Hi Doug,
Per our phone conversation today, Randy talked to you back on June 7th, 2012 regarding getting
structural Engineering to accept the bearing points on the Brookwood Trellis. If you are not able to
provide the structural Engineering, we will need to Expire this permit on August 15t, 2012. You and
the Brookwood HOA received an expiration letter dated 4/18/12 and the permit was to expire on
5/18/12 but we extended the permit waiting for you to get back in town to resolve this issue.
Hopefully we can get this issue resolved asap.

whomever are the powers to be are that need to know that this shade trellis was built and
completed at Brookwood last year before pool opening the end of May, 2011.
Doug Clegg who was the board member that over saw the construction and completion is in
Cambodia until June on a humanitarian mission.
I am not familiar with what steps now need to be taken to finalize this process, and will wait
to hear from someone from the City if they could communicate directly to me in Doug's
absence at this Brookwood email address.

Dear CCI Construction Inc,
The Building Permit issued for a Trellis in Pool Area, located at Lot 102 Block 3 in the Brookwood#7 Subdivision,
will be deemed expired as of May 18,2012 under the Building Code stated below. To receive a`Certificate of Completion',
you must finalize this project prior to the expiration date above:
IBC&IRC sections 105.5 are amended to read as follows:
105.5 Expiration.Every permit issued by the building official under the provisions of this chapter shall expire by limitation and become
null and void if the building or work authorized by such permit is not commenced within 180 calendar days from the date of such permit,
or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of
180 calendar days.
The timeframe by which a project shall be deemed to be suspended or abandoned shall be measured from the date of the last major
inspection that resulted in an approval to move to the next stage of construction by the city of Eagle or if no inspection has been required
then a project shall be deemed to be suspended 180 calendar days from the date the permit was issued
Eagle City Code Sec 105.5 also States:
If more than one year has passed since the permit has expired or the city has adopted a new version of the building code, then the
applicant shall apply for a new permit and the plans will be subject to a new plan review process and related permit fees.
The City of Eagle regrets this project was never finalized. If you have any questions regarding this action or to

A. PROJECT SUMMARY:
Brookwood Subdivision,represented by Walter Lindgren, is requesting design review approval to
construct a 300-square foot open pergola structure on the east side of the pool at the Brookwood
Subdivision pool house. The site is located on the south side of East Brookwood Drive approximately
2,850-feet east of Eagle Road at 809 East Brookwood Drive.
B. APPLICATION SUBMITTAL:
The City of Eagle received the application for this item on April 7,2011.
C. HISTORY OF RELEVANT PREVIOUS ACTIONS:None
STAFF ANALYSIS:
A. COMPREHENSIVE PLAN PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS
PROPOSAL:None
B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL:

boards,materials boards and documentation are part of the public record and shall become the
property of the City.The applicant may be required to supply the City with colored photos of the
presentation boards if determined by the Zoning Administrator.The size of the photos shall be
determined by the Zoning Administrator and the boards may be returned to the applicant if the photos
are provided to the City.
C. DISCUSSION:
• The application,site,and elevation plans stamped as received by the City of Eagle on April 7,2011,have
been reviewed by the City of Eagle Zoning Administrator and will conform to applicable Eagle City
Codes with the requirements provided herein.

• The applicant is proposing to use steel columns painted black with douglas fir beams,rafters,and wood
ties that will be stained and sealed to match the existing pergola on the west side of the pool.
• This item will not be heard by the Design Review Board unless the site plan/building plan is changed in
such a manner as to not conform with the permitted approval of the Zoning Administrator.
SITE SPECIFIC CONDITIONS OF APPROVAL:
1. A building permit required to be submitted,reviewed and approved by the City prior to any structures being
constructed on this site.
2. No signs are permitted with this application.
STANDARD CONDITIONS OF APPROVAL:
1. The Americans with Disabilities Act,Uniform Building Code,Eagle City Code,and all applicable
County, State and Federal Codes and Regulations shall be complied with. All design and construction
shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the City
Council.
2. New plans which incorporate any required changes shall be submitted for staff approval. Staff may elect
to take those plans to the Design Review Board and/or City Council for review and approval.
3. Any changes to the plans and specifications upon which this approval is based,other than those required
by the above conditions,will require submittal of an application for modification and approval of that
application prior to commencing any change.
4. Any change by the applicant in the planned use of the property which is the subject of this application,
shall require the applicant to comply with all rules,regulations,ordinances,plans,or other regulatory and
legal restrictions in force at the time the applicant or its successors in interest advises the City of Eagle of
its intent to change the planned use of the subject property unless a waiver/variance of said requirements
or other legal relief is granted pursuant to the law in effect at the time the change in use is sought.
5. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed
by the applicant or the applicant's authorized representative and an authorized representative of the City
of Eagle. The burden shall be upon the applicant to obtain written confirmation of any change from the
City of Eagle.
6. Approval of any Design Review shall expire without notice to the applicant on the date of expiration of
the Design Review,as stipulated in Eagle City Code(one year from the approval date).
7. Any modification of the approved design review plans must be approved prior to construction/installation
of such changes. Failure to do so may result in the requirement to modify the project to comply with the
approved design review and/or result in the inability to issue a certificate of completion for this project.
