A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EAGLE, IDAHO RELATING
TO SURPLUS REAL PROPERTY; DECLARING CERTAIN REAL PROPERTY OF THE
CITY TO BE SURPLUS; AUTHORIZING AND DIRECTING THE DISPOSAL OF THE
SURPLUS PROPERTY; PROVIDING FOR RELATED MATTERS; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Eagle, Idaho ("City") has acquired certain real property for the
purpose of carrying out services in the public interest by building and maintaining a pump house
within the Lexington Hills Subdivision to serve said subdivision and surrounding areas; and
WHEREAS, certain items of real property of the City, as described herein, the pump
house and well does not work properly requiring the City to drill a secondary well in the vicinity
and this well is no longer needed by the City; and
WHEREAS, the City Council of the City has deemed it unnecessary to maintain
ownership of surplus real property of the City as described herein; and
WHEREAS, the Lexington Hills Homeowners Association desires to acquire the pump
house and well for the subdivisions internal irrigation use;
WHEREAS, the City Council of the City desires to dispose of the property as allowed by
State law.
NOW, THEREFORE, it is hereby RESOLVED by the City Council of the City of Eagle,
Idaho as follows:
Section l: The City Council finds and declares that the City no longer has a use for the
