Service Solicited - 2021 - Commercial Tire - First Amendment to Fleet Services Agreement FIRST AMENDMENT TO FLEET SERVICE
AGREEMENT
This First Amendment is entered into /5 day (Crl be" , 2021 by and
between the City of Eagle (hereinafter referred to as "Eagle"), and Commercial Tire
(hereinafter referred to as "Vendor"), for the purpose of amending and extending the Fleet Service
Agreement dated December 3, 2020 (the "Service Agreement").
WHEREAS, on December 3, 2020, the City of Eagle entered into the Service
Agreement with Commercial Tire to provide fleet services; and
WHEREAS, the City of Eagle and Commercial Tire desire to modify certain terms of
the Agreement related to the pricing of products; and
WHEREAS, the City of Eagle and Commercial Tire desire to extend the term of
the Service Agreement for an additional one (1) year term.
WHEREAS Paragraph 2 of the Service Agreement provides that renewal of the Service
Agreement will be in the form of an amendment to the Service Agreement.
NOW, THEREFORE, in consideration of the foregoing, the City of Eagle and Commercial
Tire amend the Service Agreement dated December 3, 2020 as follows:
1. Exhibit A attached to the Service Agreement is hereby deleted and replaced with a new
Exhibit A-1 attached to this First Amendment and incorporated and made part of the
Service Agreement.
2. Paragraph 2 of the Service Agreement is hereby amended to read as follows:
The term of this agreement shall be valid until December 14, 2022. This Service
Agreement may at the sole discretion of the City Council, be renewed for one
additional year. Renewal of this Service Agreement will be in the form of an
amendment to the Service Agreement.
Except as modified by this First Amendment, the original Fleet Service Agreement between the
City of Eagle and Commercial Tire dated December 3,2020, shall remain in full force and effect.
