Minutes - 2021 - City Council - 12/14/2021 - Regular EAGLE CITY COUNCIL MEETING MINUTES December 14,2021 1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m. 2. City Attorney Report:None 6. PUBLIC COMMENT 1:The Eagle City Council is taking in person and remote public comment via Webex. This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek comments/opinions regarding specific City matters during this allotted time.This is not the time slot to give formal testimony on a public hearing matter,land use application,or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. Ann Joslin, 1750 Washam Road, Eagle, Idaho makes comments regarding the Avimor Development specifically the developers expressing that they would close down the trails if Avimor doesn't get annexed in. Baun clarifies that the acreage on the west side of Avimor is private lands and therefore they could prohibit public use if a development agreement is not place. Craig Shotwell, 741 W. Rush Court, Eagle, submitted a building plan for an expansion on his workshop. They were told by the City that the parcel is not in conformance with the required setbacks. He requests Council approval on his building plans. Planning Staff states that he can submit a Conditional Use application for review by City Staff and City Council. Mayor suggests he goes through the proper process. Jane Rohling, 582 Palmetto Drive,expresses concerns on water issues in Avimor. 7. Professional Services Agreement with Timberline Surveying PLLC: A professional services agreement between the City of Eagle and Timberline Surveying PLLC to conduct a survey for the purpose of locating the boundary of City-owned property located at 97 West Aikens Road in an amount not to exceed$2,200. (WEV) C. Caselle Software Purchase: Staff is requesting Council approval of the purchase of software to facilitate the electronic filing of W-2's, 1099's and ACA reporting. The approved amount will not exceed$1,700.00. (TEO) D. Task Order 21-02: Linder Road Design: Staff is requesting approval of Task Order 21-02 with Baer Design Group for design work associated with ACHD's Plans to expand Linder Road from State Highway 44 to Floating Feather Road in the mount not to exceed$27,750.00.(NBS) E. Scope of Work for Mace Park Design: Staff is requesting approval of a scope of work for engineering services with HECO Engineers for the Mace Park in the amount not to exceed$32,695.50. (NBS) F. State and Local Agreement with ITD—Eagle Road Pedestrian and Bicycle Bridge Construction: Staff is requesting approval of the state and local agreement with the Idaho Transportation Department to advance construct the Eagle Road Bridge. Total project cost is$3,082,922.The City responsibility will,after federal and state funding, is $1,693,000 with$166,471 advanced payment to ITD upon execution. (NBS) G. Resolution 21-23 Eagle Road Bike/Ped Bridge Funding Obligation: Resolution of The City Council of the City of Eagle stating the obligations of the State and City of Eagle for the development and construction of the SH55 Bike/Ped Bridge over the Boise River. Sole Sources Agreement with Biarri Networks for Design Service for a Municipal Fiber Network Plan: Having declared and published as a sole source contract under Idaho Code §67-2808(2)(a) and §67-2808(2)(a) (2)(b) and having receive no opposition,a Sole Sources Agreement with Biarri Networks in an amount not to exceed $169,000.(EZ/NBS) I. Parks and Recreation Independent Contract Instructor Agreement: The Parks and Recreation Department is seeking Mayor and Council approval of an Agreement for Independent Contract Instructor between the City of Eagle and Andre Moncheur in an amount not to exceed 50%of total revenue generated by registration fees remitted for classes.(LS) J. Service Agreement Between the City of Eagle and Integrated Security Resources,Inc.: A service agreement between the City of Eagle and Integrated Security Resources,Inc. for the installation of access control and video system for the City Hall Expansion in an amount not to exceed$75,144.56. Resolution 21-22A - Appointing the Members of the 2022 Comprehensive Plan Review Committee:A Resolution of the City Council of the City of Eagle appointing and confirming members of the 2022 Comprehensive Plan Review Committee.