Minutes - 1984 - City Council - 05/22/1984 - RegularPage 16 CITY OF EAGLE COUNCIL MINUTES MAY 22, 1984 The Council met in regular session on Tuesday, May 22, 1984, at Eagle City Hall at 7:30 p.m.. Mayor HALEY presiding. Roll call showed the following members present: STOPPELLO, WALKER, MAILE. Moved by MAILE and seconded by WALKER to approve the minutes of the April 24, 1984 meeting as printed. Motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE. Motion carried. Tom Dixon and Wayne Crosby were present to address the Council concerning the Articles of Incorporation and By Laws of the Eagle Senior and Community Building Association. Moved by STOPPELLO and seconded by MAILE to support the goals and purposes as set forth in the Articles of Incorporation and By Laws of the Eagle Senior and Community Building Association Inc. Roll call on the motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE. Motion carried. Moved by STOPPELLO and seconded by MAILE to approve the Findings of Facts and Conclusions of Law for the Baldwin Variance. Roll call on the motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE. Motion carried. A letter from the Library Baord was submitted to the council stating that "Donna Abbott has resigned as a member of the Eagle Library Board. The Board recommends that the Council appoint Chris Gaston of Eagle to complete that unexpired term on the Board. Please be advised that I have been elected to complete Donnas unexpired term as President of the Library Board." Moved by Walker and seconded by MAILE to approve the changes made on the Library Board as listed in the letter. Motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE. Motion carried. Mayor HALEY announced that this was the time and the place as advertised for a public hearing concerning "AN ORDINANCE OF THE CITY OF EAGLE, IDAHO, AMENDING ORDINANCE N0.88 BY CLARIFYING THE DEFINITIONS OF "ORIGINAL PARCEL OF LAND" AND "SUBDIVISION" AND PROVIDING AN EFFECTIVE DATE." There was no public testimony submitted either oral or written. Moved by STOPPELLO and seconded by WALKER to hold the decision on the ordinance until the next regularly scheduled council meeting. Motion resulted as follows: AYE: STOPPELLO, WALKER, MAILEo Motion carried. There was discussion about the sale of Obscene materials being sold in town and it was suggested by Councilman WALKER that the City pass ~a resolution supporting the state statutes governing the sale of obscene materials. Ada County Zoning transmittal #84-29-CU- Robert Wright was submitted for consideration. Moved by STOPPELLO and seconded by MAILE to approve the application on the grounds that it does not violate the Ea~le Co~.rehensive plan. Motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE. Motion carried. Page 17 Unanimous consent was requested in order to put the Benmoor Subdivision, Ada County Transmittal #84-13-PDR, on the agenda for consideration. Moved by WALKER and seconded by MAILE for unanimous consent. Motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE. Motion carried. Reveiw of the Benmoor Subdivision was conducted. Moved by STOPPELLO and seconded by WALKER to hold action on the matter until the next regular council meeting together with a request to the Ada County Zoning Commission to hold action until the Eagle City Council has a chance to study the matter further. Motion resulted as follows: AYE: STOPPELLO, WALKER, ~ILE. Motion carried. Ron Marshall, Design Review Chairman, presented Design Review Application #4-84-Eagle Grill, for consideration of a new sign and outside changes in the front of the restaurant. Moved by WALKER and seconded by MAILE to ancept the recommendations of the Design Review Committee and approve the sign and changes requested in application #4-84-Eagle Grill. Motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE. Motion carried. Moved by WALKER and seconded by STOPPELLO to approve the claims against the City. Motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE. Motion carried. Mayor HALEY announced that we have received word of the resignation of Councilman ESCALANTE.
