AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY IDAHO AMENDING TITLE 5,
"POLICE REGULATIONS", CHAPTER 10, "SPEED LIMITS", SECTION 1, "GENERAL
SPEED LIMITS"; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Eagle, Idaho is a municipal corporation organized and operating
under the laws of the State of Idaho; and
WHEREAS, concern has been expressed that excessive vehicle speed upon streets within
the City, and more specifically within and in proximity to the City's downtown area, exposes
residents and property to risk of injury or damage; and
WHEREAS, in accordance with Idaho Code §49-207, the City has completed a traffic
investigation and has determined a new maximum speed limit needs to be established within and
in proximity to the City's downtown area to protect the health, safety, and welfare of the citizens
of Eagle and to deter hazardous conditions to residents, businesses, and visitors alike; and
WHEREAS, City of Eagle acknowledges that the Ada County Highway District (ACHD)
is responsible for the care and maintenance of all public roadways within Ada County and within
the City of Eagle, including the posting of maximum speed limits; and
WHEREAS,the City of Eagle has requested the ACHD change the maximum posted speed
limit within the City of Eagle as specifically identified herein.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF EAGLE, Ada County, Idaho;
Section 1: Title 5, Chapter 10, Section 1 of the Eagle City Code is hereby amended, in part, to read
as follows with underline text to be added and strike-through text to be deleted:
5-10-1: GENERAL SPEED LIMITS:
No person, other than authorized emergency vehicle personnel, shall drive a vehicle at a speed in
excess of the following:
A. Twenty five (25) miles per hour, unless otherwise posted, on any public street within the
corporate city limits.
B. Ten (10) miles per hour on any throughway, or in any parking lot in a public park.
C. l en (10) miles per hour on any public alley.
D. Twenty (20) miles per hour in the following locations:
1. On State Street from Cobblestone Lane east to Stierman Way.
2. On Egle Road from Ranch Drive south to Plaza Drive.

Section 2: The provisions of this ordinance are hereby declared to be severable and if any
provision of this act or the application of such provision to any person or circumstance is declared
invalid for any reason, such declaration shall not affect the validity of remaining portions of this
ordinance.
Section 3: The City Clerk is instructed to immediately forward this ordinance to the codifier of
the official municipal code for proper revision of the code.
Section 4: This ordinance, or a summary thereof in compliance with Idaho Code §50-901A, shall
be published once in the official newspaper of the City, and shall be in full force and take effect
immediately upon its passage, approval, and publication.
