MEETING MINUTES
October 26,2021
I. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m.
2. ROLL CALL: Present: GINDLESPERGER, PITTMAN, BAUN, PIKE. All present. A
quorum is present.

5. REPORTS:
A. Mayor and Council Reports: Pittman expresses his condolences to those impacted by
yesterday's tragedy in Boise. The response by emergency service personnel, as well as citizens
helping one another was heartening.Our thoughts and prayers are with those effected.Mayor Pierce
concurs with statements made by Council member Pittman.
B. City Hall Department Supervisor Reports: Chief Wilke makes a brief statement regarding
the tragedy at Boise Towne Square. Pike encourages Eagle to reach out to leadership in other
communities to directly convey our support.
C. City Attorney Report: None
6. PUBLIC COMMENT 1: The Eagle City Council is taking in person and remote public

This time is reserved for the public to address their elected officials regarding concerns or
comments they would like to provide to the City Council regarding subjects not on the agenda.
At times,the City Council may seek comments/opinions regarding specific City matters during
this allotted time. This is not the time slot to give formal testimony on a public hearing matter.
land use application,or comment on a pending application or proposal. Out of courtesy for all
who wish to speak, the City Council requests each speaker limit their comments to three (3)
minutes.
Stan Ridgeway, 1735 W. Rush Rd., Eagle, Idaho. Mr. Ridgeway inquires if public comment will
be taken on new business items on the agenda tonight. He states that recent legislation requires the
notation of action items on the agenda. He believes that the public has the right to speak to all
business items to increase transparency. Mr. Ridgeway comments on the large number of regular
and special council meetings mostly post pandemic and the time of day they were held. He
encourages the Council to allow public comment on items so that they(Council)knows how people
feel about items and so things aren't ran like a dictatorship. A new organization has been formed
SOS Eagle a 501 (c)(4)entity and they are going to keep an eye on what is happening.
City Attorney Villegas speaks to the legislative regulations regarding due process. Due process at
the local and federal level requires that the public has the right to come watch and hear what is
being decided, but it does not mandate that the public comment on all items. However, there are
items that require a public hearing wherein the public may testify, and the City does notice those
items as such on their agendas. The City has followed what the Idaho Legislature has mandated

they do in or order to do. The City has complied with State code regarding meeting notifications
for regular and special meetings.
Judy Dahl, 735 N. Echohawk Way, Eagle, Idaho. Ms. Dahl has questions regarding the posting of
the agenda, the timeline for submittal deadline for written comments and suggests an improved
process.
Jon Seel, PO Box 93, Eagle, Idaho. Mr. Seel reads a statement regarding SOS Eagle and their
mission statement. SOS Eagle is a not-for-profit organization made up of individuals interested in
assuring that you, our elected representatives, are representing Eagle residents and area of impact
resident's best interests. The group also does not feel a financial analysis was done regarding the
acquisition of Eagle Water Company, the residents want more involvement and opportunity to
comment.
Council Member Pike inquires if anyone in the group ever reached out to the Mayor or any of the
elected officials regarding their concerns. He takes exception with being accused of unethical
behavior and dictatorship-type proceedings. Pike states that'he has dedicated his life to public
service and is personally offended by the implication of wrongdoing by this Mayor and Council.
Bob Van Arnem, 3149 Whitepost, Eagle, Idaho. He is not a part of any group; he is here on his
own. He has made it a point to maintain independence of thought and come to his own conclusions.
He appreciates Council Member Baun's comments on September 12" and October 12' regarding
Ordinance 861. Baun's comments were thoughtful and well-articulated. He mentioned the blanket
clarification of no shooting vs the new ordinance language, he mentioned the type of firearm and
the distance traveled of bullets, acreage size(20 acres)and the annexation of land. Ordinance 145
proceeded this and stood for 32 years and asks if law enforcement input was received regarding the
new ordinance.
Nancy Viano, 704 N. Nicholas Lane, Eagle, Idaho. She inquires if shooting could be allowed on
Eagle Hills Golf Course.
Discussion. Mayor Pierce states that the parcel would need to be a minimum of 20 acres, not just
individual adjacent parcels of that cumulatively meet the 20-acre mark.
Cheryl Allen, 1306 E. Covey Run Ct., Eagle, Idaho. She believes the Council's job is to represent
the citizens of Eagle. She states that Council listens but then Council does what they want anyway.
Ms. Allen has reached out but does not feel that the Council reflects the citizens desires.
Mayor Pierce states that the Mayor and Council are responsible to represent 30,000 people. All
comments are listened to, and considered, however, the decision that is ultimately made is made
with an eye to the City as a whole, not just the 100 or so engaged.
Barb Jekel, 2862 Haven Dr., Eagle, Idaho. She is in support of the message that there is a
communication gap. In years past there was a greater effort for public outreach wherein signs were
placed regarding meetings. She suggests a greater outreach to the public on these type of topics.
Mayor Pierce states that the public can sign up to receive emails of all agendas via the website. It
is an excellent tool to stay informed.
7. ALL CONSENT ITEMS ARE CONSIDERED ACTION ITEMS: CONSENT AGENDA:
• Consent Agenda items are considered to be routine and are acted on with one motion.
There will be no separate discussion on these items unless the Mayor, a Councilmember,
member of City Staff,or a citizen requests an item to be removed from the Consent Agenda

