Minutes - 2021 - City Council - 11/09/2021 - Regular EAGLE CITY COUNCIL MEETING MINUTES November 9,2021 1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m. 2. ROLL CALL: Present: GINDLESPERGER, PITTMAN, BAUN, PIKE. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: 4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA: A. City Staff requests. Zoning Administrator Vaughan requests the removal of Consent Agenda item K and remand it to staff. B. Mayor or City Council requests. 5. PRESENTATION: A. Valley Regional Transit Quarterly Update: Steven Hunt, Regional Director of Valley Regional Transit (VRT). Discusses the suspension of the 9 Extension, routes, ridership and promotion of services available through Valley Regional Transit as well as the FY 2023-2027 Transportation Development Plan. PowerPoint attached. Pittman encourages an informational exchange with VRT, and community partners in the valley to exchange ideas and information. 6. REPORTS: A. Mayor and Council Reports: Gindlesperger reports on the Animal Control Advisory Committee. Eagle Arts Commission will not be holding the Quilt Show for this Country Christmas due to staffing issues. Gindlesperger thanks the Eagle Community for their support at the last election. Pittman reports on the Eagle Senior Center meeting. Pittman reports on activities by the Eagle Sewer District in October they treated 60.38 million gallons, which is approximately 2 million gallons a day. Pike appreciates being able to attend via Zoom at the last meeting as he was unwell. Baun states that there are openings on the Eagle Comprehensive Plan Committee, people can apply online,announcements have been made and more information is available on the website. Mayor Pierce congratulates Helen Russell and Melissa Gindlesperger on the results of the election. B. City Hall Department Supervisor Reports: 1. City Treasurer Financial Reports for September and Quarter Ending 09-30-21 C. City Attorney Report: None 7. Drainage Receiver Agreement for 560 East State Street (DR-66-20) — Bank with Drive- Up Service for Idaho First Bank: Idaho First Bank, represented by Greg Toolson with JGT Architecture: Idaho First Bank is requesting approval of a drainage receiver agreement between the bank site and 100 North Stierman Way (City of Eagle parking lot and private lane). The 0.57-acre site is located on the northeast corner of East State Street and North Stierman Way at 560 East State Street. (ERG) D. Western Heating& Air Service Proposal: A service proposal between the City of Eagle and Western Heating & Air to install an electric furnace for the Dog Park restroom in an amount not to exceed $5,035. (EZ) E. Agreement for Development of Pamela Baker Park Phase II: An agreement between the City of Eagle and Dennis M. Baker Foundation, Inc., for the development of Pamela Baker Park Phase II in an amount not to exceed$288,286. (EZ) F. Sole Sources Agreement with Biarri Networks for Design Service for a Municipal Fiber Network Plan: Having declared and published as a sole source contract under Idaho Code §67-2808(2)(a) and §67-2808(2)(a) (2)(b) and having receive no opposition, the city entering into a contract with Biarri Networks in an amount not to exceed $14,000. (EZ/NBS) G. Temporary Construction Easement with BB One, LLC.: Temporary Construction Easement with BB One, LLC. for the construction of the Eagle Road Pedestrian Bike Bridge, ITD Key No. 20841. (NBS) H. Findings of Fact and Conclusions of Law for the Approval of RZ-13-21 — Rezone from BP to C-1-DA — Rudeen Architects: Rudeen Architects, represented by Joshua Jantz with KM Engineering, is requesting a rezone from BP (Business Park) to C-1-DA (Neighborhood Business District with a development agreement)to establish "medical office" as a permitted use. The 1.03-acre site is located on the south side of East McGrath Road approximately 380- feet southeast of the intersection of East McGrath Road and East State Street. (DLM) I. Equipment Property Donation Acceptance: The Public Works Department is requesting Council acceptance for a donation of a BAGJUMP Standalone Foam Pit Airbag with a value of$18,020. (EZ) N. FP-12-21 — Final Plat for Eastfield Subdivision — Schneider Custom Homes Inc.: Schneider Custom Homes Inc., represented by Dylan Schneider, is requesting final plat approvals for Eastfield Subdivision,a 32-lot(27-buildable, 5-common)residential subdivision. The 4.58-acre site is located on the northwest corner of East Hill Road and North Edgewood Lane at 200 