Minutes - 2022 - City Council - 01/11/2022 - Regular EAGLE CITY COUNCIL MEETING MINUTES January 11,2022 1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m. 2. ROLL CALL: Present: GINDLESPERGER, PITTMAN, BAUN, PIKE. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: 4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA: A. City Staff requests. B. Mayor or City Council requests. 5. REPORTS 1: A. Mayor and Council Reports: Pike attended the Eagle Sewer District meeting at which they annexed four developments. They continue to move forward with the expansion of their facility. Reports on the Urban Renewal Agency and Valley Regional Transit activities. Baun reports on a meeting he attended with the Bureau of Land Management, where the City's concept plan was presented. Discussed the next steps in the process for the RPP. Mayor Pierce reports on City Hall expansion progress. Mayor also states that they had museum visitors share some stories of how they used to attend that church and it brought tears to the visitors' eyes. They are very grateful that the building was preserved. 6. Development Agreement Associated with A-06-21/RZ-10-21 & PP-12-21 — Pescara Estates Subdivision: Staff is requesting approval of the development agreement associated with the rezone from RUT (Rural-Urban Transition — Ada County designation) to R-E-DA (Residential-Estates with a development agreement). The City Council approved the associated annexation, rezone, and preliminary plat applications on November 30, 2021 (A-06-21/RZ-10-21/PP-12-21). (DLM) G. Findings of Fact and Conclusions of Law for the Approval of A-07-21/RZ-08-21 & PP-10-21 — Rene Commons Subdivision — Sterling Land Development, Inc.: Sterling Land Development, Inc., represented by Becky McKay with Engineering Solutions, is requesting an annexation,rezone from RUT(Rural-Urban Transition—Ada County designation)and RI (Estate Residential —Ada County Designation) to R-4-DA (Residential with a development agreement), and preliminary plat approval for Rene Commons Subdivision,a 22-lot(17-buildable, 5-common) residential subdivision. City Attorney,Victor Villegas provides an overview of the written request which is seeking Council to reconsider their action on this item. ACTION ITEM.A Public Hearing to Consider Rate Increase for solid Waste Services: The purpose of the public hearing is to consider public comment regarding the proposal to increase solid waste service fees in excess of 5%. Mayor Pierce introduces the item. Rachelle Klein with Republic Services, 11101 W.Executive Drive,Boise,Idaho addresses the CPI increase. A large impact to the CPI was wage adjustments and other employment incentives for their workforce.Klein notes that the citizens of Eagle have service options based on the size of cart utilized. Mayor opens the public hearing. Bob Van Arnem,3049 S.Whitepost Way,Eagle,Idaho. He would like to see the number of weeks for leaf pick up to be extended. Additionally,he would like the Spring Clean-Up week to be altered to later in March. Tom Barrieau, 1397 W. Hereford Drive, Eagle, Idaho (appearing via WebEx). Mr. Barrieau submitted his comments in writing. He would like there to be taken into consideration the impact on lower income people,the CPI increase may not be the best source to consider. Mayor closes the public hearing. A.1. ACTION ITEMS Resolution 22-01: A resolution of the City of Eagle, Idaho, amending Republic Services fee schedule pursuant to the second addendum to Waste Collection Services contract as stated in Section 2.2. "Customer Rates — Establishment" and providing for effective date. Baun asks that when Republic Services comes back to present their annual report that they bring back a five-year history of the rate increases for comparison. ACTION ITEM RZ-14-00 MOD2 — Development Agreement Modification — John Dav: John Day is requesting a development agreement modification to modify conditions of development #2.5 (associated with permitted uses) and #2.14 (associated with setbacks) of the executed development agreement (Ada County instrument #101134699). The 2.16-acre site is located at the southwest corner of East Hill Road and South Wooddale Avenue.(MJW) Mayor introduces the item. John Day, 415 South 13th Street, Boise, Idaho, reviews the requested development agreement modification. Mike Williams,Planner III reviews the staff report. Mayor opens the public hearing. Ruben Ortega, 151 N.Lost Canyon Place,Eagle,Idaho. Mr. Ortega is passionate about jujitsu and is an attorney. Mr. Ortega has been working with the applicant to amend the CCR for the site. Jujitsu is a family,and it is a different atmosphere than like a Crunch fitness. He does not feel there should be any restrictions to this business as it is restrictive and unfair. Kevin Hall,3225 N.Wagon Wheel,Road,Boise,Idaho. Mr.Hall reiterates that Jujitsu is a family. The business is a tightknit family and feels that they could address any parking limitations without restricting class size. Pamela Street president of Great Sky Homeowners Association on Silverbow Avenue in Eagle. The HOA has concerns regarding parking on Wooddale Avenue and Hill Road. There have been