ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY IDAHO, AMENDING EAGLE CITY
CODE TITLE 4 "PUBLIC HEALTH AND SAFETY", CHAPTER 5 "ANIMAL CONTROL", SECTION
2. "NUISANCE", AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, there has been an increasing challenge keeping municipal parks and other
municipally owned property free of animal waste; AND
WHEREAS, it is the City's desire to provide a clean and safe environment for both young and
old to enjoy; AND
NOW, THEREFORE be it ordained by the Mayor and City Council of the City of Eagle, Idaho,
that below noted sections of Eagle City Code Title 4, Chapter 5 shall be amended to read as
follows and the unmodified sections shall be adapted to reflect the appropriate consecutive
numbering:
4-5-2(D): Discharge feces upon public property or private property without the consent of the

receptacle; or
E. No person owning or having the care, custody, possession or control of a dog shall:
1. Fail to have in his/her possession the equipment necessary to remove his/her dog's fecal
matter when accompanied by said dog in any park or public pathway.
2. Fail to remove the fecal matter deposited by his/her dog in any park or public pathway
before the owner leaves the immediate area where the fecal matter was deposited.
F. No person owning or having the care, custody, possession, or control of a dog shall permit or
allow such dog to enter the playground/water feature areas at any Municipal Park at any time.
G. This ordinance shall not apply to:
1. Police officers and their service animals during the official performance of their duties;
2. Handlers of search and rescue animals during the official performance of their duties; or
3. Persons with disabilities utilizing assistance animals.
EH. Is repeatedly at large.
This ordinance shall take effect and be in force from and after its passage, approval, and
publication as required by law.
