CITY OF EAGLE
COUNCIL MINUTES
NOVEMBER 27, 1984
The Council met in Special Session on Tuesday, Nov. 27, 1984,
at 7:30 p.m., at the Eagle City Hall. The purpose of the meeting
was to hold a public hearing for Robert Carpenter for a variance
to drill a domestic well on property located at 240 N. Eagle Rd.,
Eagle, Idaho.
Roll call showed the following members present: STOPPELLO,
WALKER, MAILE, GUERBER. Mayor HALEY presiding.
Mayor HALEY opened the public hearing at 7:35 p.m. and the
application was explained by Larry Stevens, contractor for the
Carpenters. Public testimony in favor of the variance was re-
ceived by the following people:
Maxine Carpenter - 4150 Collister Dr., Boise.
Jan Grover - 1522 W. 15th, Meridian
Chester Brownlee - Box 143 Eagle
Merill B. Brown - Box 215, Eagle
Winona Buchanan - 365 N. Eagle Rd., Eagle
Celia Brown - 368 N. Eagle Rd., Eagle
There was no unfavorable testimony submitted and Mayor HALEY closed
the public hearing at 7:55 P.M. Moved by MAILE and seconded by
GUERBER to approve the variance request submitted by Robert and
Maxine Carpenter to drill a domestic well at the location of
240 N. Eagle Road, Eagle, with the stipulation that in the event
a centralized water system is established in the downtown core area
the Carpenters will connect up to the water system and the approval
is for the following reasons:
That special conditions and circumstances exist which are
perculiar to the land which is not applicable to other lands
as there is no access to a Central Water System.
That literal interpretation of the provisions of Ordinance #40
Article III, Section 2, would deprive them of the right to build
a home in an R-5 Zone.
That special conditions and circumstances did not result from
the actions of the applicant as they had nothing to do with
the fact that no centralized water is available.
That granting the variance requested will not confer on the
applicants any special privilege that is denied by the Zoning
Ordinance to other lands as the lot in question is located in
the downtown core area where no central water is available and
the lot is surrounded by other lots with domestic wells.
Roll call on the motion resulted as follows: AYE: STOPPELLO,
WALKER, MAILE, GUERBER. Motion carried.
Mayor HALEY adjourned the meeting at~8:10 P.M.