(NBS) N. FP-11-21 —Final Plat for Elkhorn Reserve Subdivision—James Eric Needham: James Eric Needham is requesting final plat approval for Elkhorn Reserve Subdivision, a 3-lot residential subdivision. DR-13-97 MOD — Monument Sign for Eagle Middle School — Eagle Middle School: Jenny Tellez with Eagle Middle School, represented by Jeff Bickford with Bickford Sign and Awning, is requesting design review approval to remove the existing monument sign and replace it with a punch through illuminated monument sign with an electronic reader board. The 32.99-acre site is located on the north side of West Floating Feather Road approximately 2,600-feet west of Eagle Road at 1000 West Floating Feather Road. (ERG) P.1. Findings of Fact and Conclusions of Law for the Approval of DR-13-97 MOD—Monument Sign for Eagle Middle School—Eagle Middle School Q. DR-43-21 — Common Area Landscaping within Arvory Crest Subdivision — FS One, LLC: FS One, LLC, represented by Jaime Snyder with T-O Engineers, is requesting design review approval of the common area landscaping within Arvory Crest Subdivision. The 80.2-acre site is located on the southeast corner of West Floating Feather Road and State Highway 16 at 1252 North Highway 16. (ERG) R. DR-44-21 — One Subdivision Entry Feature and Seven Subdivision Entry Monument Signs for Arvory Crest Subdivision — FS One, LLC: FS One, LLC, represented by Jaime Snyder with T-O Engineers,is requesting design review approval for one subdivision entry feature and seven subdivision entry monument signs for Arvory Crest Subdivision. Service Agreement Between the City of Eagle and Waxie Sanitary Supply: A service agreement between the City of Eagle and Waxie Sanitary Supply for sanitary supplies services.Exhibit"A"of the agreement provides supply sell price.(EZ) V. Service Agreement Between the City of Eagle and Commercial Tire: A service agreement between the City of Eagle and Commercial Tire for fleet services. Exhibit "A-1"of the agreement provides service costs. (EZ) W. Resolution 21-27: A resolution of the City of Eagle, Idaho declaring broadband internet to be an essential service.(EZ) X. Sole Source Contract between the City of Eagle and Fatbeam:Having declared and published as a sole source contract under Idaho Code §67-2808(2)(a) and §67- 2808(2)(a)(2)(b)and having received no opposition,the city is entering into a contract with Fatbeam for the installation of conduit, and,where available, installation of fiber into a joint trench as part of the municipal fiber optic system. ACTION ITEM: A-07-21/RZ-08-21 & PP-10-21 — Rene Commons Subdivision — Sterling Land Development, Inc.: Sterling Land Development, Inc., represented by Becky McKay with Engineering Solutions, is requesting an annexation, rezone from RUT (Rural-Urban Transition—Ada County designation)and R1 (Estate Residential—Ada County Designation)to R- 4-DA (Residential with a development agreement), and preliminary plat approval for Rene Commons Subdivision, a 22-lot(17-buildable, 5-common) residential subdivision. The 5.58-acre site is located approximately 160-feet north of the intersection of East Windrose Street and North Falling Water Way at 2425 East Floating Feather Road. (DLM) Mayor introduces the item. Becky McKay, 1029 N. Rosario Street #100, Meridian, Idaho with Engineering Solutions representing Sterling Land Development Inc. Ms. McKay reviews the application, and addresses conditions in the staff report of concern to the applicant. Daniel Miller,Planner II reviews the staff report. Mayor Pierce opens the public hearing. Judy Dahl, 735 N. Echohawk Way, Eagle, is not in favor of the project and states that there are problems with the project such as lot lines. The surrounding lots are larger lots, and it is not consistent with the Comprehensive plan.. McKay provides a rebuttal. Mayor Pierce closes the public hearing. Baun moves to approve action Item A A-07-21/RZ-08-21 & PP-10-21 — Rene Commons Subdivision—Sterling Land Development,Inc. Seconded by Gindlesperger.Discussion.Pike states that they are in conformance with the rest of the neighborhood. Pittman agrees with Pike that it is conforming with the area. ACTION ITEM: RZ-12-21/CU-07-21/PPUD-07-21/PP-14-21 — Benari Estates Subdivision—Eagle 1,LLC: Eagle 1, LLC, represented by Laren Bailey, is requesting a rezone from A (Agricultural) to R-4-DA-P (Residential with a development agreement — PUD), conditional use permit, preliminary development