Minutes - 2022 - City Council - 02/08/2022 - Regular EAGLE CITY COUNCIL MEETING MINUTES February 8,2022 1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:31 p.m. 2. ROLL CALL: Present: GINDLESPERGER, PIKE, BAUN, RUSSELL. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: 4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA: A. SUEZ Water: Representatives from SUEZ will address Council regarding their recent acquisition of Eagle Water Company and the transition associated with the same. Marshall Thompson, General Manager Suez Water reviews the history of Suez Water, its service area and the road to the acquisition of Eagle Water Company. Cathy Cooper, Director of Engineering discusses booster pumps and the upgrades to the system to address pressure issues within the system. PowerPoint attached B. Valley Regional Transit Presentation: Stephen Hunt, Director of Valley Regional Transit. Mr. Hunt provides an update on quarterly ridership and ridership throughout the system. PowerPoint attached 6. REPORTS: A. Mayor and Council Reports: Pike reports on the Eagle Downtown Advisory Group and the Eagle Senior Center Board. Baun reports on the Community Infrastructure District meeting, Ada County Soil and Water Conservation District and the Resource Conservation and Development meetings. B. City Hall Department Supervisor Reports: Director of Long-Range Planning and Projects, Nichoel Baird Spencer states there will be a workshop with Valley Regional Transit on February 17t. Reports on the Pre-bid meeting for the Eagle Road bike-pedestrian bridge meeting held today, and the memo regarding a public outreach plan for a shooting range (archery, rifle and pistol pits and a clay pigeon area). Chief Ryan Wilke,Ada County Sheriff's Office,provides a law enforcement report. C. City Attorney Report: None 7. PUBLIC COMMENT 1: The Eagle City Council is taking both in-person and remote public comment via WebEx. Meeting login instructions are posted on https://www.cityofeagle.org/1698Nirtual-Meetings. This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek comments/opinions regarding specific City matters during this allotted time.This is not the time slot to give formal testimony on a public hearing matter,land use application,or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. Steve Bender, 1235 N. Mr. Bender suggests additional sign placement to better inform drivers.He wonders if any of the Council would like to remove item F to address concerns that had previously been raised regarding the development. James Westcott, 1396 N. Racing Waterway, Eagle, Idaho. He is not only a resident, but also the Vice President CTC Telecomm. His concern is competition against a private company in the community. Should the city only allow one provider to use the network it would not foster good competition in the business community. If the City requires the developers to install the conduit, it is not investing in the capital outlay whereas businesses are incurring those costs. Mayor Pierce addresses the City's desire to install a fiber infrastructure, the City will not be the internet service provider (ISP). Multiple ISP providers would be allowed to utilize the infrastructure, and with the cost of the maintenance of the infrastructure lying with the City, the ISP providers will not be incurring that long term cost.Ammon and Mountain Home are installing the fiber infrastructure as well. Eagle is trying to provide high speed internet to underserved or unserved areas. Discussion. 8. Re-appointment to the Eagle Arts Commission: In accordance with Resolution 14-19, Mayor Pierce is requesting Council confirmation of the re-appointment of Jennifer Mangiantini to the Eagle Arts Commission. Ms. Mangiantini will be serving a three(3)year term that will expire February 2025. (JP) R. Re-appointment to the Historic Preservation Commission: In accordance with Resolution 14-19, Mayor Pierce is requesting Council confirmation of the re-appointment of Joel D'Andrea to the Historic Preservation Commission. City Attorney Villegas states that the language could be clarified and suggests he work with staff to bring back language. Mr. Yorgasson reiterates' that he stated at the meeting that they are committed to building a bridge and will work with Middleton Mill irrigation to work through the process. Mr. Yorgasson is very concerned with the delay and the investment in the property and project. Discussion. Gindlesperger remands this consent agenda item 8M to staff to change the condition to reflect Councils intent during deliberation and bring it back at the next meeting on February 17th. Public Works Director, Eric Ziegenfuss corrects