A RESOLUTION OF THE CITY OF EAGLE, IDAHO, DECLARING BROADBAND
INTERNET TO BE AN ESSENTIAL SERVICE, AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,the City of Eagle "Eagle is Home" Comprehensive Plan, was adopted by the
Eagle City Council on November 15, 2017; and
WHEREAS, the "Eagle is Home" Comprehensive Plan states in its intent, within Chapter
4: Utilities, Facilities, and Services, Section 4.10.2 Objectives, Policy "F" states, "Work with
telecommunication and internet providers to ensure that the Eagle comprehensive planning
boundary is provided uninterrupted access to up-to-date, state-of-the-art telecommunications and
internet service." Section 4.10.3, Implementation Strategies, Policy "L" states "The City should
work with telephone and telecommunications utilities to encourage new development to include
in the development plans advanced services such as fiber optic and WiFi," and Policy"M" states,
"Establish policies for the expansion of broadband and fiber optic services to the City."; and
WHEREAS,the "Eagle is Home" Comprehensive Plan states in its intent, within Chapter
5: Economic Development, Section 5.7, Policy "H" states, "Encourage development of desirable
services, infrastructure, and amenities to serve employees of Eagle's business and technology
sectors."and
WHEREAS, the Federal Communications Commission (FCC) has deemed broadband
internet access service to be an essential telecommunications service under Title II of the
Communications Act of 1934; and
WHEREAS, broadband internet access service is currently defined by the Federal
Communications Commission (FCC) as internet service with a minimum download speeds of 25
Megabits per second(Mbps) and minimum download speeds of 3 Mbps; and
WHEREAS, when electricity and telephone service first became viewed as essential to
society, federal, state, and local governments worked in accordance with programs established
pursuant to the Rural Electrification Act of 1936 and the Communications Act of 1934 to ensure
that citizens have universal access to these essential services; and
WHEREAS, federal and state efforts to promote broadband internet access should not
erode longstanding requirements to ensure universal access to all essential communications
services that are reliable and affordable to the residents of the City of Eagle; and
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
CITY OF EAGLE, IDAHO:
Section 1. That broadband internet access is an essential telecommunications service that
should be accessible and affordable to the residents of the City of Eagle.
Section 2. That federal, state, and local governments have a role in ensuring, supporting,
and facilitating reliable, affordable broadband internet access services.
This Resolution will be in full force and effect upon its adoption and approval this 14th day of
December 2021.