plan, and preliminary plat approvals for Benari Estates Subdivision, a 148-lot(133-buildable, 15-common)residential planned unit development. The 35.29-acre site is located at the northeast corner of West State Street and North Ballantyne Lane at 1770 West State Street. (MJW) Mayor introduces the item. Pittman discloses that he received emails prior to the public hearing. Williams puts into the record that the emails are apart of the record. They were duplicates. Baun discloses that he has worked on projects with Laren in the past. Keith Clark,251 Front Street,Boise representing Eagle 1 LLC. Mr.Clark reviews the application and addresses conditions within the staff report of concern to the applicant. Mike Williams,Planner III reviews the staff report. General discussion regarding the project between Council and Staff. Mayor opens the public hearing. Allen Lusk, 1764 W. Rush Road, Eagle, appreciates the transition from the developer as well as preserving the barn.He looks forward to transitioning to a smaller home in this area. Orson Woodhouse, 1037 Winding Creek Drive,Eagle,supports the project and is a business owner in Eagle. This is a project that is needed in Eagle.It is pedestrian friendly and a nice design. Kelly Woodhouse, 2238 N. Black Forest Ave, Eagle, is a realtor and receives phone calls from clients expressing that they want to be close to downtown Eagle, single level homes and low maintenance.Eagle needs a development like this,and request council approve this community. Jeff Clifford,2624 N. Town Home Lane,Meridian, supports this development and believes Eagle needs a development like this. Travis Perry, 3945 W. Wellhouse Steet, Eagle, supports the project and would like to locate his father to Idaho in a development like the proposed project. Amy Kelly,367 N Lost Canyon Way,Eagle,resides in Countryside.Empty nesters and are looking to downsize and move to this proposed community. They love the eagle community and do not want to leave it. Dave Klein,631 W.Bosanka Drive,Eagle,has resided in his house in Eagle for 20 years.His house is 25 years old and has been looking into another place to reside. He hopes Council approves the project so he can move there. Mary Terpening, 1852 Hereford Drive,Eagle,is not in favor.There is no transition between Capella Subdivision and requests that Council deny this application and support staff recommendation. Terry Hall, 1852 Hereford Drive, Eagle, provides photos of the barn. It is unsafe and has been deemed for it to not be on the Historical Society Registry.He is concerned that patrons will get hurt due to no requirements to update the barn. The transition is not a fare comparison to the adjacent area. He had a meeting with Gary Ensleman at ACHD and expressed that they did not evaluate an entrance from West State Street. Additionally, there is no design for an irrigation pump station. Scott Hurren, 1238 W Shearson Court, Eagle, expresses that he would like his son and his family to reside in Banari Estates as well as his widow mother in-law. He is in favor of the project and requests Council approval. Kay Maffey, 1615 Hereford, Eagle, requests Council denial. She requests protecting the Baker's Acres property. A 25- foot setback is not acceptable. Requests a 40-foot setback,berm, and fence between the two subdivisions. Cindy Bahorra, 1407 West Deadwood Court, Eagle, agrees with the Planning and Zoning Commission. It should be a lower density and have another entrance off of West State Street. Transition should be larger along the entire perimeter and funnel into smaller lots. Jan Weed, 1378 Yellowstone, Eagle, supports Planning and Zoning Commission denial. A traffic study was done prior to this development during covid on their subdivision. They had over 200 trips a day. She believes it is a safety issue with the increase of traffic. She believes the barn is not safe and a fence around it will not be enough. Sally Boldhouse, 1588 W. Deadwood Street, Eagle, has concerns with high density development and the traffic plan. Dale Bolthouse, 1588 W. Deadwood Street, Eagle, has concerns with the high density and traffic flow. Mariah Courtwright, 1648 Hereford Drive,Eagle, requests a rezone to R-2 and insists that a berm to the north and south of Pine Ranch be required and requests the stub street be removed. Mayor calls a 5-minute break at 8:32 pm. Mayor