Minutes - 2022 - City Council - 02/17/2022 - Special EAGLE CITY COUNCIL MEETING MINUTES February 17,2022 *Action Items Identified 1. CALL TO ORDER: Meeting begins at 3:00 p.m. 2. ROLL CALL: GINDLESPERGER,PIKE,BAUN,RUSSELL. Present: Gindlesperger, Pike, and Russell. Absent: Baun A quorum is present. 3. PLEDGE OF ALLEGIANCE: 4. PUBLIC COMMENT 1: The Eagle City Council is taking both in-person and remote public comment via WebEx. Meeting login instructions are posted on https://www.cityofeagle.org/1698/Virtual-Meetings. If you just want to watch the meeting, without giving comment,please watch our livestream at https://www.cityofeagle.org/305/City- Agendas-Videos. This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times,the City Council may seek comments/opinions regarding specific City matters during this allotted time. This is not the time slot to give formal testimony on a public hearing matter, land use application,or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. Baun present at 3:02 p.m. The Mayor opens public comment. Judy Dahl, 735 North Eachohawk, Eagle, Idaho. Dahl has concerns about the Comprehensive Plan. There has been harm done since the new plan has been initiated. The City needs to keep a rural density throughout Eagle. 5. UNFINISHED BUSINESS: A. ACTION ITEM: Findings of Fact and Conclusions of Law for the Approval of A-05- 21/RZ-06-21 & PP-08-21—Annexation and Rezone from RUT to R-9-DA and Preliminary Plat for Skyview Subdivision—Lennar Homes of Idaho: Lennar Homes of Idaho, represented by Dave Yorgason, is requesting an annexation, rezone from RUT (Rural-Urban Transition—Ada County designation)to R-9-DA (Residential with a development agreement [in lieu of a PUD])and MU-DA (Mixed Use with a development agreement [in lieu of a PUD]), and preliminary plat approvals for Skyview Subdivision, a 146-lot(125-single family, 1-commercial, 15-common, and 5-private street) subdivision. The 18.94-acre site is located at the northwest corner of State Highway 44 and North Park Lane at 101 North Park Lane. (MJW)This item was continued from the February 8, 2022 meeting. The written condition is not correct based on Council deliberation at the previous meeting. Vaughan suggests correcting the condition and bringing it back to Council at the end of the meeting. Pike moves item 5A to New Business at the end of the agenda. Seconded by Baun. ALL AYE...MOTION CARRIES. 6. NEW BUSINESS: A. Presentation by Republic Services: Representatives from Republic Services will provide an overview on current contracted services, rate history and special programs within the Eagle community. Mayor introduces the item. Rachele Klein, 2130 W. Franklin Road, Meridian, Idaho. Ms. Klein provides an overview on the current contracted services. General discussion amongst Klein and the Council. B. Valley Regional Transit Workshop—Discussion of transit service planning within the City of Eagle. Mayor introduces the item. Stephen Hunt, Development Director of Valley Regional Transit, provides an overview of the long-range transit vision, Route 9 Extension, and On-Demand Exploration. General discussion amongst Mr. Hunt and City Council. C. ACTION ITEM: Ordinance 872— 12700 North Horseshoe Bend Road: An ordinance changing the zoning classification of certain real property described herein from A-R (Agricultural-Residential—Ada County designation)to MU-DA (Multi-use with a development agreement); amending the zoning map of the City of Eagle to reflect said change; directing that copies of this ordinance be filed as provided by law; and providing an effective date. The 1.09-acre site is located on the south side of East Beacon Light Road approximately 55-feet east of the intersection of East Beacon Light Road and North Horseshoe Bend Road at 12700 North Horseshoe Bend Road. (BV) Mayor introduces the item. Bauns moves, pursuant to Idaho Code, Section 50-902,that the rule requiring Ordinances to be read on three different days with one reading to be in full be dispensed with,and that Ordinance#872 be considered after being read once by title only. Seconded by Russell. ALL AYE...MOTION CARRIES. Baun moves that Ordinance#872 be adopted.
