CITY OF EAGLE
COUNCIL MINUTES
JULY 9, 1985
The council met in regular session at the Eagle City
Hall, on Tuesday, July 9, 1985, at 7:30 P.M. Mayor HALEY
presiding.
Roll call showed the following members present:
WALKER, STOPPELLO, MAILE, GUERBER.
Moved by MAILE and seconded by WALKER to approve the
minutes of the April 30, 1985 meeting as printed. Motion
resulted as follows: AYE: WALKER, STOPPELLO, MAILE,
GUERBER. Motion carried.
Moved by WALKER and seconded by GUERBER to approve
the minutes of the meeting of May 14, 1985, as printed.
Motion resulted as follows: AYE: WALKER, STOPPELLO,
MAILE, GUERBER. Motion carried.
Mayor HALEY presented a Certificate of Appreciation
to Boy Scout Troop ~77 for their participation in the Eagle
Spring Clean-up Campaign.
Marjorie Allred, representing the Ada County Free
Library, presented a draft of a contract for an open access
agreement between the Ada County Free Library and the Eagle
Public Library. Moved by STOPPELLO and seconded b~ WALKER
to approve the contract subject to the Eagle Library Board's
approval and/or further review by the Council if there are
any material changes to Draft #4. Roll call on the motion
resulted as follows: AYE: WALKER, STOPPELLO, GUERBER,
MAILE. Motion carried.
Design Review #8-85 for a change in the sign at Summers
Funeral Home was reviewed by the council and it was moved by
WALKER and seconded by GUERBER to approve the sign change as
recommended by the Design Review board. Motion resulted as
follows: AYE: WALKER, STOPPELLO, MAILE, GUERBER. Motion
carried.
Design Review #9-85 for the remodel of the Fire Station
was reviewed by the council and it was moved by STOPPELLO
and seconded by WALKER to approve the Design Review ~9-85.
Motion resulted as follows: AYE: WALKER, STOPPELLO, GUERBER,
MAILE. Motion carried.
Resolution #2-85 "A Resolution authorizing a representa-
tive from the City to acquire federal surplus property from
the Idaho State Bureau of Surplus Property" was reviewed by
the council. Moved by MAILE and seconded by GUERBER to ap-
prove the resolution. Roll call on the motion resulted as
follows: AYE: WALKER, STOPPELLO, MAILE, GUERBER. Motion
carried.

Ordinance #95 was presented by the Mayor. Moved by
WALKER and seconded by STOPPELLO that in accordance with
the provisions of ~50-902, Idaho Code, the rule requiring
ordinances to be read on three different days, two readings
of which are to be by title only and one of which is to be
in full, be despensed with and that Ordinance No. 95 be
considered immediately. Roll call on the motion resulted
as follows: AYE: WALKER, STOPPELLO, GUERBER, MAILE.
Motion carried. Moved by WALKER and seconded by STOPPELLO
to adopt Ordinance #95, "AN ORDINANCE OF THE CITY OF EAGLE,
IDAHO, AMENDING SECTION 2, OF ORDINANCE NO. 78 TO ADOPT
THE 1985 UNIFORM BUILDING CODE". Roll call on the motion
resulted as follows: AYE: WALKER, STOPPELLO, MAILE,
GUERBER. Motion carried.
Ordinance #96 was presented by the Mayor. Moved by
GUERBER and seconded by WALKER that in accordance with
the provisions of #50-902, Idaho Code, the rule requiring
ordinances to be read on three different days, two read-
ings of which are to be by title only and one of which is
to be in full, be despensed with and that Ordinance No.96
be considered immediately. Roll call on the motion resulted
as follows: AYE: WALKER, STOPPELLO, GUERBER, MAILE.
Motion carried. Moved by GUERBER and seconded by STOPPELLO
to adopt Ordinance #96, "AN ORDINANCE OF THE CITY OF EAGLE,
IDAHO, AMENDING SECTION 2, OF ORDINANCE NO. 79, ADOPTING
THE 1985 UNIFORM FIRE CODE". Roll call on the motion
resulted as follows: AYE: WALKER, STOPPELLO, GUERBER,
MAILE. Motion carried.
