Minutes - 1987 - City Council - 05/12/1987 - RegularEAGLE CITY COUNCIL ~EETING ~ay 12, 1987 The City Council met in regular session at the Eagle Primary School on Tuesday, May 12, 1987. Mayor CAROL HALEY presiding. Roll call showed the following members present: GUERBER, MATLOCK, MINOW, ROGERS. ~4otion made by GUERBER to accept the minutes of the April 21, 1987 meetina with the correction on page ~ 9th paragraphto read that GUERBER made that motion. ~otion seconded by ~"ATLOCK. ALL AYE: MOTION CARRIED. PUBLIC HEARING: GARP~TT REZONE. Mayor Haley announced that it was the time and the place for a public hearing regarding a rezone application submitted by Homer Garrett. The zoning is now established as residential, the application request zoning C-3 to provide for a small engine repair and rental business. The time was 7:33 p.m. Representative for Mr. Garrett was Chuck Palmer. Mr. Palmer stated that in the location that the property is in that it would be suited for a business and that commercial will probably be in that area in the future. He indicated that as the property sits now it is neglected and with the construction of a business that the property would be improved. Mayor HALEY called for those in opposition to the project. Those in opposition were: Francis Transtrum and Donna Abbott who both indicated that there are empty buildings in the citv now add they do not ~esire another. If the business doesn't make it %here will be an empty b~il~ing. tt is a residential district with houses and churches and their desires are that it remain that way. They state that it was their understanding that Eagle businesses would move to the east and not to the west. The public hearing closed at 7:40 p.m. Discussion by the council resulted in a motion by MINOW to deny the application as it creates spot zoning with residential all the way around it. Motion was seconded by GUERBER. ROLL CALL ON THE MOTION RESULTED AS FOLLOWS: AYE: GUERBER, MATLOCK, MINOW, ROGERS. MOTION CARRIED. APPLICATI©~ DENIED. PUBLIC HEARING/WILDER/WRICHT ANNEXATION AND ZONIP~G: Public hearing on application submitted by John Wilder beaan at 7:55 p.m. Representative for the application was Joe Rausch for Wright Bros. Mr. Rausch indicated that the property use woul(~ be for Mini Storage and RV parking. Mayor Haley.called for those in favor and in opposition. There was no tesitmony. Public hearing closed at 7:57 City Council May 12, 1987 Page 2 Motion made by GUERBER to annex and zone C-3 to allow a Mini Storage and ~7 parking. Motion was seconded by MINOW. ROLL CALL ON THE MOTION IS AS FOLLOWS: AYE: GUERBER, MATLOCK, MINOW, ROGERS. MOTION CARRIED. ORDINANCE 9115, FLOOD PLAIN: Motion to dispense with the three day ruling as provided in Idaho Code, Section 50-90 by GUERBER, motion seconded by M1NOW, ALL AYE: MOTION CARRIED. Motion by GUERBER to acceDt Ordinance #115, a Flood Plain Ordinance as presented,.motion seconded by ROGERS. ALL AYE: MOTION CARRIED. ORDINANCE #116, ANNUAL SALARY AMENDMENT ORDINANCE: Motion by MATLOCK to dispense with the three day ruling as provided in Idaho Code, Section 50-90, motion seconded by MINOW. ALL AYE: MOTION CARRIED. Motion by MATLOCK to accept Ordinance #116, a salary amending Ordinance, motion seconded by MINOW. ROLL CALL ON THE MOTION RESULTED AS FOLLOWS: NAY: GUERBER, AYE: MATLOCK, MINOW, ROGERS. MOTION CARRIED. MIDWESTE~ CONTRACTORS: Presentation by Fred C. Rathbone regarding a project in the Eagle Impact Area. Midwestern has sub-leased the Marcum Sand and Gravel Pit next to Monroe Concrete Co. on State St. and desire to install a hot plant, scales and use the property for contractors yardi, office, shop, steel fabrication and storage. Midwestern would like to have the written approval of the City of Eagle to present to Ada County for supDort in their efforts to get Ada County approval. It was ~he qeneral opinion of the Council to agree to write the letter to Midwestern, from City Hall, granting support. BOISE-ADA, BFI FRANCHISE: It was the general opinion of the council to table any Franchise discussion until such time as the current Franchise suit in progress regarding Intermountain Gas has come to a conclusion. ADA COUNTY TRANSMITTAL 87-3-PR: No objection from Council and no action taken. Transmittal received late. ADA COUNTY TRANSMITTAL 87-07-TLQ: No objection from Council and no action taken. Transmittal received late. TINO'S S.~ALL ENGINE REPAIR: Motion by GUERBER to follow the guidelines set by Design Review and require Mr. Sanchez to comply with those guidelines. Motion seconded by ROGERS, ALL AYE: MOTION CARRIED. RIVERSTONE SUBDIVISION: Motion by GUERBER to grant a one year extension on the project. Motion seconded by MATLOCK. ALL AYE: MOTION C~RRIED.