for discussion. Items removed from the Consent Agenda will be placed on the Regular
Agenda in a sequence determined by the City Council.
• Any item on the Consent Agenda which contains written Conditions of Approval from the
City of Eagle City Staff, Planning & Zoning Commission, or Design Review Board shall
be adopted as part of the City Council's Consent Agenda approval motion unless
specifically stated otherwise.

B. TML Commercial Service Contract Agreement: A service contract agreement between
the City of Eagle and TML Commercial to upgrade and install an HVAC system at Eagle
City Hall in an amount not to exceed $106,098. (EZ)
C. Appointment to the Mayor's Youth Advisory Council: In accordance with Resolution
14-19, Mayor Pierce is requesting Council confirmation of Raegan Fordemwalt new
member to the Mayor's Youth Advisory Council. (JP)
D. Parks and Recreation Independent Contract Instructor Agreement: Authorizing the
Mayor to execute an agreement for an independent contract instructor with Joanne Thong
to facilitate language classes for the Parks and Recreation Department. (BJ)
E. DR-05-03 MOD—Modification to the Exterior Building Elevations and Addition of a
Patio for a Restaurant with Drive Through Building(Wendy's)—Wendy's: Wendy's,
represented by Cesar Segovia, is requesting design review approval to modify the exterior
building elevations of a 3,100-square foot restaurant with drive through building and modify
the site to add a patio area. The 0.92-acre site is located at the southeast corner of Eagle
Road and East Eagle River Drive at 65 East Eagle River Street within Eagle River
Development. (ERG)
F. DR-38-21 — Multi-tenant Flex Space Office Building for Balmshot — Daniel Walker:
Daniel Walker, represented by Joe Thompson with BRS Architects, is requesting design
review approval to construct a 6,000-square foot multi-tenant flex space office building.
The 0.61-acre site is located on the south side of East Iron Eagle Drive approximately 585-
feet west of South Edgewood Lane at 1395 East Iron Eagle Drive(a portion of Lot 3, Block
3, Merrill Subdivision No. 1). (BAW)
G. DR-39-21—Master Sign Plan for a Multi-tenant Flex Space Office Building,including
Signage for Balmshot— Daniel Walker: Daniel Walker, represented by Daren Epperson
with The Sign Center, is requesting design review approval for a master sign plan for a
multi-tenant flex space office building, including signage for Balmshot. The 0.61-acre site
is located on the south side of East Iron Eagle Drive approximately 585-feet west of South
Edgewood Lane at 1395 East Iron Eagle Drive (a portion of Lot 3, Block 3, Merrill
Subdivision No. 1). (BAW)
H. DR-40-21 — Office (Business and Professional) and Storage Building within Eagle
Island Crossing—Stefan Gleason: Stefan Gleason, represented by Andy Erstad and Nick
Oelrich with Erstad Architects, is requesting design review approval to construct a 38,099-
square foot two story (1st Floor= 23,379-SF and 2nd Floor= 14,720-SF) office (business
and professional)and storage building. The 2.71-acre site is generally located northeast of
State Highway 44 and North Fisher Park Way at 74 North Fisher Park Way within Eagle
Island Crossing(Lot 4, Block 2, Arts West Subdivision and Lots 8, 9, and 10, Block 2, Arts
West Subdivision No. 2). (BAW)
I. Findings of Fact and Conclusions of Law for the Approval of FPUD-07-21 & FP-13-
21 —Final Development Plan and Final Plat for Whitehurst Subdivision No.2—Evans
Development LLC: Evans Development LLC, represented by Becky McKay with
Engineering Solutions, LLP, is requesting final development plan and final plat approvals
for Whitehurst Subdivision No. 2, a 28-lot (25-buildable, 3-common), residential
subdivision. The 12.72-acre site is located approximately 775-feet north of the terminus of
West Breanna Drive east of Eagle High School. (DLM)
J. FPUD-08-21 & FP-14-21 — Final Development Plan and Final Plat for Rene Place
Subdivision No. 2 — MCG Sterling, LLC: MCG Sterling, LLC, represented by Becky
McKay of Engineering Solutions LLP, is requesting final development plan and final plat

