. 4. Section 105.1.2 " Annual permit records " is deleted. 5. Section 105.2, Subsections on Electrical and Plumbing are deleted. • Section 105.3.1, "Action on application" shall be amended to add the text as follows: For new construction, written approval or fee receipts shall be obtained from the following agencies and provided to the City of Eagle in order to receive an Eagle Buildine Permit: • Ada County Highway District (ACHD) Impact Fee receipt or ACHD Impact Fee waiver. • Central District Health Department Septic System Approval or Eagle Sewer District Connection Fee receipt or Connection Fee waiver. • Park Impact Fee receipt or Park Impact Fee waiver. • Water Service Provider Fee Receipt or Department of Environmental Oualitv Well Certification. 6. Building permit valuations" shall be amended to add the text as follows: The value to be used in computing the building permit fee shall be either the total value of construction work for which the permit is issued as stated by the Building Permit Applicant, or the value calculated using "Building Valuation Data" established by a resolution adopted by the Eagle City Council whichever is the larger amount. The fee for each building permit shall be calculated using a "Building Permit Fee Table" established by resolution 98-10 adopted by the Eagle City Council or any subsequent resolution approved by the City Council. Plan Review Fees: add Plan Review Fees for Group R. Division 3 and Group U. Division 1 Occupancies shall be determined by resolution 98-10 adopted by the Eagle City Council. or any subsequent resolution approved by the City Council. 8. Section 109.3.8. "Other inspections" shall be amended to add the text as follows: Re -inspections shall be charged a fee of fifty ($50.00) per inspection. 9. Section 112.1. "General". shall be amended to add the text as follows: All appeal hearings will require a fee as approved and adopted by resolution of the City Council to defray expenses incurred in travel and overhead of the members of the Building Appeals Board and administrative costs as determined by the Eagle Building Official. 10. Section 111.1. "Connection to service utilities" is amended to read as follows: A final inspection and approval is required upon completion and prior to occupancy and use of all buildings and structures. Lack of building official approval may result in the termination of utility services to said building or structure and prosecution under IBC section 113.3. 11. Add Section 114.4. "Investigation Fees Work without a Permit". Whenever any work for which a permit is required by this code has been commenced without first obtaining said permit, a special investigation shall be made before a permit may be issued for such work. An investigation fee, in addition to the permit fee, shall be collected whether or not a permit is then or subsequently issued. The investigation fee shall be equal to the amount of the permit fee required by this code. The minimum investigation fee shall be the same as the minimum fee set forth in Section 108.2. The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this code nor from any penalty prescribed by law. All re -inspections shall be charged at a rate of Fifty ($50.00) dollars 12. Section 115. "UNSAFE STRUCTURES AND EOUIPTMENT" is deleted. 13. Section 903.2.8 "Group R-2" is amended to read as follows: An automatic sprinkler system shall be provided throughout all buildings with a Group R-2 fire area where more than two stories in height. including basements. or where having more than 6 dwelling units. Section 1608.2, " Ground Snow Loads"is amended to read as follows: The ground snow load to be used in determining the design snow load for the City of Eagle shall be 20 psf (PQ). 15. Section 1612. " FLOOD LOADS" is deleted. B. To the International Residential Code, parts I-V and IX. 1. Section R103.2. " Appointment" is deleted 2. Section R104.10.1. Areas prone to flooding" is amended as follows: The building official shall not grant modifications to any provisions related to areas Drone to flooding established by Table R301.2 (1) with review and approval by the Eagle City Floodplain Administrator. 3. Section R105.2. " Work Exempt from permit" shall be amended to read as follows: 1. One story detached accessory structures. provided the floor area does not exceed 120 Square Feet. Section R108 Fees insert following section as follows, R108.6 Investigation Fees: Work without a Permit. Subsections on Electrical and Plumbing are deleted. 4. Section 105.3.1.1, "Substantially improved or substantially damaged existing buildings and structures" is amended as follows: For applications for reconstruction, rehabilitation, addition, or other improvement of existing buildings or structures located in and area prone to flooding as established by Table R301.2 (1), the Eagle City Floodplain Administrator shall examine or cause to be examined the construction documents of the proposed work. For buildings that have sustained damage of any origin, the value of the proposed work shall include the cost to repair the building or structure to its pre -damage condition. All substantially improved or reconstruction of existing structures shall be made in accordance with the Eagle city floodplain ordinance. 5. Section R106.5, Retention of construction documents " is deleted. 