ROLL CALL: Present: WRIGHT, MCCAULEY, MCLAUGHLIN. Absent: GUERBER, SMITH. A quorum is present. CONSENT AGENDA: ALL CONSENT AGENDA ITEMS ARE CONSIDERED ACTION ITEMS. ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. Findinjjs of Fact & Conclusions of Law for the Approval of RZ-07-21 & PP-09-21 — Rezone from R-4 to R-6-DA and Preliminary Plat for Kodv Corner Subdivision — MJV Properties LLC: MJV Properties, LLC — Rowe Sanderson, represented by Ben Semple with Rodney Evans & Partners, LLC, is requesting a rezone from R-4 (Residential) to R-6-DA (Residential with a development agreement) and preliminary plat approval for Kody Corner Subdivision, a 21-lot (19-buildable, 2-common) residential subdivision. The 3.5-acre site is located on the west side of North Parkinson Street at 525 North Parkinson Street and 543 North Parkinson Street. (MJW) C. Findings of Fact & Conclusions of Law for the Approval of A-10-21/RZ-15-21 & PP-15-21— Annexation and Rezone from RUT To R-E-DA and Preliminary Plat For Amberly Ranch Subdivision — Gerard Investments LLC: Gerard Investments LLC, represented by Jadon Schneider of Bronze Bow Land, is requesting an annexation and rezone of three (3) existing parcels (totaling 11.81 acres) from RUT (Rural -Urban Transition — Ada County designation) to R-E-DA (Residential -Estates with a development agreement) and preliminary plat approvals on one of the three parcels for Amberly Ranch Subdivision, a 4-lot (3-buildable, 1-common) residential subdivision (totaling 7 acres). The site is located on the southwest corner of West Beacon Light Road and N. Ballantyne Lane. (MNB) McLaughlin moves to approve the consent agenda as presented. Seconded by McCauley. ALL AYES... MOTION CARRIES. 4. UNFINISHED BUSINESS: NONE. PUBLIC HEARINGS: ALL PUBLIC HEARING ITEMS ARE CONSIDERED ACTION ITEMS. A. ACTIONITEM.- PP-02-21/FP-02-21 & CU-08-21— Combined Preliminary/Final Plat & Conditional Use Permit for Shepherding Acres Subdivision — Braiden Shaw: Braiden Shaw, represented by Aaron Rush with LR-GEO, is requesting a combined preliminary and final plat approval for Shepherding Acres Subdivision, a 4-lot residential subdivision, as well as a Conditional Use Permit to waive the code section requiring paved sidewalk along West Washam Road and to address the existing nonconforming structure on the property. The 7.2-acre site is located on the south side of West Washam Road at 1791 and 1835 West Washam Road. (MNB) Braiden Shaw and Tyler Horn, 346 Mission Drive, applicants. Braiden Shaw and Tyler Horn, the applicants, address concerns raised during the Public Hearing and provides rebuttal. Chairman Wright closes the Public Hearing. General discussion amongst the Commission. McCauley moves to approve PP-02-21/FP-02-21 & CU-08-21— Combined Preliminary/Final Plat & Conditional Use Permit for Shepherding Acres Subdivision with the addition of site specific requirements as follows: All overhead all power facilities shall be placed underground and shall be applied to the plat prior to the City Clerk signing the final plat, the removal of the word "both" as it pertains to conduit being laid on both sides of the street on site -specific condition #8. Seconded by McLaughlin. ALL AYES ... MOTION CARRIES. 6. NEW BUSINESS: NONE. 7. REPORTS: A. Commission: McLaughlin states that Commissioner Guerber will be representing the P&Z Commission. B. I just wanted to follow up in regards to the meeting that you held in which you voted on whether the house on 1835 W. Washam in Eagle would be added to the Eagle Historic Registry. Alan Hochstrasser and I appreciate the time given to this discussion. I heard the conversation that John and Alan had was very interesting during the site visit. No worries if it was not inducted into the registry, Alan and I are just curious as we have never heard a final synopsis. Thanks for your time and have a great New Years weekend. be safe! The commission did discuss this property and reviewed the pictures I took and those Alan provided to me. The home itself has been modified over the years and now in and of itself does not really merit adding to the Eagle registry. My recommendation to the full board was that we not include this property on Eagles historic registry and the board concurred. The home and family certainly are a part of Eagles history and an interesting piece of its history. I am not sure if you remember our conversation but I was acting under the request of Councilmen Pitman for a project that I am working on with the city. Would you give me permission to add your email to that application so councilmen pitman can review it? I figured it wouldn't be added to the registry after the conversation I had with Alana, but Councilmen Pitman was very adimate that I ask the Historic society to review it.
