CITY OF EAGLE
COUNCIL MINUTES
MARCH 12, 1985
The Council met in regular session on March 12, 1985, at
the Eagle Primary School Multi-purpose room at 7:30 P.M.
Roll call showed the following members present: WALKER,
MAILE, STOPPELLO, GUERBER. Mayor HALEY presiding.
Moved by WALKER and seconded by GUERBER to approve the min-
utes of the February 12, 1985 council meeting as printed Motion
resulted as follows: AYE: STOPPELLO, WALKER, MAILE, GUERBER.
Motion carried.
Moved by GUERBER and seconded by STOPPELLO to approve the
minutes of the special council meeting of March 5, 1985 as
printed. Motion resulted as follows: AYE: WALKER, STOPPELLO,
MAILE, GUERBER. Motion carried.
Ron Marshall presented Design Review #2-85 (Continued), for
the Bank Club's additional sign. Moved by STOPPELLO and seconded
by WALKER, to approve the readerboard sign as presented by
Mr. Marshall and explained by the owner. Motion resulted as
follows: AYE: WALKER, STOPPELLO, MAILE, GUERBER. Motion
carried.
Ordinance #94 was presented to the Council. Moved by
GUERBER and seconded by MAILE that in accordance with the pro-
visions of 950-902, Idaho Code, that the rule requiring ordin-
ances to be read on three different days, two readings of which
are to be by title only and one of whic.h is to be in full, be
dispensed with and that Ordinance No. 94 be considered immediat-
ely. Roll call on the motion resulted as follows: AYE: WALKER,
STOPPELLO, MAILE, GUERBER. Motion carried. Moved by WALKER,
and seconded by GUERBER to adopt Ordinance #94 "AN ORDINANCE
ESTABLISHING A SCHEDULE OF FEES FOR CERTAIN REQUESTED LAND USE
PLANNING ACTIONS WITHIN THE CITY LIMITS AND AREA OF IMPACT OF
THE CITY OF EAGLE", be adopted. Roll call on the motion re-
sulted as follows: AYE: WALKER, STOPPELLO, MAILE, GUERBER.
Motion carried.
Councilman STOPPELLO presented a clean draft of the pro-
posed Comprehensive Plan and a map to the council. Moved by
STOPPELLO and seconded by WALKER that the Eagle City Council
March 12, 1985 Comprehensive Plan Draft together with the pro-
posed map, with the exception that the small area of blue be
turned into orange (Mixed Use) go to public hearing on April
16, 1985. Roll call on the motion resulted as follows: AYE:
WALKER, STOPPELLO, MAILE, GUERBER. Motion carried. Motion
was amended later in the meeting.

The DeShazo Planned Unit Development was discussed. Moved by
MAILE and seconded by GUERBER to allow the developer to file with
the administrator a final plat for further action that she feels
needs to be taken. Motion withdrawn by MAILE and second withdrawn
by GUERBER. Moved by WALKER and seconded by MAILE that the City
require the developer to submit all materials and follow the sub-
division ordinance for a preliminary plat approval with the except-
ion that we wave the requirement for a public hearing for the sake
of time and that upon certification of the material for the pre-
liminary plat that will require approval of the city council that
has been complied with and we proceed from there to~-iTra-1-/~l~tcouncil
/~u~rl~--i~i~ as it has been presented as completed and complied
with. Roll call on the motion resulted as follows: AYE: MAILE,
WALKER, GUERBER. ABSTAIN: STOPPELLO. Motion carried.

Mayor HALEY announced that this was the time and the place as
advertised for a public hearing on the preliminary plat for the
Eagle Rim Subdivision and opened the hearing for public testimony.
The following people testified:
Earl Cohick- 1165 Pebble Beach, Eagle - concerned about water
John Jones - 1246 Cerramar Ct, Eagle - concerned about water
Pat Towne - 200 N. Edgewood, Eagle - asked about protective covenents.
Don Fodrea - 443 Winged Foot P1, Eagle - concerned about the density.
Lloyd Gilkey - 8524 Wichita Dr, Boise - concerned about the density.
Dave Beggrow - 605 N. Edgewood Lane, Eagle - questioned the density.
Wallace Smith - 409 Winged Foot P1, Eagle - concerned with density.
Leon Brunner - 1449 Medinah Ct, Eagle - Concerned about water.
Armond Baril - 580 Winged Foot P1, Eagle - concerned about additional
children on the golf course and cutting through his
property.
Jim Bostwick - 1293 Cerramar Ct, Eagle - concurred with previous
testimony.
Jim Barga - 960 Eagle Hills Way, Eagle - concerned about water and
the cost of the homes in the new subdivision.
Patty Blaine - 704 Spyglass Way, Eagle - concerned about the impact on
the schools.
Molly Hess - 1104 O'Farrell, Boise, representative from the P.U.C.
commission, she said the commission would be holding
a public hearing on the water problem.
Willard Clark - 1337 Cerramar Ct, Eagle - Concerned with density
Bill Oestrich - 1700 E. Hill Rd, Eagle - concerned with density, and
standard of homes to be built in the new subdivision.
Molly Minow - 812 Eagle Hills Way, Eagle - concerned with the impact
on the school system.
Betty Barns - 307 Winged Foot P1, Eagle - Concerned about density.
Mayor HALEY closed the public testimony portion of the public hearing
at 9:25 p.m. and put the question to the council. During the quest-
ion and answer portion of the meetinc between the council and the
applicant the applicant submitted ~amended plat with 38 lots in-
stead of 41 lots on it. Moved by STOPPELLO and seconded by GUERBER
to approve the preliminary plat that utilizes the thrity-eight units
subject to the restrictions of the entrances and exits to lots 1, 2,3
and 38and that those matters will be placed on the maps, that he
be given the two variances requested in his application subject to
the change for the turn around of fifty foot leng'th and subject to
his complying to the requ~enents set forth by the Ada County High-
way District.

Motion amended by GUERBER and seconded by STOPPELLO to include in
the motion that the applicants make a formal request to Eagle Ranch
Water Company for water and that an engineering study be made to
determine the water supply needed to provide adequate water for the
subdivision under the Public Utilitie Commissions guidelines.
Roll call on the motion resulted as follows: AYE: WALKER,
STOPPELLO, MAILE, GUERBER. Motion carried.
Ada County Transmittal #85-4-CU-Stanton for temporary living
quarters for a relative, was presented to the council. Motion by
STOPPELLO and seconded by MAILE that the application does not
violate the Eagle Comprehensive Plan, but the council request that
Ada County continue to monitor the situation to make sure it is
temporary. Motion resulted as follows: AYE: WALKER, STOPPELLO,
MAILE, GUERBER. Motion carried.
The claims against the City were presented and it was moved
by STOPPELLO and seconded by WALKER to approve the claims against
the City. Roll call on the motion resulted as follows: AYE: WALKER,
STOPPELLO, MAILE, GUERBER. Motion carried.
Moved by STOPPELLO and seconded by WALKER that the previous
motion concerning the proposed comprehensive map be amended that
the map is correct and that we do not change the little area of
blue (Industrial) to Mixed Use. Roll call on the motion resulted
as follows: AYE: WALKER, STOPPELLO, MAILE, GUERBER. Motion
carried.
Mayor HALEY adjourned the meeting at 10:05 P.M.