6. Section R108.2. "Schedule of permit fees" shall read to include additional text adopted above in section A-3. 7. Add section R108.6. "Fee" An investigation fee. in addition to the permit fee, shall be collected whether or not a permit is then or subsequently issued. The minimum investigation fee shall be the same as the minimum fee set forth in section 108.3 International Building Code. IRC Section 309.2, "Separation Required" is amended to read as follows: Private garages shall be separated from residences and their attic area by means of a minimum 5/8 inch. type X gypsum board applied to the garage side. Door openings between the garage and residence. shall be equipped with either a solid core wood door not less than 1 3/8 inch in thickness, solid or honeycombed steel doors not less than 1 3/8 inch in thickness. or doors in compliance with IBC Section 714.2.3. Openings from a private garage into a room used for sleeping purposes shall not be permitted. 13. IRC Section R316.2, "Guard opening limitations" is amended to read as follows: Required guards on open sides of stairways. raised floor areas. balconies and porches shall have intermediate rails or ornamental closures that do not allow passage of a sphere 4 inches (102 mm) in diameter. Exception: The triangular opening formed by the riser. tread and bottom rail of a guard at the open side of the stairway are permitted to be of such a size that a sphere 6 inches (152mm) cannot pass through. 14. Add Appendix chanter G. SWIMMING POOLS. SPAS AND HOT TUBS. C. To the International Energy Conservation Code: 1. Section 104.2, "Information on construction documents" shall be amended to add the text follows: All construction documents shall be submitted with a ResCheck or COMcheck compliance statement. 2. The International Mechanical Code, 2000 All buildings shall be subject to mechanical fees as established and set by resolution of the Eagle City Council. A schedule of said fees is on file in the office of the City Clerk. 7-1B-34: MECHANICAL INSPECTOR: A. Appointment, Term Of Office: The City Council shall have the power to appoint a person qualified and experienced in heating, ventilation and air conditioning, to be Mechanical Inspector who shall hold such office at the discretion of the City Council and whose duties shall be overseen by the Building Official. B. Duties: It shall be the duty of the Mechanical Inspector to attend to the enforcement of the provisions of this Article, as the same shall pertain to the inspection and supervision of mechanical systems. The Mechanical Inspector shall have the jurisdictional authority to inspect, and shall inspect, installations of heating, ventilation, air conditioning and related equipment within the City's limits, to give notice of mechanical violations, to issue or cancel mechanical permits, and to otherwise carry out their duties as Mechanical Inspector for the City. C. Compensation: The compensation that the Mechanical Inspector shall receive for providing services shall be fixed by the City Council and shall be paid in the same manner as other claims against the City. Section 3: Title 7, Chapter 1C, Section 1 of the Eagle City Code is hereby amended to read as follows: 7-1C-1: ELECTRICAL CODE ADOPTED: Except where a different standard is required by this article, all work of electrical wiring, installation and construction, and the material, apparatus and fixtures used therein shall be in accordance with the rules established in the 1999 2002 Edition of the National Electrical Code, which is hereby adopted for the city, except: compliance with article 675-8(b) will include the additional requirement that a disconnecting means always be provided at the point of service from the utility no matter where the disconnecting means for the machine is located. The Idaho State Division of Building Safety shall inspect such work and report violations to the Building Official. Agricultural buildings are exempt from the building codes adopted herein but shall remain subject to placement requirements established by zoning regulations. Section 6: SEVERABILITY. This ordinance is hereby declared to be severable. Should a court of competent jurisdiction declare any portion of this ordinance invalid, the remaining provisions shall continue in full force and effect and shall be read to carry out the purpose(s) of the ordinance before the declaration of partial invalidity. Section 7: REPEAL OF CONFLICTING PROVISIONS. All provisions of the current Eagle City Code or ordinances of the City of Eagle, Idaho, which conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict. Section 8: EFFECTIVE DATE. This Ordinance, or a summary thereof in compliance with Section 50-901A, Idaho Code, shall be published once in the official newspaper of the City, and shall take effect immediately upon its passage, approval, and publication. Permit Fees for fuel gas piping shall be as follows: For each gas piping system of one to five outlets 5.00 For each additional gas piping system, per outlet 1 00 11. Process Piping: For each hazardous process piping system (HPP) of one to four outlets 5 00 For each HPP piping system of five or more outlets, per outlet 100 5.00 For each nonhazardous process piping system (NPP) of one to four outlets For each NPP piping system of five or more outlets, per outlet 1.00 Other Inspections and Fees 1.
