Mayor HALEY announced that this was the time and the place

and Jerry Elliott, 3904 Pennfield, Bosie. Written testimony in

asked Mr. Baldwin questions outlined in Section E., Chapter XV of
Ordinance #40. Moved by STOPPELLO and seconded by WALKER to approve
the Variance for Mr. & Mrs. Robert Baldwin for property located at
305 Yellowpine, Eagle, on the grounds that:
Special conditions and circumstances exist which are perculiar
to this lot, i.e., it's unusual shape which is not applicable
to other lots in the same district;
2. That a literal interpretation of the provisions of the Zoning
Ordinance would deprive the applicant of the rights commonly
enjoyed by other properties in the same district under the
terms of the ordinance;
3. That special conditions and circumstances did not result
from the actions of the applicant, as they purchased the lot
as is; and
That granting the variance requested would not confer on the
applicant any special privilege that is denied by the Zoning
Ordinance to other lands in the same district.