numerous accidents that have almost happened due to people parking on both sides of Wooddale Avenue. Additionally, the increased traffic may lead to pass through driving through the subdivision. The HOA is hoping to partner with local business and Council to request that ACHD limit parking to one side of Wooddale. Mark Maxfield, 1079 S.Anacona,Eagle,Idaho. Mr.Maxfield is a business owner in Eagle. He is in support of the application. Jujitsu is a family and can make positive changes in people's lives. Alexander is a legend in the jujutsu community. Mario McCracken, 5918 N. Lillybrook Place, Boise,Idaho. Mr. McCracken feels that carpooling can address the parking matters. Jujitsu has made a positive impact in his family's life. Gigi is internationally renowned in the field of jujitsu, and it is an honor for to have him teach in Eagle and begin his business. Aaron Milier,2685 Cherry Circle,Emmett,Idaho.Mr.Milier's family all participate in the classes. He offers his support and emphasizes how great the jujitsu community is. Judy Dahl,735 N.Echohawk Way,Eagle,Idaho. Ms.Dahl welcomes JiJi to the Eagle community. Ms. Dahl expresses concern regarding increased traffic at the five-lane intersection on Highway 55. She makes inquiries regarding the development of property near Great Sky Estates. She does not feel that common areas should be sold for commercial development. Steve Bender, 1235 N. Seven Oaks Place, Eagle, Idaho. Mr. Bender has a concern regarding the proposed restriction of class size. He feels there are other ways to address the matter. Kenny Pittman, 231 S. Wooddale Avenue, Eagle, Idaho (business address). He is the business association president. They are in favor of the allowed use and access. There have been concerns with parking. The association has amended their CC&R's to allow for the business. Pittman reads the parking conditions within the CC&R's,which states that the business owners retain priority for use of parking spaces. Robert Scarret, 291 S. Wooddale Avenue, Eagle, Idaho (business address). He is the Vice- President of the business association. He is in support of the jujitsu facility. His business does have extended hours some evenings as well as early mornings. John Day rebuts testimony. Discusses traffic matters. Mike Williams displays an overview showing the plot map of Great Sky Estates that identifies common lots,residential lots and the buildable commercial lot. Mayor closes the public hearing. Pike moves to approve item 14B with the conditions striking 2.7 and to add the personal improvement use and 2.14 to address the setbacks staff is requesting add lots 21-25. Discussion. Council does not want to limit the number of students. ACTION ITEM: CU-06-18 MOD/PPUD-04-18 MOD — Planned Unit Development Modification—Wild Rose Subdivision—Marty Camberlanao: Marty Camberlango represented by Steve Busalacchi,is requesting a planned unit development modification approval to modify the maximum lot coverage within Wild Rose Subdivision.The 3.3-acre site is located on the south side of East Hill Road approximately 535-feet east of the intersection of North Edgewood Lane and East Hill Road.(MJW) Mayor introduces the item. Steve Busalacchi, 9395 West Pandion Court, Boise, Idaho. Mr. Busalacchi reviews the requested planned unit development modification. Mike Williams,Planner III, reviews the staff report. Mayor opens the public hearing. Marty Camberlango, he is in agreement with what was presented by Mr. Busalacchi and Mr. Williams. Rylie Berg, 1812 Birchwood Drive, Eagle, Idaho. He owns a home adjacent to the development. There is an issue with the elevation of the new subdivision in relation to adjoining homeowners. The Wild Rose Subdivision foundations are quite a bit higher than those nearby. Steve Bender, 1235 N. Seven Oaks Place,Eagle,Idaho.He believes that developers should be held to standards. However, perhaps this was a genuine mistake by the builder and perhaps staff. Discusses the requested lot coverage. He would want to ensure that the drainage can be accommodated. Judy Dahl, 735 N. Echohawk Way, Eagle,Idaho. She feels the homes are a nice product and feels bad for the adjacent homeowner who is losing some privacy due to grading. Comments on land use zoning and the need for appropriate clarification. Steve Bender inquires regarding the rear landscaping that is required. Steve Busalacchi states that it has been engineered appropriately to handle drainage. Each of the homes are custom built and do have a landscaping allotment. They may request that additional landscaping be installed in the rear for buffering but that will be left to the individual homeowners. Discussion. Mayor closes the public hearing. Baun moves to approve action item 14C CU-06-18 MOD/PPUD-04-18 MOD—Planned Unit Development Modification—Wild Rose Subdivision with the following changes: change the 55%to 50%in the DA and add the CEP program that the developer agreed to add. Seconded by Gindlesperger. Discussion. Baun amends his motion to include that the applicant shall submit a revised landscape plan showing additional landscape plantings of the zero-scaping flavor. The landscaping plan shall be