Service Solicited - 2021 - Waxie Sanitary Supply - First Amendment Sanitary Supply Services FIRST AMENDMENT TO SANITARY SUPPLIES
SEREVICE AGREEMENT
This First Amendment is entered into /5 day p'CG,r,be-v , 2021 by and
between the City of Eagle (hereinafter referred to as "Eagle"), and Waxie Sanitary Supply
(hereinafter referred to as "Vendor"), for the purpose of amending and extending the Sanitary
Supplies Service Agreement dated November 19,2020 (the "Service Agreement").
WHEREAS, on November 19, 2020, the City of Eagle entered into the Service
Agreement with Waxie Sanitary Supply to provide sanitary supplies services; and
WHEREAS, the City of Eagle and Waxie Sanitary Supply desire to modify certain
terms of the Agreement related to the pricing of products; and
WHEREAS, the City of Eagle and Waxie Sanitary Supply desire to extend the term
of Service Agreement for an additional one (1)year term; and
WHEREAS Paragraph 2 of the Service Agreement provides that renewal of the Service
Agreement will be in the form of an amendment to the Service Agreement.
NOW, THEREFORE, in consideration of the foregoing, the City of Eagle and Waxie
Sanitary Supply amend the Service Agreement dated November 19, 2020,as follows:
1. Exhibit A attached to the Service Agreement is hereby deleted and replaced with a new
Exhibit A-1 attached to this First Amendment and incorporated and made part of the
Service Agreement
2. Paragraph 2 of the Service Agreement is hereby amended to read as follows:
The term of this agreement shall be valid until November 30, 2022. This Service
Agreement may at the sole discretion of the City Council, be renewed for one
additional year. Renewal of this Service Agreement will be in the form of an
amendment to the Service Agreement.
Except as modified by this First Amendment, the original Sanitary Supplies Service Agreement
between the City of Eagle and Waxie Sanitary Supply dated November 19, 2020, shall remain in
full force and effect.
