SPECIAL MEETING MINUTES
November 30,2021
1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m.
2. ROLL CALL: Present: GINDLESPERGER, PITTMAN, BAUN,PIKE. All present. A
quorum is present.

A. Mayor and Council Reports: Pittman states that the Industrial Development Commission
will be meeting tomorrow. Pike states he attended the Urban Renewal meeting. Mayor Pierce
reminds everyone that Eagle Country Christmas is this Saturday and encourages folks to attend.

6. PUBLIC COMMENT 1:The Eagle City Council is taking in person and remote public comment via Webex.

This time is reserved for the public to address their elected officials regarding concerns or comments they would
like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek
comments/opinions regarding specific City matters during this allotted time.This is not the time slot to give formal
testimony on a public hearing matter,land use application,or comment on a pending application or proposal. Out
of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3)
minutes.

7. ALL CONSENT ITEMS ARE CONSIDERED ACTION ITEMS: CONSENT AGENDA:
• Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate
discussion on these items unless the Mayor,a Councilmember,member of City Staff,or a citizen requests an
item to be removed from the Consent Agenda for discussion.Items removed from the Consent Agenda will be
placed on the Regular Agenda in a sequence determined by the City Council.
• Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City
Staff,Planning&Zoning Commission,or Design Review Board shall be adopted as part of the City Council's
Consent Agenda approval motion unless specifically stated otherwise.

on Eagle Road, Approximately 50' North of the Dry Creek Bridge: The Water
Department is requesting approval of the bid from Eagle Water company to install a
1''A"water service,meter base and vault. The installation of the service is$11,940 plus
a meter connect fee of$560 for a total project cost of$12,500.(KA)
E. Agreement for Development of Bike Park Feature:An Agreement between the City
of Eagle and Southwest Idaho Mountain Bike Association to construct and donate a
bike park feature located at the Ada/Eagle Sports Complex. (EZ)
F. Master Pathway License Agreement: Approval of the Master Pathway License
Agreement between the City of Eagle,Middleton Mill Ditch Company,and Middleton
Irrigation Association,Inc.(collectively referred to as"Ditch Company")to permit the

construction and maintenance of pathways, landscaping, and/or related improvements
within the Ditch Company's ditch easement or right-of-way,and to make said pathway

G. Findings of Fact and Conclusions of Law for the Approval of A-06-21/RZ-10-21
&PP-12-21—Annexation and Rezone from RUT to R-E-DA and Preliminary Plat
for Pescara Estates Subdivision—801 BTH,LLC: 801 BTH, LLC, represented by
Becky McKay with Engineering Solutions, LLP, is requesting an annexation, rezone
from RUT (Rural-Urban Transition — Ada County designation) to R-E-DA
(Residential-Estates with a development agreement), and preliminary plat approvals
for Pescara Estates Subdivision, a 10-lot (8-buildable, 2-common [1-private road])
residential subdivision.The 16.34-acre site is located on the south side of East Beacon
Light Road,approximately 630-feet west of the intersection of East Los Luceros Drive
and East Beacon Light Road at 801 East Beacon Light Road. (DLM)
H. Findings of Fact and Conclusions of Law for the Approval of CU-04-21/PPUD-
04-21/PP-06-21 — Application for Conditional Use Permit, Preliminary
Development Plan,and Preliminary Plat for Snoqualmie Basin Subdivision—Red
Butte LLC:Red Butte,LLC,represented by David Sterling,P.E.,with T-O Engineers,
is requesting conditional use permit, preliminary development plan, and preliminary
plat approvals for Snoqualmie Basin Subdivision, a 35-lot (26-residential, 4-
commercial, 5-common) mixed use planned unit development. The 12.84-acre site is
located at the southwest corner of West Floating Feather Road and North Palmer Lane
at 1833 North Palmer Lane. (MJW)

Baun removes item 7E.
Pike moves to approve consent agenda items A-H excluding items E. Seconded by
Gindlesperger. GINDLESPERGER AYE; PITTMAN AYE; BAUN: AYE; PIKE: AYE:
ALL AYE: MOTION CARRIES.
E. Agreement for Development of Bike Park Feature: An Agreement between the City of
Eagle and Southwest Idaho Mountain Bike Association to construct and donate a bike park feature
located at the Ada/Eagle Sports Complex. (EZ)
Council member Baun seeks clarification on the agreement.
Public Works Director,Eric Ziegenfuss states this agreement is the donation of a bike park feature
at the bike park and discusses the feature. The City has consulted ICRMP regarding liability. The
feature does not increase the liability of the Sports Complex. Discussion regarding feature
maintenance and routine inspections that are conducted at the park.
General discussion.
Baun moves to approve consent agenda item 7E Agreement for Development of Bike Park
Feature. Seconded by Pittman. GINDLESPERGER AYE; PITTMAN AYE; BAUN: AYE;

