Findings - CC - 2015 - Appeal-AA-04-15 - Zoning Admin Decision To Require Removal Of 6' Cedar FenceBEFORE THE E'AGLE CITY COUNCIL IN THE MATTER OF AN APPEAL OF THE ZONI , NG ADMINISTRATOR'S DECISION POST RECONSIDERATION TO REQUIRE REMOVAL OF FENCE IN ORDER GRANTING FRONTYARD LOCATED AT 430 E. APPEAL AA -04-15, FLOATING FEATHER ROAD I The above -entitled matter came before the Eagle, City Council for their action oil July l4, 21115, at which time testimony was taken and the decision was made to deny the appeal. 'rhe city council, oil August 25, 2015, voted 2-2 (Mayor in flavor) to reconsider the above matter. On September 8, 2015, after having received oral and written testimony firoin the Applicant Dylan Schneider and City Staff, and reviewed the record, the Council voted 4 to 0 to approve the above referenced appeal. The City Council, having reviewed the, particular facts arid circumstances regarding the Zoning Adnililistrator's decision to require the removal of tile previously -constructed six (6') tall cedar fence within the front yard located at 430 El. Iloating Feather Road, and based Upon the Council's review of all information provided, tile, City Council makes the following findings and C011CILlsions and authorizes the Mayor to sign this Order. A. Dylan and l"rika Schneider are the owners ot'property located at 430 1-". Floating Feather. Road, Eagle, Jdaho, 13. The property is not similar to other properties in the general area; it was unable to be included with the development of surrounding subdivisions and the only access to the site is visa Floating Feather Road, C. The site has topographical constraints; the Only usable area is located adjacent to Floating Feather Road. The north portion of the site slopes significantly thereby limiting the usable area. D. A fence located within the front yard area wi I I provide sone privacy for the I irnited, usable area of the property. R The fence inforniation shown on Exhibit A, attached hereto, reflects the approved fence style. The existing fence shall be immediately, reconstructed to match the fence shown on Exhibit A. The fence shall be painted to match the exterior color of the 110LISC (located at 430 E. Floating Feather Road).
