RE: Redwood Creek Subdivision Pathway
Dear Mayor:
This letter constitutes the requested proposal to the Pathways Committee and the City
Counsel in accordance with the recent meetings and decisions made by the Counsel with respect
to a public pathway through the Redwood Creek subdivision, and the determination that the
pathway, if any, would be located adjacent to public streets, rather than though the backyards of
several lots along the Chevron pipeline easement.
Redwood Creek Development, Inc. proposed to build a berm over the pipeline to raise the
depth of the pipeline to a minimum of 4 feet (current depth determined by measurements provided
by Chevron) along the pipeline as it passes along the back of the lots within the center of the
subdivision, and through portions of the park. The owners of each of the effected lots have
purchased their property subject to the 1949 Pipeline Easement, and understand that they cannot
place buildings within the boundaries of the easement. The recorded rear yard setback also
prohibits any building within 25' of the rear property line which would ensure that no buildings
would be within the pipeline easement.
Redwood Creek Development, Inc., further proposed that, in the event that the city ever
formally designates a pathway through the Redwood Creek subdivision to join other public
pathways, that these pathways be located along the public roadway as it entets the subdivision
near the South East comer on Conifer Drive, then travel North and West around the loop on
Timber Drive then West on W. Timber Court thereby exiting the subdivision at the westerly end
ofW. Timber Court. This would allow the pathway, if ever used, to remain within the 6' wide
asphalt walkinglbiking path that already exists within the public right of way. We have discussed
this proposal with the officers of the Redwood Creek Homeowners Association and have received
their approval.
Furthermore, Redwood Creek Development, Inc. agrees to contribute $7,500 to the City
of Eagle pathway fund for the enhancement of pathways within the Cities jurisdiction. This
agreed resolution for pathway location through the Redwood Creek Subdivision contribution
fulfills all of obligations toward pathways, greenbelts and easements by the Redwood Creek
Development, Inc.
Please let me know if there is anything further that we can do to assist the city in finalizing
this agreement regarding the location of the public pathways in and through the Redwood Creek
subdivision. If you should have any questions concerning this issue, please call either Joe Harris at
345-1330 or myself at 322-1476.
Very truly yours,
~tf~