calls the meeting back to order at 8:41pm. Patrick Courtwright, 1648 Hereford Drive, Eagle,this development is the definition of fringe. He didn't hear any pro support at the P&Z meeting, so it is odd that there was a lot of pro support tonight. He requests Council look into another access point. Christine Peterson, 2273 W. Ferns Drive, Eagle,concurs with the previous speaker. There was no pro testimony at the P&Z meeting. This is not the location for a high-density subdivision. Greg Dye, 1534 West Yellowstone Court,Eagle,has traffic concerns and requests an access point from West State Street. Laura Johnson, 1691 Hereford Drive, Eagle, has concerns with the high-density and believes it is not compatible with the surrounding area. Ken Lenz, 1510 Deadwood, Eagle, has questions on the access on State Street, would like proof and put on the record and does not agree with the transition of the project. Olani Beal, 1436 W. Powder Court, Eagle, has traffic concerns and believes there should be an entry on State Street. Deadwood Street, Eagle, opposed to the development at an R-4 density and the traffic flow and connectivity. Andy Knight, 1492 W. Powder Court, Eagle, states that there was no pro testimony at the P&Z meeting.He does not agree that there will only be 90 trips a day per the study.Density is an issue. Dave Welsch, 2136 W. Forest Grove, Eagle, asks why does there need to be heavy growth? Why is it wrong to protect Eagle as something special?He would like to see a lower density. Claudia Harris, 602 N. Ballantyne Lane, Eagle, agrees with the P&Z Committee. Has concerns with density,transition,and traffic safety. Jeff Crump, 2274 W Forrest Grove Court, Eagle, wants to make note that there was no support at the P&Z meeting. Has safety concerns with the gates based on his experience in law enforcement. Jim Reinbold, 1412 W. Powder Court, Eagle, provides photos of an F-250 parked on a 25-foot setback residence,truck impedes the sidewalk, and has concerns with the barn. Brad Watts,416 N. White Sage Way,Eagle, saw an increase in crime based on his previous career with high-density. Concerns with traffic safety. He is referencing the development as stack and pack. Tom Barrio,1397 Herford Drive, Eagle, requests a berm and further setbacks and has concerns about the barn. Judy Dahl, 735 N Echohawk Way, Eagle, states that all of the developers push their agendas and the Council and Mayor need to stand up to them. The Mayor and Council do not have a backbone. Kenneth Hebert, 2396 W. Buckhorn Court, Eagle recommends larger lots such as agricultural or R-1. Applicant Clark provides a rebuttal. Representative Laren Bailey, 4824 West Fairview Ave, Boise, Idaho, states that they have water rights from New Dry Creek and the development does have a pump station location. Kurt Smith,2502 W.Timber Drive,Eagle,concerns with traffic and noise within Eagle City limits as well as the density proposed. General questions and discussion amongst Clark and the Council. Planner III Williams, clarifies that staff did not recommend approval. Mayor Pierce closes the public hearing. Gindlesperger thanks those who showed up to testify, questions why those who were in favor did not show up at the P&Z meeting. She has concerns about the development not being an R-2,a berm through the northside is not identified and there needs to be a third access point.Pine Ranch is not set up for the increase of traffic. She would like to hear what the other Council members have to say but she is in strong support of denying this application. Pike states that the main thing they need to focus on is the transitioning component. He disagrees with the high-density in this area. He is leaning towards denial on this project. He prefers public roads and no gates and suggests removal of the barn.However,this is a good location for more density. Pittman states that City staff and the P&Z Commission are good at what they do and consider their recommendation.He has concerns with traffic,private streets,and the barn.He suggests remanding back to staff. Gindlesperger makes a motion for action item 9B to deny RZ-12-21/CU-07-21/PPUD-07- 21/PP-14-21 — Benari Estates Subdivision — Eagle 1, LLC. Seconded Pike. The 17.2-acre site is located on the north side of West Homer Road, approximately 1,350-feet west of North Linder Road. (DLM) Mayor introduces the item.