9. NEW BUSINESS:
A. ACTION ITEMS Canvas Votes for the 2021 General Election: Acceptance of the November
2, 2021, election results as canvased by the Ada County Commissioners. [I.C. §50-412] (TEO)
Mayor introduces the item.
Mayor Pierce introduces the item.
City Clerk, Tracy Osborn states that the acceptance of the election results is part of the process
required by State Statue. A motion accepting the results is the action to be considered.
Baun moves to new business item 9A Canvas Votes for the 2021 General Election. Seconded
by Gindlesperger. ALL AYE...MOTION CARRIES.
B. ACTION ITEM: Ordinance No. 863 (Eastfield Rezone): An ordinance changing the zoning
classification of the real property described herein from A-R(Agricultural-Residential)to R-7-DA
(Residential with a development agreement); amending the zoning map of the City of Eagle to
reflect said change; and providing an effective date. The 4.58-acre site is located on the northwest
corner of East Hill Road and North Edgewood Lane at 200 North Edgewood Lane.(MJW)
Mayor Pierce introduces the item.
Pittman moves,pursuant to Idaho Code,Section 50-902,that the rule requiring Ordinances
to be read on three different days with one reading to be in full be dispensed with,and that
Ordinance#863 be considered after being read once by title only. Seconded by . ALL
AYE: MOTION CARRIES.
Pittman moves that Ordinance#863 be adopted. An ordinance changing the zoning
classification of the real property described herein from A-R(Agricultural-Residential)to
R-7-DA(Residential with a development agreement); amending the zoning map of the City
of Eagle to reflect said change; and providing an effective date. Seconded by
Gindlesperger. GINDLESPERGER: AYE; PITTMAN AYE; BAUN: AYE; PIKE: AYE:
ALL AYE: MOTION CARRIES.
10. EXECUTIVE SESSION
A. Idaho State Code 74-206(1) - Personnel Matters & Pending/Threatened
litigation: When authorized. (1) An executive session at which members of the public are
excluded may be held, but only for the purposes and only in the manner set forth in this
section. The motion to go into executive session shall identify the specific subsections of this
section that authorize the executive session. There shall be a roll call vote on the motion and
the vote shall be recorded in the minutes. An executive session shall be authorized by a two-
thirds (2/3) vote of the governing body. An executive session may be held:
(b) To consider the evaluation,dismissal or disciplining of,or to hear complaints or charges
brought against,a public officer,employee, staff member or individual agent,or public school
student;
(f) To communicate with legal counsel for the public agency to discuss the legal ramifications of
and legal options for pending litigation, or controversies not yet being litigated but imminently
likely to be litigated. The mere presence of legal counsel at an executive session does not satisfy
this requirement.
Pittman move pursuant to I.C.74-206 he asks that Council enter into Executive Session for
the purpose of discussing personnel matters and pending/threatened litigation. Seconded
by Baun. GINDLESPERGER: AYE; PITTMAN AYE; BAUN: AYE; PIKE: AYE: ALL
AYE: MOTION CARRIES.

C. ACTION ITEM Action item relating to Pending/Threatened litigation
Mayor Pierce introduces the item.
Pike moves to allow to form a petition to file an amicus brief with the Idaho Supreme
Court. Seconded by Pittman. Discussion. Pike amends for clarification moves to file an
amicus curiae brief regarding the redistricting case currently filed at the Idaho Supreme
Court. Second concurs. GINDLESPERGER AYE; PITTMAN AYE; BAUN AYE; PIKE
AYE. ALL AYE..MOTION CARRIES.

Eric Shirmer 4430 N. Double S.Lane Eagle,Idaho. Mr. Shirmer's property backs up to the BLM
land. There has been more and more shooting occurring on the land. He has consulted with an
Eagle Deputy regarding enforcement options. Mr. Shirmer discusses the proposed baseball park
location, a wastewater treatment facility and water tables. He encourages promoting building
sustainability,possibly making it a construction mandate.