At 8:10 P.M. Mayor HALEY announced that this was the
time and the place as advertised for a public hearing to
consider an ordinance amending Ordinance No. 55. There was
no public testimony and Mayor HALEY closed the public testi-
mony portion of the hearing at 8:12 P.M. Moved by STOPPELLO
and seconded by WALKER to amend proposed Ordinance #97 by
having the City attorney add the language that he wants in
order to allow the City to receive attorney fee's for pro-
cessing and possibly to add a penalty clause of $10.00 per
day or any amount he deems fit, for a violation of the
Ordinance, and to table a decision on the ordinance until
the next meeting and after the Planning and Zoning Comm-
ission has had a chance to consider the ordinance. Motion
resulted as follows: AYE: WALKER, STOPPELLO, GUERBER,
MAILE. Motion carried.
Mayor HALEY declared the public hearing open at 8:25 P.M.
for the consideration of an ordinance amending Article XII,
Section B of Ordinance No. 40 by providing the Planned Unit
Developments shall also be subject to the provisions of
Ordinance No. 55 and Ordinance No. 88. There was no public
testimony and Mayor HALEY closed the public testimony portion
of the hearing at 8:27 P.M. Moved by STOPPELLO and seconded
by GUERBER that the ordinance be tabled for consideration at
the regular council meeting after the Planning and Zoning
Commission has had a chance to act on the proposed ordinance
and further, that the City attorney be directed to check in-
to the procedures for handling a C.U.P., P.U.D., Subdivision,
Flood Plain Permit, and Design Review at the same time.

Motion resulted as follows: AYE: WALKER, STOPPELLO, MAILE,
GUERBER. Motion carried.
Mayor HALEY declared the public hearing open at 8:30 P.M.
for the consideration of an Ordinance amending Chapter 6,
Section 9 of Ordinance No. 88 by clarifying the existing
requirement that Planned Unit and Condominium Developments
shall also be subject to the provisions of Ordinance No. 40,
Ordinance No. 82, and Ordinance No. 55 as amended. There was
no public testimony and the Mayor closed the public testimony
portion of the public hearing at 8:31 P.M.. Moved by STOPPELLO
and seconded by MAILE to table this ordinance until the next
regularly scheduled council meeting and after the Planning
and Zoning Commission has had a chance to act upon it.
Motion resulted as follows: AYE: WALKER, STOPPELLO, MAILE,
GUERBER. Motion carried.
The proposed new rates for United Cable Television
were presented. Moved by MAILE and seconded by STOPPELLO to
disapprove the rate increase. Roll call on the motion re-
sulted as follows: AYE: WALKER, STOPPELLO, MAILE. ABSTAIN:
GUERBER. Motion carried.
Roland Jones spoke to the council concerning the final
plat for Riverstone Townhouses. The clerk was instructed to
photo copy the minutes in the file concerning the C.U.P./P.U.D.
and send them out to the council.
A discussion about Eagle's participation in A.P.A. was
held and it was bought up that there would be a meet-
ing at Ada Planning Association on Thursday, July 18, 1985
at 8:00 A.M.. The clerk was instructed to mail a copy to
each of the Council of the Ada County Commissioner's proposal
concerning the voting membership to A.P.A..
There was some discussion about the City of Eagle pass-
ing an ordinance concerning Day Care Licensing. The City
attorney was instructed to check into what the City could
do to require Day Care Centers within the City to be licensed.
A council budget workshop was scheduled for Tuesday,
July 23, 1985, at the City Hall at 7:30 P.M.
The City Clerk was instructed to draw up an amendment
to Ordinance #36 concerning the salaries of the Elected Of-
ficials and increase the Council salary to $1,800.00 a year,
and the Mayor's salary to $6,000.00 a year.
The claims against the City were reviewed and it was
moved by STOPPELLO and seconded by WALKER to pay the claims
against the City. Roll call on the motion resulted as follows:
AYE: WALKER, STOPPELLO, MAILE, GUERBER. Motion carried.