reviewed and approved by Cit Council prior to the issuance of any building permit and shall be planted prior to issuance of occupancy. ACTION ITEM: RZ-05-02 MOD7 — Development Agreement Modification — The Bridges at Lakemoor — Paul Stephens: Paul Stephens, represented by Brittnee Elliott, is requesting a development agreement modification to modify condition of development #3.5 (associated with Restaurant [with drive-through]) of the executed Third Amended and Restated Development Agreement (Bridges at Lakemoor) (Ada County instrument #2017-023755). The 25.25-acre site is located at the southeast corner of East Colchester Drive and South eagle Road approximately one-third mile north of Children Boulevard. (MJW) Mayor introduces the item. Brittnee Elliott, 855 W. Brad Street, Boise, Idaho, representing Paul Stephens, reviews the requested development agreement modification. Mike Williams,Planner III, reviews the staff report. Mayor opens the public hearing. Emily Firtell 390 East Lake Briar Lane,Eagle,Idaho. She is opposed to the modification, and it is based on traffic. She believes an additional drive through would increase the challenges that homeowners in Lakemoor currently encounter. The location of the proposed drive-thru is in close proximity to Crave and would increase the problem. Curbside and take-out are viable options. Linda Lawbacker, 2764 S. Lake Vista Lane, Eagle, Idaho. She requests denial of the requested development agreement modification. The traffic impact will be significant. Colchester Road is used for the homeowners of Lakemoor as well as Laguna Point the business buildings as well.The Intuit buildings are currently under used due to Covid.But when people go back to work,there will be a severe impact.Another restaurant is not needed at this location. John Conner, 768 E. Brook Trail Lane, Eagle, Idaho. It is currently a challenge to access Eagle Road from Colchester. There are times when he must wait through three traffic lights to get to Eagle Road. Once workers return to the job site at Intuit,the problem will only increase. Matt Risenam,759 E.Lake Briar Lane,Eagle,Idaho. He concurs with the other testimony. Traffic safety is a big concern and the amount of Frank Furtell, 390 E. Lake Briar Eagle,Idaho. There is a big difference between a restaurant, and a restaurant with a drive thru. The increase of traffic with a drive through would be a more negative impact. Ron Johnson, 812 E. Ashbourne Lane, Eagle, Idaho. He disagrees with the addition of the drive thru for safety reasons. Justin Johnson,2864 S.Lake Vista Lane,Eagle,Idaho. His concern is with the addition of a drive thru but it would depend on the intensity of the use,he is also concerned about parking availability. Judy Dahl, 735 N. Echohawk Way, Eagle, Idaho. Ms. Dahl never imagined that Eagle would be filled with drive thrus. She prefers a sit-down restaurant. Brittnee Elliott state that they are only allowed a fast casual restaurant. Discusses the additional parking allotment that would allow more availability for Crave restaurant. Discussion regarding parking stacking,parking lot flow. Mayor closes the public hearing. Pike moves,pursuant to Idaho Code,Section 50-902,that the rule requiring Ordinances to be read on three different days with one full reading to be in full be dispensed with,and that Ordinance#869 be considered after being read once by title only. Regarding Rene Commons/Rene Place due to inadequate notification of ACHD meeting regarding the use of established neighborhood streets to carry the burden of the development traffic. The notice we received from Becky was late, it advised we could attend the ACHD meeting after the meeting had already been completed. Also I have actually measured the street surface and Dickey Lane is actually wider than Echohawk Way. And is simply more equipped to carry the traffic a shorter distance to Hill Road than sending the traffic through our smaller residential streets.As these facts were not considered in the process, I believe you may want to re-examine the facts. Also the gate at Dickey Lane and Rene Place can be 30 ft wide,which is more desirable than them shrinking it down to 24ft if they eliminate the closest lot(on the south west corner at the gate)to the gate , as the new lot would go beyond the lot line of where the gate post is now located narrowing the access, eliminating this new lot there would be more aesthetically pleasing and give better access for traffic/ emergency vehicles. Another glaring oversight is the path actually dead ends to the street where there are no sidewalks to continue to Gurber park, as she claims this will be the route to walk there, I feel it is an unsafe walk on Dickey with no sidewalks, and the route they are more likely to take is through the neighborhood on already established trails. Knowing the min width now for traffic calming is 24ft with ACHD even without improving the gate access area.the current black top would work for a traffic calming area out of the New development to proceed to Hill Road. I do not believe ACHD or the City considered these options , or measured the area , and it certainly should be considered.
