COUNCIL MINUTES
September 10, 1985

The council met in regular session at the Eagle City Hall,
on Tuesday, 'September 10, 1985, at 7:30 p.m. MAYOR HALEY presiding.
Roll call showed the following members present: WALKER,
STOPPELLO, MAILE, GUERBER.
Moved by GUERBER and seconded by MAILE to approve the
minutes of the August 13, 1985 meeting as printed. Motion
resulted as follows: AYE: WALKER, STOPPELLO, GUERBER. Motion
carried.
Moved by STOPPELLO and seconded by WALKER to approve the
minutes of the special meeting of August 19, 1985 as printed.
Motion resulted as follows: AYE: WALKER, STOPPELLO, GUERBER.
Motion carried.
UNFINISHED BUSINESS: Codification. Will be postponed
until the next council meeting, October 8, 1985. Material
not yet completed.
STOPPELLO moved for unanimous consent for the park issue
to be put on the agenda for purpose of discussion. Seconded
by GUERBER. Motion resulted as follows: AYE:WALKER, STOPPELLO,
MAILE, GUERBER. Motion carried.
STOPPELLO suggested that MAYOR HALEY contact Block Brothers
to negotiate for $2,000.00. MAYOR HALEY agreed to contact them
and if they are willing to agree to $2,000.00 the city will take
the park.
Motion_seconded by GUERBE~. 9~].! ca/1 on the motion resulted
as follows: AYE~ WALKER, STOPPELLO, MAILE, GUERBER. Motion
carried.
Moved by Stoppello and seconded by GUERBER to authorize the
Mayor to negotiate a settlement or agreement whereby the City
would accept the park free and clear with $2,000.00, not including
age 48
any other land and if the Mayor is able to negotiate that
settlement, the City immediately repair the sprinkler system,
lay the new sod, clean up the trees and shrubs and clean up
the play ground. Motion amended to include the words settlement
in writing. Roll call on the motion resulted as follows: AYE:
W-~LKER, STOPPELLO, MAILE, GUERBER. Motion carried.
OATH: BARBARA MONTGOMERY appointed new City Clerk and
Finance Officer. MAYOR CAROL HALEY appointed new City Zoning
Administrator. Motion made to approve new appointments by
WALKER, seconded by STOPPELLO. Motion resulted as follows:
AYE: WALKER, STOPPELLO, MAILE, GUERBER. Motion carried.
DESIGN REVIEW: Circle K STOPPELLO made the motion that
the Circle K Design Review be denied based upon the fact that
it is in violation of B-2, which prohibits a pylon/sign that
exceeds 50 sq. ft. Motion seconded by WALKER. Roll call on
the motion resulted as follows: AYE: WALKER, STOPPELLO,
MAILE, GUERBER. Motion carried.
STOPPELLO suggested that they would be complying with a
20 sq. ft. reader board. Tentative agreement followed to hold
a Special Council Meeting thereby omitting Cirle K from the
need of the Design Review process again.. Motion made by WALKER,
seconded by STOPPELLO. Motion resulted as follows: AYE: WALKER,
STOPPELLO, MAILE, GUERBER. Motion carried.
RESOLUTION #2-85: No discussion,roll call on motion resulted
as follows: AYE: WALKER, STOPPELLO, MAILE, GUERBER. Motion
carried.
CONDITIONAL USE/VARIANCE: Submitted by Eagle First Methodist
Church. PUBLIC HEARING OPEN 8:20p.m.

Motion made by MAILE and seconded by WALKER to approve the
Conditional Use Permit on temporary placement of a mobile home
in the rear of the Eagle First Methodist Church providing an
eight foot unabstructed area remain adjacent to Mr. Brownlee's
property, and allow 12 x 56 mobile home. Roll call resulted as
follows: AYE: WALKER, STOPPELLO, MAILE, GUERBER. Motion carried.
MAILE asked for a review of this Conditional Use Permit in eleven
(11) months.

MAYOR CAROL HALEY reminded Council of up-coming Flag
Raising Event in Eagle, Wednesday September 11, 1985, 7:30p.m.
at Eagle City Hall.
BROADWAY GUIDELINES/STATE STREET DESIGN PLAN: Discussion
only MAILE and Bob Shade of Planning and Zoning will meet
regarding this at a later date.
CLAIMS AGAINST THE CITY: Motion made to acuept as presented
by GUERBER, seconded by MAILE. Roll call on the motion resulted
as follows: AYE: WALKER, MAILE, GUERBER. STOPPELLO excused
from the meeting earlier. Motion carried.
MAYOR CAROL HALEY adjourned the meeting at 9:10 p.m.