K. Live Performance Agreement: The Parks and Recreation Department is seeking Council
approval for a Live Performance Agreement between the City of Eagle and Musicians Three
in an amount not to exceed $800. They will be performing at Eagle Country Christmas
taking place on December 4, 2021. (PT)

M. Declaring a Sole Source Procurement with Fatbeam,LLC: This declaration is based on
the determination that Fatbeam, LLC is the only vendor reasonably available to provide
joint trench, installation of conduit, and, where available, installation of fiber as part of the
municipal fiber optic system as allowed under Idaho Code §67-2808 (2)(a) and §67-
2808(2)(b)viii. (NBS)
N. Resolution 21-22— Establishing a Comprehensive Plan Review Committee: A
resolution of the City Council of the City of Eagle, Ada County, Idaho, establishing a
Comprehensive Plan Review Committee, the purposes of such Committee, the term of the
Committee,Committee members,and a sunset date,and providing an effective date. (NBS)
O. Professional Services Agreement with EntryPoint Networks, LLC: A professional
service agreement between the City of Eagle and EntryPoint Networks, LLC for fiber optic
planning, technology, networking, security, and other related consulting service in an
amount not to exceed $24,000. (EZ)
Pittman asks for item 7B to be removed from the Consent Agenda. Judy Dahl asks for item
7J to be removed from the Consent Agenda.

B. TML Commercial Service Contract Agreement: A service contract agreement between
the City of Eagle and TML Commercial to upgrade and install an HVAC system at Eagle City Hall
in an amount not to exceed $106,098. (EZ)
Pittman asks for additional clarification on the requested contract.
Public Works Director, Eric Ziegenfuss states that this item is in the Capital Maintenance Program,
that is scheduled to be conducted within the next two years. This contract would move that timeline
up. With the installation at this time the units would be the same as that which will be installed
with the City Hall addition.
Pittman moves to approve TML Commercial Service Contract Agreement. Seconded by
Baun. Gindlesperger AYE; Pittman AYE; Baun AYE; Pike AYE. ALL AYE...MOTION
CARRIES.
J. FPUD-08-21 & FP-14-21 — Final Development Plan and Final Plat for Rene Place
Subdivision No.2—MCG Sterling,LLC: MCG Sterling, LLC, represented by Becky McKay of
Engineering Solutions LLP, is requesting final development plan and final plat approvals for Rene
Place Subdivision No. 2, a 21-lot(19-buildable,2-common)residential subdivision. The 3.82-acre
site is located approximately 0.25 miles west of Hwy. 55 and 0.3 miles south of Floating Feather,
immediately south of the Farmers Union Canal. (MNB)
Judy Dahl,735 N. Echohawk Way, Eagle, Idaho. She believes this is too soon to be on the agenda.
She inquires if a comprehensive plan amendment was done for a compact area north of Sadie Drive.
These plans have been misrepresented and feels that an injunction should be filed.