North Edgewood Lane. (MNB) O. Live Performance Agreement: The Parks and Recreation Department is seeking Council approval for a Live Performance Agreement between the City of Eagle and Samuel Henry in an amount not to exceed $115. They will be performing at Eagle Country Christmas taking place on December 4, 2021. (PT) P. Minutes of October 26,2021. (TEO) Pittman requests 81 and 8K be removed. (EZ/NBS) Mayor introduces the item. Director of Long-Range Planning and Projects, Nichoel Baird-Spencer reviews the sole-source agreement. With the following changes staff is recommending the contract be approved. The contract will be between Biarri and the City of Eagle on page 1,on page 7 under expenses it should read that any travel related expenses shall be approved by the City of Eagle prior to occurring and on the last page the signature line should be Mayor of Eagle for signature. Planner II, Emily Gero addresses the hours of illumination for the monument sign. Gindlesperger asks if a revised design has been submitted. Staff displays the latest design submittal. Discussion regarding hours of illumination and sign design. Baun moves to approve 8L DR-13-97 MOD — Monument Sign for Eagle Middle School — Eagle Middle School with provisions outlined limiting usage from 7:30 am to 5:30 pm unless there is a closure or emergency. Seconded by Pittman. Discussion. Baun rescinds his motion and moves to remand this back to staff. Seconded by Pittman. ALL AYE...MOTION CARRIES. 9. UNFINISHED BUSINESS: A. ACTION ITEM: City Review of Ada County Highway District (ACHD) Integrated Five Year Work Program: ACHD has issues it final draft of the Integrated Five-Year Work Program. Staff will provide the Council an overview of the document and request any additional comments for submittal to ACHD. (NBS) Mayor introduces the item. Director Baird-Spencer provides an overview of the Integrated Five-Year Work Program. Discussion regarding the funding of Eagle projects and the delay of several due to ACHD deciding to not take $1.6 million in foregone, instead they chose to take $422K to fund operations and maintenance only. Pittman is disappointed with the de-prioritization of projects in Eagle based on the funds collected by Eagle. Mayor Pierce reminds Council that the recommendations being reviewed tonight are from Ada County Highway District Staff and have not been approved by the Page 4 K:\COUNCIL\MINUTES\Temporary Minutes Work Area\CC-11-09-21min.docx Commissioners yet. He has had several good conversations with Commissioner May regarding Eagle's concerns. Pike would like to see how other city's projects were allocated and see if projects across the board were bumped or not. General discussion. Director Baird-Spencer is seeking Council direction for staff to prepare a letter to respond to ACHD on the latest draft of the integrated 5-Year Work Plan Baun makes a motion to do what Nichoel just said.Seconded by Pike. The 16.34-acre site is located on the south side of East Beacon Light Road, approximately 630-feet west of the intersection of East Los Luceros Drive and East Beacon Light Road at 801 East Beacon Light Road. McKay addresses questions regarding the roadways, and while the roads will be considered private, they will still need to be constructed to ACHD standards. Discusses drainage retention and tree removal/mitigation. Mayor closes the public hearing. Discussion. Pittman feels a public street designation is important. Also based on the location he understands the need for septic vs within the sewer district. NEW BUSINESS: A. ACTION ITEM. Council Decision Regarding Opioid Settlement Participation. (VV & TEO) Mayor introduces the item. City Clerk, Tracy Osborn provides an overview of the Opioid Settlement and seeks Council direction as to participation in the settlement. Council discussion. Gindlesperger moves to approve action item I la council decision regarding opioid settlement participation. Seconded by Baun.Discussion.Gindlesperger amends to clarify that the funds will be retained to be used locally. Second concurs. ALL AYE...MOTION CARRES B. ACTION ITEM Ordinance No. 862: An Ordinance of the City of Eagle, Ada County, Idaho amending Title 3, Chapter 4, Vendors, Solicitors and Temporary Merchants; providing for severability; providing for codification; and providing an effective date. (TEO) Mayor introduces the item. City Clerk Osborn provides a review overview of the required code changes needed to comply with the Federal Bureau of Investigation standards.