language on the memo associated with this item and clarifies that the items to be purchased will be used equipment,this is allowed in Idaho State Code 67-2803(8)(18). Discussion. Stan Ridgeway, 1735 W. Rush Rd. Eagle, Idaho. Mr. Ridgeway states he has reviewed the State Statue and that the legislature provides additional information. Mr. Ridgeway has a different interpretation of the State Statue. He inquires as to the staffing required to operate the equipment and the ongoing expenses associated with the same.Discussion. Baun seeks comment from the City Attorney to ensure the City's compliance with State Code. City Attorney Villegas states that the procurement statute does not define the term equipment. The term personal property is used throughout the statue definition. Upon reviewing other portions of Idaho Code,and within the tax code the term personal property is defined as equipment,machinery, furniture and other personal property. The section of the code requiring permission from the governing board is pertaining to items obtained at an auction, the items identified by the Public Works Director would fall under the common definition of personal property. Baun moves to approve consent agenda item 8S Request to Purchase Equipment for Fiber Optic Installation. Seconded Gindlesperger. UNFINISHED BUSINESS: A. ACTION ITEM Request for Fee Waiver—Judy Dahl: Judy Dahl is requesting approval of a fee waiver for the planning application fee,legal deposit,and future public hearing notification costs for a request for reconsideration of the final decision for Rene Commons Subdivision(A-07- 21/RZ-08-21 & PP-10-21). This item was continued from the January 25, 2022, City Council meeting. Mayor Pierce introduces the item. Zoning Administrator, Bill Vaughan provides a brief overview of the request from Ms. Dahl to waive the fees associated with a request for consideration for the final decision for Rene Commons Subdivision. Judy Dahl. Ms. Dahl states that she was in Hawaii and in Arizona and was not able to attend the earlier meetings, and appreciates the request being heard tonight. Ms. Dahl states that it would harm her to pay the fee personally, she is not poor but it is a very expensive fee. Discussion regarding the fees associated a request for reconsideration as established in the City's fee schedule. Baun moves to deny the request for fee waiver.Seconded by Gindlesperger. ACTION ITEM: A-10-21/RZ-15-21 & PP-15-21 —Annexation and Rezone from RUT To R-E-DA and Preliminary Plat For Amberly Ranch Subdivision — Gerard Investments LLC:Gerard Investments LLC,represented by Jadon Schneider of Bronze Bow Land,is requesting an annexation and rezone of three (3) existing parcels (totaling 11.81 acres) from RUT (Rural- Urban Transition—Ada County designation)to R-E-DA (Residential-Estates with a development agreement) and preliminary plat approvals on one of the three parcels for Amberly Ranch Subdivision, a 4-lot(3-buildable, 1-common)residential subdivision(totaling 7 acres). The site is located on the southwest corner of West Beacon Light Road and N. Ballantyne Lane. (MNB) Mayor introduces the item. Jaydon Schneider representing 412 S. Third Street Boise, Idaho Gerard Investments LLC presents the application. Planner II, Morgan Beesaw reviews the staff report. Craig McClintock, 3054 W. Caliper Court. and is a member of Lateral 78 Association. They welcome the development, but they have concerns regarding the distribution box for irrigation. There appears to be issues with the lateral that may require engineering that runs all the way to Farmers Union Canal. This distribution box is tied to the Amberly Ranch Subdivision. There are also concerns with ACHD requirements that may impact the relocation of the lateral. Discussion. Kenneth Hebut, 2396 W.Buckhorn Court, Eagle,Idaho. Mr. Hebut discusses the berming. Baun moves to approve action item 10B A-10-21/RZ-15-21 & PP-15-21 — Annexation and Rezone from RUT To R-E-DA and Preliminary Plat For Amberly Ranch Subdivision with the following conditions of approval or changes the first being adding the waivers for internal sidewalks, ribbon curb and private street requirements; however not waiving the one regarding the tree area requirements of they would have to meet the landscaping requirements of the City including the berm and landscaping. They can incorporate any trees that they can, but only if they can incorporate them into the actual berming plan and be commiserate with what we have including moving the irrigation line outside of ACHD right of way. In addition, the requirement of landscaping and sidewalks on both Beacon Light and Ballantyne Road berming and