CITY OF EAGLE
COUNCIL MINUTES
AUGUST 13, 1985
The council met in regular session at the Eagle City
Hall, on Tuesday, August 13, 1985, at 7:30 p.m. Mayor
HALEY presiding.
Roll call showed the following members present: WALKER,
STOPPELLO, GUERBER.
Moved by GUERBER and seconded by STOPPELLO to approve the
minutes of the July 9, 1985 meeting as printed. Motion resulted
as follows: AYE: WALKER, STOPPELLO, GUERBER. Motion carried.
Moved by STOPPELLO and seconded by WALKER to approve
the minutes of the meeting of July 23, 1985, as printed.
Motion resulted as follows: AYE: WALKER, STOPPELLO, GUERBER.
Motion carried.
Wayne Watson from United Cable Television was present to
appeal the decision the council had made at the last council
meeting. Moved by WALKER and seconded by GUERBER to approve
the new rates for United Cable as per request. Roll call on
the motion resulted as follows: AYE: WALKER, STOPPELLO,
GUERBER. Motion carried.
Ordinance No. 97 was presented to the council for their
consideration. Moved by WALKER and seconded by STOPPELLO that
the rule requiring ordinances to be read on three different days,
two readings of which are to be by title only and one of which
is to be in full, be dispensed with and that Ordinance #97 be
considered immediately. Roll call on the motion resulted as
follows: AYE: WALKER, STOPPELLO, GUERBER. Motion carried.
Moved by WALKER and seconded by STOPPELLO to adopt Ordinance
No. 97 "AN ORDINANCE OF THE CITY OF EAGLE, IDAHO, AMENDING
ORDINANCE NO. 55 AS AMENDED BY ORDINANCE NO. 83 BY PROVIDING THAT
~ ADDITION TO THE CRIMINAL PENALTIES ATTACHED TO VIOLATIONS OF
THE DESIGN REVIEW ORDINANCE, THE CITY COUNCIL MAY DIRECT THE
CITY ATTORNEY TO SEEK INJUNCTIVE RELIEF AGAINST VIOLATIONS OF
THE ORDINANCE". Roll call on the motion resulted as follows:
AYE: WALKER, STOPPELLO, GUERBER. Motion carried.
Moved by STOPPELLO and seconded by GUERBER that the rule
requiring ordinances to be read on three different days, two
readings of which are to be by title only and one of which is
to be in full, be dispensed with and that Ordinance #98 be
considered immediately. Roll call on the motion resulted as
follows: AYE: WALKER, STOPPELLO, GUERBER. Motion carried.
Moved by STOPPELLO and seconded by WALKER to adopt Ordin-
ance #98 "AN ORDINANCE OF THE CITY OF EAGLE, IDAHO, AMENDING
ARTICLE XII SECTION B OF ORDINANCE NO. 40 BY PROVIDING THAT PLANNED
UNIT DEVELOPMENTS SHALL ALSO BE SUBJECT TO THE PROVISIONS OF
ORDINANCE NO. 55 AS AMENDED (DESIGN REVIEW ORDINANCE), ORDINANCE

No.82 (FLOOD PLAIN ORDINANCE) AND ORDINANCE NO. 88 (SUBDIVISION
ORDINANCE). Roll call on the motion resulted as follows: AYE:
WALKER, STOPPELLO, GUERBER. Motion carried.
Moved by GUERBER and seconded by WALKER that %he rule

considered immediately. Roll call on the motion resulted as
follows: AYE: WALKER, STOPPELLO, GUERBER. Motion carried.
Moved by GUERBER and seconded by WALKER to adopt Ordinance
No. 99 "AN ORDINANCE OF THE CITY OF EAGLE, IDAHO, AMENDING
CHAPTER 6, SECTION 9 OF ORDINANCE NO. 88 BY CLARIFYING THE
EXISTING REQUIREMENT THAT PLANNED UNIT AND CONDOMINIUM DEVELOP-
MENTS SHALL ALSO BE SUBJECT TO THE PROVISIONS OF ORDINANCE
NO. 40 (ZONING ORDINANCE), ORDINANCE NO. 82 ( FLOOD PLAIN
ORDINANCE) AND ORDINANCE NO. 55 AS AMENDED (DESIGN REVIEW
ORDINANCE)" Roll call on the motion resulted as follows:
AYE: WALKER, STOPPELLO, GUERBER. Motion carried.
Tom Wright addressed the council concerning the Middle-
brook subdivision and asked the council if they would like
to annex the property prior to subdividing. No action was
taken.
The Council appointment to the Community Building Associa-
tion was discussed. Moved by STOPPELLO and seconded by WALKER
to appoint TOM MAILE to the position. Motion resulted as
follows: AYE: WALKER, STOPPELLO, GUERBER. Motion carried.
Ron Marshall appeared before the council on behalf of
Nancy Mason who would like to split a single lot of record in
the M-1 Zone. He was told to proceed with the subdivision
application.
The Mayor asked the councils approval of the appoint-
ment to the Design Review Committee for a three year term of
Marshall Carpenter and LeRue Bevington. Moved by GUERBER and
seconded by STOPPELLO to approve the appointment. Motion re-
sulted as follows: AYE: WALKER, STOPPELLO, GUERBER. Motion
carried.
Ordinance #100 was presented to the Council. Moved by
STOPPELLO and seconded by GUERBER that the rule requiring or-
dinances to be read on three different days, two readings of
which are to be by title only and one of which is to be in
full, be dispensed with and that Ordinance No. 100 be con-
sidered immediately. Roll call on the motion resulted as
follows: AYE: WALKER, STOPPELLO, GUERBER. Motion carried.
Moved by STOPPELLO and seconded by WALKER that the council
adopt Ordinance #100 "~ ORDINANCE REPEALING ORDINANCE NO. 36,
AND ESTABLISHING THE SALARIES OF ELECTED OFFICIALS, AND PROVIDING
AN EFFECTIVE DATE". Roll call on the motion resulted as follows:
AYE: WALKER, STOPPELLO, GUERBER. Motion carried.
Mayor HALEY announced that this was the time and the place

as advertised for a public hearing on the budget for the City
of Eagle for Fiscal year 1985/86. Public testimony was re-
ceived from the following:
Susan D.
McColl, 249 Riverview, Eagle - Testified on behalf of
the Library budget and asked for a total sum
of $40,518.00.
Beverly Hancock, 1237 Cerrmar Ct., Eagle - Testified on behalf
of the Eagle Public Library.
Mayor HALEY closed the public testimony portion of the hearing
at 9:30 p.m.. Moved by GUERBER and seconded by WALKER to approve
the amount of $40,518.00 for the library portion of the City
budget for fiscal year 1985/86. Roll call on the motion resulted
as follows: AYE: WALKER, STOPPELLO, GUERBER. Motion carried.
The total figures for the budget were set and are part of the
minutes on pages 44 and 45. The Mayor set Monday, August 19, 1985,
as the date for a special meeting to adopt the appropriations
ordinance for the budget.
The claims against the City were reviewed and it was moved
by STOPPELLO and seconded by WALKER to pay the claims against
the City. Roll call on the motion resulted as follows: AYE:
WALKER, STOPPELLO, GUERBER. Motion carried.
Mayor HALEY closed the meeting at 9:55 P.M.
