Minutes - 1984 - City Council - 09/11/1984 - RegularPage 32 CITY OF EAGLE COUNCIL MINUTES SEPTEMBER 11, 1984 The Council met in regular session on Tuesday, Sept. 11, 1984, at 7:30 p.m., at Eagle City Hall. Roll call showed the following members present: STOPPELLO, WALKER, MAILE, GUERBER. Mayor HALEY presiding. Moved by MAILE and seconded by GUERBER to approve the minutes of the August 14, 1984 council meeting as printed with the correction of the date of a public hearing to be held October 2, 1984, in addition the motion included the approval of the Findings of Fact and Conclus- ions of Law for the Bectold-Robison rezone. Motion resulted as follows: AYE: STOPPELLO, WkLKER, MAILE, GUERBER. Motion carried. Ordinance No. 93 "AN ORDINANCE OF THE CITY OF EAGLE, IDAHO, AMENDING ORDINANCE NO. 72 BY AMENDING THE OFFICIAL ZONING MAP; DELETING THE A (AGRICULTURE) DESIGNATION AND SUBSTITUTING THEREFORE AN R-5 (RESIDENTIAL) DESIGNATION FOR THE DESCRIBED PARCEL OF PROPERTY" legal description of the Bectold-Robison property followed, was presented to the council. Moved by MAILE and seconded by WALKER that in accordance with the provisions of~50-902, Idaho Code, that the rule requiring ordinances to be read on three different days, two readings of which are to be by title only and oneof which is to be in full, be dispensed with and that Ordinance No. 93 be considered immediately. Roll call on the motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE, GUERBER. Motion carried. Moved by MAILE and seconded by WALKER to Roll call on the motion resulted as follows: WALKER, MAILE, GUERBER. Motion carried. adopt Ordinance #93. AYE: STOPPELLO, Engineer's Wayne Forrey and Dave Curtis from J.U.B. Engineering Co..were present to speak to the council concerning a new 50% grant that is available for City water systems. Their proposal was that the City consider applying for this grant by consolidating with Eagle Ranch Water Company. Design Review #7-84 for the Eagle Foursquare Church was presented to the Council. Moved by STOPPELLO and seconded by GUERBER to approve the application for Design Review by Eagle Foursquare Church. Motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE, GUERBER. Motion carried. The City attorney was instructed to pursue the Design Review matter concerning the Eagle Village Restaurant. Mayor HALEY announced that this was the time and the place as published for a public hearing on the application for a Flood Plain Page 33 Development permit for Mr. and Mrs. Harry Fisher at 135 Floating Feather Road, Eagle, Idaho. The public testimony portion of the public hearing was opened at 8:12 p.m.. Mr. J. J. Howard, an engineer representing the Fisher's, answered questions presented by the Council and Mr. Fisher testified concerning flooding in the surrounding areas in previous years. Mayor HALEY closed the public testimony portion of the public hearing at 8:25 p.m.. Moved by WALKER and seconded by STOPPELLO to approve the Flood Plain Permit for Mr. and Mrs. Harry Fisher at 135 Floating Feather subject to the satisfactory submission of an elevation certificate varifying that construction will be in compliance with the Eagle Flood Plain ordinance. Roll call on the motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE, GUERBER. Motion carried. Les Cullen from Fabco Manufacturing was present to appeal to the council to reduce the cost of a building permit for construction of an open storage unit at Fabco. The council reviewed the situation with Mr. Cullen and the City Building Inspector and a motion was made by STOPPELLO and seconded by GUERBER to uphold the fee assested by the building inspector with the condition that if Mr. Cullen moves the storage canopy to his new sight he be given valuation credit towards any future building permit (for the canopy) of $50,000.00 Roll call on the motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE, GUERBER. Motion carried. Ada County Zoning Transmittal #83-44-CU - Patricia Browen was presented for review. The transmittal was for a Conditional Use Permit to allow a residential non-farm subdivision of 15 acres at the northeast corner of Ballentine Lane and Floating Feather Roads. Moved by MAILE and seconded by STOPPELLO that we submit to Ada County our recommendation that pursuant to our current comprehensive plan that coincides with this piece of ground, that this subdivision can not be approved because the outlying areas within the Eagle Impact Area are predominately agricultural. The intent is to create minimal disruption to agricultural pursuits. The goal being to maintain a rural atmosphere and to protect agricultural pursuits in areas outside of the 1992 Sewer Planning Limits. Roll call on the motion resulted as follows: AYE: STOPPELLO,WALKER, MAILE,GUERBER. Motion carried. Ada County zoning Transmittal #84-50-CU-Kolander for a condit- ional use permit to allow a temporary mobile home on ten acres located on the north side of Rush Road ½ mile east of Ballentine Lane. Moved by WALKER and seconded by MAILE to recommend to Ada County for approval of the Conditional use permit. Roll call on the motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE, GUERBER. Motion carried. The claims against the City were reviewed. Moved by WALKER and seconded by GUERBER to approve the claims against the City. Roll call on the motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE, GUERBER. Motion carried. Page 34 The proposed changes to the Comprehensive Plan were discussed and it was moved by STOPPELLO and seconded by WALKER that based upon the representation from the Planning and Zoning of Mr. Hill, Mr. Wilson and Mr. Shade that both the City Council and Planning and Zoning cancel the public hearing date of October 2, 1984, to consider changes to the comprehensive plan, and reconsider a new public hearing date at the special Council-Planning and Zoning meeting on Tuesday, September 18, 1984. Motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE, GUERBER. Motion carried.
