Ordinance - 2002 - 433 - Dispensing Of Public Hearing For Design Review - 12/10/2002ORIGINAL ORDINANCE NO. 433 AN ORDINANCE FOR THE CITY OF EAGLE, IDAHO, AMENDING EAGLE CITY CODE, 111LE 8 "ZONING", CHAPTER 2 "ZONING DISTRICTS AND MAP", ARTICLE A " DR DESIGN REVIEW OVERLAY DISTRICT", SECTION 8 "SIGN REGULATIONS", CREATING A NEW SUBSECTION N, PROVIDING FOR PENALTIES FOR VIOLATIONS OF THE SIGN ORDINANCE; AND, AMENDING SECTION 13 (A) "PROCEDURE FOR APPROVAL" TO DISPENSE WITH THE REQUIREMENT THAT PUBLIC HEARINGS BE CONDUCTED FOR BOARD LEVEL DESIGN REVIEW APPLICATIONS PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Eagle, Idaho is a municipal corporation organized and operating under the laws of the State of Idaho; and WHEREAS, pursuant to Chapter 65, Title 67, Idaho Code, the City of Eagle has the authority to adopt, establish and amend a Zoning Ordinance; and WHEREAS, the Mayor and Council have determined that good cause exists for amending the Zoning Ordinance so as to preserve and enhance the beauty and livability of the City of Eagle; and NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF EAGLE, Ada County, Idaho; Section 1: That Title 8, Chapter 2A, Section 8, Subsection N of the Eagle City Code, be and is hereby added to read as follows: 8-2A-8 N. Violations and Penalties for non -complying signs: In addition to or in lieu of removal of non -complying signs by the City as permitted by Subsection I of this Section, the sheriff, deputy sheriff, or zoning officer sworn as a limited purpose deputy. may issue to the known owner of such sign a citation which shall be an infraction. Such citation shall impose upon the owner a fine of twenty-five dollars ($25.00) for the first violation, fifty dollars ($50.00) for the second violation, and one hundred dollars ($100.00) for the third and subsequent violations. Each day a sign continues in violation of this Section shall be deemed a separate offense. Section 2: That Title 8, Chapter 2, Article A, Section 13 (A), of the Eagle City Code, be and is hereby amended, in part, to read as follows: Design Review Board Action: At least thirty five (35) days prior to review by the design review board, anyone required to comply with this chapter shall submit their application, together with the required fee, to the zoning administrator. If modification is required or if the application is denied, the board shall prepare a statement of the reasons for its action. Section 3: EFFECTIVE DATE: This ordinance or summary thereof in compliance with Idaho Code § 50-901A, shall be published once in the official newspaper of the City, and shall take effect immediately upon its passage, approval and publication.
