W REAS, Oakmont Signature Homes LLC, represented by Jordan Thompson; requested'a vacation of the final plat of Park Lane Estates Subdivision to remove a two foot(2')wide portion of the twelve foot (12') wide public utilities, irrigation and drainage easement located along the easterly boundary of Lot 4,Block I of Park Lane Estates Subdivision;and; WHEREAS;On October 4 2021,the.Planning and Zoning Commission recommended approval of the vacation(VAC 04-21) to the City Council;and WHEREAS.Legal notice of the request for vacation was;sent by certified mail to all:propy owners in accordance:with Idaho Statute and Eagle City Code.on'October 8,2021;and WHEREAS,On October 26 2021,the City Council held a public bearing on the proposed vacation(VAC-04 21),and voted to approve the vacation;and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50-1306A of the Idaho Codex"Vacation of Plats-<Procedure",and Section 9-6 4.of Eagle City Code,"Vacations and Dedications" NOW THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL Of THE CITY OF EAGLE,IDAHO.
