CALL TO ORDER: The meeting was called to order at 5:35 P.M. 2. ROLL CALL: BLAINE, CROCKETT,DECKERS,ELWER,HUFFAKER,MINCH,STIRRAT LIAISON: COUNCIL MEMBER BAUN Absent: Deckers and Stirrat 3. APPROVAL OF MINUTES: A. Minutes of January 13, 2022 Commissioner Blaine moved to approve the minutes of January 13, 2022, as written. Seconded by Commissioner Elwer. ALL AYES... MOTION CARRIES. 4. Election of Chairman and Vice-Chairman: Commissioner Blaine makes a motion to retain current hierarchy. Seconded by Commissioner Crockett. ALL AYES... MOTION CARRIES. 5. PUBLIC COMMENT: None 6. MAYOR/COUNCIL REPORT: Council Member Baun discussed the shooting range. A user group will be meeting on March 23`d with an open house to the public on March 9"'. 7. PARKS AND RECREATION REPORT: Brian Allen introduced himself as the new Recreation Director. Recently hired a new Recreation Coordinator for Camps and Classes named Tyler. Saturday is the Daddy Daughter Dance which is full. Basketball season is almost complete and currently preparing for soccer. Saturday Market planning meetings have started along with Eagle Fun Days. Steve Noyes requested a change to the agenda to correct the numbers on the agenda,to move the Trail Superintendent Report to after New Business and reschedule Millstone Farm Subdivision. Commissioner Crockett makes a motion to amend the numbers on the agenda, move the Trail Superintendent Report to after New Business,and reschedule Millstone Farm Subdivision to the March PPRC meeting. Seconded by Commissioner Elwer.ALL AYES...MOTION CARRIES. 8. PUBLIC WORKS REPORT: Eric Ziegenfuss stated that Pamela Baker Park bids have not come back yet. Discussing the new storage facility at Guerber Park. Concrete bids are coming in for the volleyball border. Guerber Park playground equipment is getting new parts due to its use. City Hall expansion is still on track with offices scheduled to be complete by April 1st. The community hall should be complete by May 1st so Parks and Recreation can start scheduling classes. Recently hired a new custodian and trails staff. Currently looking for 9 seasonal staff members. Looking into a Park Ambassador program due to increased vandalism. 9. UNFINISHED BUSINESS: Brook Cole agrees with the recommendations as they are laid out today regarding Spring Valley Pump#1. Steve Noyes discussed Spring Valley Pump#1. Commissioner Blaine makes a motion to approve staffs recommendation for the development as what was presented in 10A. Seconded by Commissioner Crockett.ALL AYES...MOTION CARRIES. Council Member Baun left the meeting at 6:45pm. 10. NEW BUSINESS: Discussion of Farmstead Landing Subdivision. Commissioner Blaine makes a motion to move to accept the staff recommendation unamended for what was presented on 11A. Seconded by Crockett.ALL AYES...MOTION CARRIES. 11. TRAIL SUPERINTENDENT REPORT: Steve Noyes presented on the Concrete Jungle Trail at the Bike Park. Eagle Island State Park connection is still on hold. Discussion of FEMA repairs. There are 9 potential areas where funding can be used. 12. PPRC LIAISON ASSIGNMENT REPORT: None 13. It is a 167-lot(140-buildable, 27-common)residential subdivision. PATHWAYS: a. The following list also refers to callouts in FIGURE 1: • A,B and C=The developer shall provide 8-foot-wide concrete pathways built to the City Standard for Community Pathways in the alignments shown in FIGURE 1. • D and E=The developer shall provide 6-foot-wide concrete pathways built to the City Standard for Neighborhood Pathways in the YELLOW areas shown in FIGURE 1. • F=The developer shall provide dog bag dispensers/waste receptacles in these general locations. • G=The developer shall provide public access detached sidewalks, on both sides of N.Weldon Ave., and the north side of Floating Feather Road, in widths matching those of existing and adjacent development on Floating Feather Road. b. Curb ramps where pathways meet roadways shall be provided where they are permitted by ACHD. C. PUBLIC ACCESS EASEMENTS: a. The following list refers to callouts in FIGURE 1: • A,B and C=The developer shall provide public access easement(s)25-feet in width in favor of the City of Eagle,with a minimum 4-foot margin on each side of pathway tread within any part of the easement where possible. (alignments shown in GREEN). b. Public access easements and a survey depicting the location of this pathway within the easement must be submitted to the City,prior to the City Clerk signing of the final plat. 3. CONSTRUCTION TIMING: a. The pathway shall be constructed, and a survey depicting the location of this pathway within the easement must be submitted to the City,prior to the City Clerk signing of the final plat for each phase. 4. MAINTENANCE: a. the developer and future homeowners association shall provide maintenance of all pathways in FIGURE 1 in perpetuity. 5. LIABILITY(Information only): Idaho Code 36-1604 provides limitation of liability of landowners. The purpose of this code is to encourage owners of land to make land, airstrips, and water areas available to the public without charge for recreational purposes by limiting the owner's liability toward persons entering the owner's land for recreational purposes. Some of the benefits of this law are: • Owner is Exempt from Warning. An owner of land owes no duty of care to keep the land safe for entry by others for recreational purposes, or to give any warning of a dangerous condition,use, structure, or activity on such land to persons entering for such purposes. • Owner Assumes No Liability. An owner of land or equipment who either directly or indirectly invites or permits without charge any person to use such property for recreational purposes. • User is Liable for Damages. Any person using the land of another for recreational purposes,with or without permission, shall be liable for any damage to land,property. • As the Grantee of a public access easement,the City of Eagle is also protected. In this Code"landowner"is defined as a possessor of a fee interest,right-of-way, or easement, a tenant, lessee, licensee, occupant, operator,permit holder,or person in control of, or with a right or duty to maintain,the land.