Zoning Administrator Vaughan provides an overview regarding original application and the
subsequent appeal process that is made available on applications.
Planner Ill, Mike Williams is the Planner that processed the application. Williams provides
clarification on the application and conformance with the Comprehensive Plan.

easterly boundary of Lot 4, Block 1, Park Lane Estates. The applicant requests a reduction of the
easement from twelve feet (12 ft.) to 10 feet (10 ft.) in width. The 0.41 acre lot is located in the
northeast corner of Park Lane Estates,just south of Beacon Light Rd. and approximately 500 ft.

B. ACTION ITEM. RZ-13-21 — Rezone from BP to C-1-DA — Rudeen Architects: Rudeen
Architects, represented by Stephanie Hopkins with KM Engineering, is requesting a rezone from
BP (Business Park) to C-1-DA (Neighborhood Business District with a development agreement)
to establish "medical office" as a permitted use. The 1.03-acre site is located on the south side of
East McGrath Road approximately 380-feet southeast of the intersection of East McGrath Road
and East State Street. (DLM)

Architects. Seconded by Gindlesperger. Baun amends to add item 3.18 condition of approval

C. ACTION ITEM A-05-19/RZ-11-19/RZ-06-04 MOD4/CU-10-19/PPUD-07-19/PP-07-19 —
Route 44 Crossing Subdivision—Jay Walker: Jay Walker is requesting annexation, rezone from
R1 and C2 (Estate Residential and Community Commercial - Ada County designations) to C-1-
DA-P (Neighborhood Business District with a development agreement - PUD), development
agreement modification and conditional use permit,preliminary development plan,and preliminary
plat approvals for Route 44 Crossing Subdivision, a 71-lot (41-single-family [inclusive of 9-
live/work lots], 10-commercial [inclusive of 2-storage unit lots], 20-common)
residential/commercial planned unit development. The 15.68-acre site is located at the northeast
corner of State Highway 44 and North Linder Road at 410 North Linder Road and 4400 West State
Street. (MJW)

Ken Firmage, representing FS1, 4909 W. French Glen, Eagle, Idaho. Mr. Firmage shows a brief
video and gives a general flavor of what is being proposed. He reviews the application and the
amenities of the proposal.
Council Member Pike expresses his concern with the roads and the impact on Linder. Baun also
has concerns with the road. Comments on green space and if the applicant is willing to participate
in the Conservation and Education Program (CEP). Gindlesperger discusses traffic flow and
maneuverability of oversized vehicles.
Planner III, Mike Williams reviews the staff report and areas of special concern.

Don Huckdale, 142 N. Salina Ave., Eagle, Idaho. Mr. Huckdale represents Sedona Creek
Homeowners Association. The developer has been working well with the HOA and they support
the development.
Mark Butler, 1675 E. Bishop Way, Eagle, Idaho. Mr. Butler provides history on this property as
he represented the developer and how the comprehensive plan came to reflect commercial in this
area. He feels it would be a shame to lose commercial at this location. Mr. Butler addresses the

