THE EASTERLY BOUNDARY OF LOT 4, BLOCK 1, (PARK LANE ESTATES).AS SHOWN.ON`
THE ATTACHMENTS HERETO;AND PROVIDING AN EFFECTIVE DATE.
W REAS, Oakmont Signature Homes LLC, represented by Jordan Thompson; requested'a
vacation of the final plat of Park Lane Estates Subdivision to remove a two foot(2')wide portion of the
twelve foot (12') wide public utilities, irrigation and drainage easement located along the easterly
boundary of Lot 4,Block I of Park Lane Estates Subdivision;and;
WHEREAS;On October 4 2021,the.Planning and Zoning Commission recommended approval
of the vacation(VAC 04-21) to the City Council;and
WHEREAS.Legal notice of the request for vacation was;sent by certified mail to all:propy
owners in accordance:with Idaho Statute and Eagle City Code.on'October 8,2021;and
WHEREAS,On October 26 2021,the City Council held a public bearing on the proposed
vacation(VAC-04 21),and voted to approve the vacation;and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Codex"Vacation of Plats-<Procedure",and Section 9-6 4.of
Eagle City Code,"Vacations and Dedications"
NOW THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL Of THE CITY OF
EAGLE,IDAHO.
The Eagle City Council hereby vacates the two foot (2') wide portion of the public utilities,
irrigation, and drainage easement along the easterly boundary.of Lot 4,Block 1,of the final plat of Park
Lane Estates, as consisdered, heard and approved by the Council'at its October 26, 2021,. public hearing
for:application numb er VAt 04-2I and as shown on the attachments hereto(Exhibit A).
This Resolution shall be in lull force and effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of E le,Idaho,this 14th:day of December 2021.
