Mayor HALEY presiding. Roll call showed the following members present: WALKER, MAILE. STOPPELLO, Moved by STOPPELLO and seconded by MAILE to of the April 3, 1984 council meeting as printed. follows: AYE: STOPPELLO, WALKER, MAILE. Motion approve the minutes Motion resulted as carried. Moved by STOPPELLO and seconded by WALKER to approve the minutes of the April 10, 1984 council meeting with the correction on page 13, line one ~o-~eeommem~-~p~ov~-o~-~8~-~-~W to read "that Ada County Transmittal #84-15-CU was not in conflict with the Eagle Comprehensive Plan." Motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE. Motion carried. Mayor HALEY announced that this was the time and the place advertised as a public hearing for a Variance for Mr. & Mrs. Robert Baldwin. Public testimony in favor of the variance was heard from Mr. & Mrs. Robert Baldwin, 378 Moriane Place, Eagle and Jerry Elliott, 3904 Pennfield, Bosie. Written testimony in favor of the Variance was received from Ed Thomas, 2309 Malad, Boise. No unfavorable testimony was received. Councilman STOPPELLO asked Mr. Baldwin questions outlined in Section E., Chapter XV of Ordinance #40. Moved by STOPPELLO and seconded by WALKER to approve the Variance for Mr. & Mrs. Robert Baldwin for property located at 305 Yellowpine, Eagle, on the grounds that: Special conditions and circumstances exist which are perculiar to this lot, i.e., it's unusual shape which is not applicable to other lots in the same district; 2. That a literal interpretation of the provisions of the Zoning Ordinance would deprive the applicant of the rights commonly enjoyed by other properties in the same district under the terms of the ordinance; 3. That special conditions and circumstances did not result from the actions of the applicant, as they purchased the lot as is; and That granting the variance requested would not confer on the applicant any special privilege that is denied by the Zoning Ordinance to other lands in the same district. Roll call on the motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE. Motion carried. Mayor HALEY presented Resolution #4-84 " A RESOLUTION OF THE CITY OF EAGLE, IDAHO, APPROVING THE ADOPTION OF JOINT REGISTRATION PROCEDURES WITH ADA COUNTY, IDAHO, FOR ALL ELECTIONS FOLLOWING THE ADOPTION OF THIS RESOLUTION." Moved by WALKER and seconded by MAILE to approve Resolution #4-84. Roll call on the motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE. Motion carried. Page 15 Ann Gallinger, City Librarian, presented a request by the Library Board to apply for a C.W.E.C. employee. Moved by MAILE and seconded by STOPPELLO to proceed with the application by the Library Board for a C.W.E.C. employee. Motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE. Motion carried. Procedural problems of Impact were discussed into the problem. concerning Subdivision Plats in the Area and the City Attorney was asked to check There was a discussion conerning illegal signs in the Design Review District. Moved by WALKER and seconded by MAILE to approve the claims against the City for the month of April. Roll call on the motion resulted as follows: AYE: STOPPELLO, WALKER, MAILE. Motion carried.