landscape requirements to include a 10' sidewalk. Support staff recommendations for City Council for 3, 4 and 5 (of the development agreement). Seconded by Pike. Discussion. Baun amends to split the DA. Second concurs. ACTION ITEM: PP-02-21/FP-02-21 & CU-08-21 —Combined Preliminary/Final Plat &Conditional Use Permit for Shepherding Acres Subdivision—Braiden Shaw:Braiden Shaw, represented by Aaron Rush with LR-GEO, is requesting a combined preliminary and final plat approval for Shepherding Acres Subdivision, a 4-lot residential subdivision, as well as a Conditional Use Permit to waive the code section requiring paved sidewalk along West Washam Road and to address the existing nonconforming structure on the property. The 7.2-acre site is located on the south side of West Washam Road at 1791 and 1835 West Washam Road. (MNB) Mayor introduces the item. Braiden Shaw and Tyler Hon, 1444 Crosswater Way,Eagle,Idaho presents the application. Planner II, Morgan Beesaw reviews the application. Mayor opens the public hearing. Steve Bender, 1235 N. Seven Oaks Place,Eagle,Idaho.He feels the concept of putting power lines underground is a good concept. He also feels that the fiber conduit also needs to be installed. Mr. Bender is not in favor of waivers. Alan Hochstrasser, 1835 W. Washam Road, Eagle, Idaho. Mr. Hochstrasser states that the proposed plat is not unique compared to the others located on Washam Road. He was born and raised here and lived on the property. Judy Dahl, 735 N. Echohawk Way, Eagle, Idaho. This is a great example of the pressure of development standards. The City should not make it too expensive to develop agricultural land, and feels they should be grandfathered in. The applicant should be allowed to do what they want with their property. Mr. Shaw, 346 Mission Drive, Eagle, Idaho and Mr. Hon, 1440 Crosswater Eagle, Idaho, rebuts testimony. They state that the configuration is not unique compared with others on Washam. They believe they have complied with City Code. Discussion. Mayor closes the public hearing. Baun moves to approve action item 10 C PP-02-21/FP-02-21 & CU-08-21 — Combined Preliminary/Final Plat&Conditional Use Permit for Shepherding Acres Subdivision keeping site condition of approval 8 and 17, amending 17 to allow the option of a surety bond for relocation prior to signing the final plat. Here are a few things to consider further: 1. ACHD will reconsider the access if requested by the council , the notice to attend the ACHD meeting regarding the traffic was over before the notification to the public was recieved, so we were unable to attend. a. Creating a five way traffic problem at 55 and Hill Rd at South Echohawk Way. ( Please review 2nd P&Z meeting, public input and recommendations b. Realizing now that Dickey not only has fewer homes and is a more direct path but is also wider than North Echohawk Way currently. 2. IN The Parks and Rec Dept can consider how they would like new trails along the canal to look, with common and rgreen areas along the trail or just narrow trails behind i homes that eliminate privacy and security. 0,3.In the 2017 comp Plan when completed this area was designated neighborhood residential as described in the Plan "north of Sadie should remain Neighborhood Residential. Page 147 item e (6.18.1 , legal description) a. There is no valid explanation or comp plan amendment that was ever posted to change the plan with public input. b.There has been no explanation of how and when this was changed, The public wants to know how why and when this was arbitrarily changed. c. This area is not a compact area, never was. 4. Feathering in higher density is the most important tool we have, It protects established residents from the density increases in the 2017 Comp Plan, and lessens the impacts on there properties. (its the least we could do, and it is policy) In this plan they are not matching lot sizes on the perimeter and gradually increasing them. (note 2 for one lots on the eastern boarder) In closing , Council Members, I listed the four major concerns, (to keep it to one page, easy read) but we know about other concerns as well. I hope you have reviewed everything and will take the time to, if you have not re watched the meetings involved in this process, on this one. I will say this , I enjoy noise, crime, traffic, being mislead, losing my sunset view,(that had horses in it) losing my privacy, being ignored when expressing concerns, being denied process, having all the agricultural land under severe development pressure and trying to be convinced we are already Urban so everything is inevitable, about as much as everyone else does...So Lets Fix this one!.