difference between trip generation vs trip capture, and how the difference between residential and
commercial development impacts traffic.
Judy Dahl, 735 N. Echohawk, Way Eagle, Idaho. She does not recommend going after ACHD
legally. If the Developer would build the street to code there wouldn't be an issue.
Dave Yorgason, 14254 W. Battenburg. Mr. Yorgason states that the irrigation district would not
allow a private bridge over the canal. He understands the need for connectivity, there is concern
with cut through traffic.
Gary McAllister, 2115 E. Motion St., Meridian, Idaho represents Shady Acres, the property to the
east of the development. They are in support of the proposed development.
Mr. Firmage rebuts testimony.They have constructed roads to ACHD standards.They have worked
with the neighbors to include residential as they did not want it all to be commercial. Discusses
the challenges with ACHD and the proposed roads within the development.
Mayor closes the public hearing.
Pike expresses his concern with the access to Linder. Pittman is concerned with Linder access also,
but more the public/private road situation, he would prefer the road be public. It is a great fit, and
he is glad they worked with the neighbors. Gindlesperger agrees with the comments by Pike and
Pittman. The location of the proposed storage and vehicle usage is of concern. She agrees that
commercial should perhaps be retained. Baun concurs with Pittman and Pike. He does like
commercial in this area. He wishes there was more green space proposed. He 100% agrees this
needs to be a public road.
Director of Long-Range Planning and Projects, Nichoel Baird-Spencer provides history on the
roadway designation. She provides suggestion on a way to move forward with Council's desire for
a public road on the project.
Baun moves to approve 9C A-05-19/RZ-11-19/RZ-06-04 MOD4/CU-10-19/PPUD-07-19/PP-
07-19 — Route 44 Crossing Subdivision with the following, that the road is identified as a
public road and sending it (the road) back to ACHD commissioners. As well as all other
conditions of approval. Seconded by Pittman. Discussion. Baun amends to include the CEP
funds as approved by the developer.Second concurs.Discussion.Baun amends to a minimum
of 24% open space on site. Second concurs. Discussion. THREE AYE: ONE NAY
(Gindlesperger). Motion carries.
10. NEW BUSINESS:
A. ACTION ITEM: Ordinance 858: An ordinance of the City of Eagle, Ada County Idaho,
amending Title 8 "Zoning", Chapters 1, 2 & Article 2A, 3, 6, 7, adding a new Chapter 12, and
amending Title 9 "Land Subdivisions", Chapters 1, 2, 3, 4, 5, 6; providing a severability clause;
and providing an effective date. (WEV)
Mayor Pierce introduces the item.
Zoning Administrator Vaughan reviews the requested changes.
Pittman moves, pursuant to Idaho Code, Section 50-902,that the rule requiring Ordinances
to be read on three different days with one reading to be in full be dispensed with,and that
Ordinance#858 be considered after being read once by title only. Seconded by
Gindlesperger. ALL AYES... MOTION CARRIES.

B. ACTION ITEM. Extension of Municipal Water Services Outside the Incorporated City
Limits: Council will consider establishing a policy to formally allow for the extension of municipal
water service outside the City Limits but within the municipal water service planning area through
contract. (JP)
Mayor Pierce introduces the item.
Mayor states that the City has been approached by people not within the water system. The Mayor
states that the water system would need to be constructed and water shares turned over to the City
as in other annexations.
Pittman inquires if any water shares would be taken from the City system or if the owner would
bring their own shares to be utilized. Pike states that the water system is an enterprise fund. Mayor
states that this will give the City control of the water rather than the people approaching other water
providers. Pittman states that this gives owners an option. Gindlesperger confirms that this option
would not necessarily guarantee annexation into the City of Eagle.
Baird-Spencer states that approval by IDWR would be required, other agreements will need to be
acted on by Council should they direct staff to move forward.
Baun states that the infrastructure is given to the City at zero cost to the City and protects the
aquafer.
Baun moves to approve action item 10B Extension of Municipal Water Services Outside the
Incorporated City Limits. Seconded by Gindlesperger. ALL AYE... MOTION CARRIES.

Judy Dahl asks questions is regarding the Comprehensive Plan and the compact designation.
Ms. Dahl expresses her concern with non-compliance of the Comprehensive Plan.
Mark Butler, 1675 E. Bishop Way, Eagle, Idaho. Mr. Butler is happy with the return of
shooting rights on BLM land. He appreciates it.

I2. EXECUTIVE SESSION:
A. Idaho State Code$74-206. Executive sessions -- When authorized. (1) An executive session
at which members of the public are excluded may be held, but only for the purposes and only in
the manner set forth in this section. The motion to go into executive session shall identify the
specific subsections of this section that authorize the executive session. There shall be a roll call
vote on the motion and the vote shall be recorded in the minutes. An executive session shall be
authorized by a two-thirds(2/3)vote of the governing body. An executive session may be held:
(c) To acquire an interest in real property which is not owned by a public agency.

Mr. Mayor and Council Members:
SOS Eagle is a not-for-profit organization made up of individuals interested in
assuring that you, our elected representatives, are representing Eagle residents and
area of impact residents' best interest.
The City's Comprehensive Plan Page 10 States, Vision; Citizen involvement and
support is very important. The public should be aware of and involved in the
City's planning decisions. Based on Public Input, the Planning and Zoning
Commission and City Council make their decisions.
It appears that major changes to some policies and ordinances are being made
without consideration to the Comprehensive Plan and State Law.
We encourage you to change your practices to assure more opportunities for public
input.
